Mr. Wood:
On December 8, 2020, Thad Valentine from the Raleigh Regional Office of the Division of Energy,
Mineral, and Land Resources(DEMLR), visited the subject site located on Chapel Hill Church Road.
The site visit and file review revealed that Fred Smith Company has neither applied for, nor obtained
coverage under,NPDES Stormwater General Permit No. NCG020000 Mining permit for stormwater
discharges from the site. The site currently discharges process-affected stormwater to receiving
waters designated as Urahaw Swamp, a Class C;NSW waterbody in the Roanoke River Basin.
An NPDES permit is required to discharge stormwater to waters of the state in accordance with G.S.
143-215.1(a) and Title 15A NCAC 2H .0126. Enclosed with the inspection report is a copy of tile
Notice of Intent(NOI) that shall be completed and submitted to DEMLR within 30 calendar days of
receipt of this notice. Submission information can be found in the NOI.
Thank you for your attention to this matter. DEMLR requires that this violation be properly resolved.
This violation, and any future violations, are subject to a civil penalty assessment of up to$25,000
