As of this inspection date, 69 days since receipt of the Plan of Action, DWQ has received an engineer's certification. However, DWQ has not received any offiste permit applications or BUA verifications for the built upon lots and the following deficiencies were observed: 1. Pond No. 4 lacks rip rap at the inlet. 2. The slope failure at Pond No. 4 near the outlet has continued to erode. 3. No evidence was observed that vegetative maintenance has occurred on Pond Nos. 2, 3, or 4. 4. The swale behind Lots 8 & 9 was not observed. Additionally, recorded deed restrictions were not found in the DWQ file. Access to the inlet on Pond No. 3 was not cleared from brushed and trees; and access to either the inlet or outlet was not readily available at Pond No. 2. The report summarizes the findings of a recent inspection of the project's stormwater controls conducted on May 14, 2009 to determine compliance with Stormwater Permit Number SW8 971034 issued on September 11, 2003. As dicated in the attached inspection report the following deficiencies must be resolved: �1. Submit an engineer's certification of the stormwater system ✓2. Install rip rap in the inlet of Pond#4 V3. Repair the slope near the outlet at Pond#4 _Z4. Install the Swale behind lots 8&9 according to the approved plan ,/5. Perform operation and maintenance items to assure optimum efficiency of the stormwater system — see O&M questions for specifics 6. Provide verification of all lots needing offsite permits have been obtained. Please inform this Office in writing before June 22, 2009, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $10,000 per day. If a written plan of action is not submitted to this office by June 22, 2009 then DWQ staff will re -inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed.
