This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that is set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177 which grants an extra year for a total of four (4) years extension. Accordingly, Stormwater Permit # SW8 990236, which has already expired on August 11, 2009, is now in effect until August 11, 2013. A letter was sent to you on March 12, 2013 notifying you that the expiration date associated with this permit had been extended until August 11, 2013 and requesting that the renewal application be submitted 180 days prior to this date. This letter was returned as "Not deliverable as addressed. Unable to forward." On June 10, 2013, Christine Nelson of the Wilmington Regional Office of the Division of Water Quality (DWQ) conducted a file review inspection of Superior Center in New Hanover County to determine compliance with Stormwater Management Permit Number SW8 990236 last issued on August 11, 1999. DWQ file review revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. As indicated in the attached inspection report, the following must be resolved: 1. Please complete and submit the renewal application along with the application fee. The renewal application can be found on the following website: http://portal.ncdenr.orglweb/wq/ws/su/statesw/forms dots This permit expires on August 11, 2013 and per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. 2. As required by Section 11.7 of the permit, please submit the completed designer's certification. Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification from an appropriate designer for the system installed must be submitted to the Division. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. Please confirm whether or not J & S Miller, Inc is the current owner of this property. According to the NC Secretary Of State, J & S Miller, Inc. has dissolved. According to the New Hanover County GIS tax records, this project area appears to have been subdivided and ownership has changed/transferred to Superior Center LLC and Superior Center COA, Inc without notifying DWQ. As indicated by Section 111.1 of the permit, the permit is not transferrable and an application to change the ownership of a permit must be submitted to and approved by DWQ. If portions of the property are or have been subdivided and sold to a separate entity, the permit will also need to be modified (as required by Section 11.13 of the permit) and deed restrictions will have to be recorded on those subdivided portions. Please be aware that the permit can only be transferred once the aforementioned compliance items are resolved and the site is found to be in compliance. The forms necessary to apply for a change of ownership, which should be completed and submitted once the site is found to be compliant, can be found on the following website: http://portal.ncdenr.o[g/web/wg/ws/su/statesw/forms dots. Please inform this Office in writing before July 12, 2013, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, or to respond to this letter by the due date, may initiate enforcement action including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not submitted to this office by July 12, 2013 then DWQ staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed. Please be reminded that if an ownership change, or a name change or a mailing address change has occurred, it is your responsibility to submit a completed and signed Name/Ownership Change form to the Division. Please include the name, mailing address and phone number of the party who is now responsible for this permit. Control cattail growth to a minimum of 50%. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $10,000 per day. A revised O&M form showing the pond design depth to be 5.0' (Elev. _ 33.0') and the sediment removal benchmark to be 4.0' (Elev. = 34.0'). 2. Existing spot elevations were shown on the original plan. Existing topographic contours are added to the revised plan. 3. Note No. 14 on the plan requires all rooftop drainage to be directed into the stormwater pond. 4. The pond depth is shown to be 5.0'. 5. A revised Sheet #2 of the application is included which shows the stream classification of Mott Creek to be C Sw. This was omitted on the original application. Two sets of revised plans and calculations are enclosed. Please include this information with our original submittal package and review it as soon as possible. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, grass cover, and general condition. b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within 2 to 5 days. 2. Repair eroded areas -immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the original design depth. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). The original design depth is: 33.0' The sediment removal benchmark depth is: 34.0' Remove cattails and other indigenous wetland plants when they cover 75% of the basin surface. These plants shall be encouraged to grow along the basin perimeter. 6. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through the emergency drain shall be minimized to the maximum extent practical. 7. All components of the wet detention basin system small be maintained in good working order.
