That this action was duly instituted on the ist day of March,
1993, by the issuance of Summons, filing of a Complaint and a
Declaration of Taking and Notice of Deposit and by the deposit of
FIVE HUNDRED FORTY SIX THOUSAND SEVEN HUNDRED ($546,700.00) DOLLARS
as estimated just compensation; that Summons was duly served on the
defendants together with a copy of the Complaint and Declaration of
Taking and Notice of Deposit; that by Order dated and filed July 5,
1994, Exxon Corporation no longer has any interest in this action
since their leasehold interest expired on July 31, 1994 and were
dismissed as a party to this action; the defendants, City of
Asheville and Asheville Regional Airport Authority, are the only
parties who have or claim to have an interest in the property
described in the Complaint and Declaration of Taking and the title
to the property is not in dispute; that the property described in
the Complaint and Declaration of Taking is subject only to such
liens and encumbrances as are set forth in Exhibit "A" of the
Complaint and Declaration of Taking; that the defendants filed an
Answer to the Complaint within the time permitted by law; that all
parties who are necessary to the determination of this action are
properly before the Court; and that the defendants are under no
legal disability;

an agreement whereby the plaintiff has agreed to pay and the
defendants have agreed to accept the additional sum of SEVENTY
THOUSAND ONE HUNDRED FIFTY ($70,150.00) DOLLARS, which includes
interest, as full and just compensation for the appropriation of
the interests and areas as. set forth in the Complaint and
Declaration of Taking and as hereinafter more particularly
described; for any and all damages caused by the construction of
Department of Transportation Project 8.1950203/6.804747, Buncombe
County; and .for the past and future use thereof by the Department
of Transportation, its successors and assigns, for all purposes for
which the Department of Transportation is authorized by law to
subject the same.
NOW, THEREFORE, IT IS ORDERED, ADJUDGED AND DECREED:
1. That the Department of Transportation, plaintiff herein,
was entitled to acquire and did acquire on the 1st day of March,
1993, by the filing of a Complaint and Declaration of Taking and
Notice of Deposit, together with the deposit of FIVE HUNDRED FORTY
SIX THOUSAND SEVEN HUNDRED ($546,700.00) DOLLARS, those certain
interests or estates and areas, hereinafter more particularly
described in, over, upon and across the property of defendants, and
that said property of defendants is described as follow:
Being all of those tracts of land more particularly described
in that certain Memorandum of Action captioned, "DEPARTMENT OF
TRANSPORTATION, Plaintiff, v. City of Asheville, Exxon Corporation
(formerly Humble Oil and Refining Company, Lessee and Asheville
Regional Airport Authority, Defendants", recorded in the Office of
the Register of Deeds for Buncombe County, Book 1735, Page 024, and
also recorded in the Office of the Register of Deeds for Henderson
County, Book 816, Page 108, reference to which Memorandums of
Action are made for a more particular description of said property
of the defendants.
2. That the interests or estates acquired in, over, upon and
across the hereinabove described property of defendants are:
Fee simple title to rights of way and temporary slope
easements for providing lateral support to the highway or land

time as said owners lower or raise the elevation of the land
adjacent to said highway to the extent that such lateral support is
no longer needed and, in addition, temporary construction easements
to continue until the completion of the project, at which time said
temporary construction easement areas will revert to the owners and
also in addition, easements, in perpetuity, for drainage for all
purposes for which the plaintiff is authorized by law to subject
the same and in addition, a temporary drainage easement to continue
until the completion of the project, at which time, said temporary
drainage easement area will revert to the owners.

Access is controlled by the Department of Transportation as is
indicated by control -of -access (C/A) lines on the official plans
for Department of Transportation Project 8.1950203/6.804747,
Buncombe/Henderson Counties and as shown on the second revised
plat filed by the plaintiff in this action with the right of
abutting property owners to access to, from or across the areas
within the control -of -access (C/A) lines to be controlled and
limited solely to those points at which access may be permitted by
the Department of Transportation, and there will be no access to,
from or across the property abutting said highway right of way to,
from or across the areas within the said control -of -access (C/A)
lines, except by public road connections.
3. That the areas acquired in, over, upon and across the
hereinabove described property are accurately shown upon a second
revised plat entitled, "Property Described in Civil Action
Entitled, 'State of North Carolina Department of Transportation vs
City of Asheville, et al, Limestone Township, Buncombe County,
Project 8.1950203/6.804747, 11 filed by the plaintiff in this action
on the 22nd day of March, 1996, and are described as follows:

4. That the Department of Transportation, plaintiff herein,
pay into Court the additional sum of SEVENTY THOUSAND ONE HUNDRED
FIFTY ($70,150.00) DOLLARS, and that said sum, together with the
original deposit made by the plaintiff in this action unless
heretofore disbursed by order of the Court, be disbursed to the

5. That the said sum of SIX HUNDRED SIXTEEN THOUSAND, EIGHT

amount of the original deposit, plus said additional amount, and
including interest, is the full, fair and adequate value of and
represents just compensation for the taking of the hereinabove
described interests and areas by the Department of Transportation;
for any and all damages caused by the construction of Department of
Transportation Project 8.1950203/6.8047474, Buncombe/Henderson
Counties; and for the past and future use thereof by the Department
of Transportation, its successors and assigns, for all purposes for
which the said Department of Transportation is authorized by law to
subject the same.
6. That a copy of this judgment be certified to the Register
of Deeds of Buncombe/Henderson Counties to be recorded among the
land records of said Counties.
7. That the plaintiff, Department of Transportation, pay the
costs of this action.
