This permit expires on October 4, 2012. Per 15A NCAC 2H.1003(h) (the stormwater rules), applications for permit renewals shall be submitted 180 days prior to the expiration of a permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an active project please complete and submit the enclosed renewal application prior to April 4, 2012. If this project has not been constructed and a permit is no longer needed, please submit a request to have the permit rescinded. If you have sold the project please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Enclosed is a form for change of ownership, which should be completed and submitted if the property has changed hands. Your permit requires that upon completion of construction and prior to operation of the permitted stormwater treatment system, a certification of completion be submitted to the Division from an appropriate designer for the type of system installed. This is to certify that the permitted facility has been installed in accordance with the permit, the approved plans, specifications and supporting documentation. If you have not already provided a Designer's Certification to our office, please include a copy with your permit renewal request and processing fee. A copy of the certification form is enclosed for your convenience. You should be aware that failure to provide the Designer's Cerrtification and the operation of a stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and may result in appropriate enforcement action including the assessment of civil penalties of up to $10,000 per day. REQUIRED ITEMS CHECKLIST The following checklist outlines design requirements per the Stormwater Best Management Practices Manual (N.C. Department of Environment, Health and Natural Resources, February 1999) and Administrative Code Section: 15 A NCAC 2H .1008. After every significant runoff producing rainfall event and at least monthly: a_ Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation, vegetated cover, and general condition. b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within 2 to 5 days as designed. 2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near a wet detention basin or stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. This was reported to DWQ in a very timely manner, the Permittee conducted a drainage test to determine the release point. The report summarizes the findings of a recent inspection of the project's stormwater controls conducted on January 29, 2009 to determine compliance with Stormwater Permit Number SW8 020622 issued on October 4, 2002. As indicated in the attached inspection report the following deficiencies must be resolved: 1. Submit a designer's certificate of the stormwater system. 2. Perform maintenance on Pond 1 & 2 as detailed in the accompanying report. Please inform this Office in writing before March 13, 2009, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action including the assessment of civil penalties of up to $10,000 per day. This inspection was performed to determine compliance with the North Carolina Sedimentation Pollution Control Act of 1973. The inspection revealed a land -disturbing activity of approximately 17.9 acres being conducted. It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The purpose of this letter is to inform you that this activity was found to be in violation of the Act, NCGS 113A-50 to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible for the following violations, please notify this office immediately. The violations that were found are: 1. Failure on a tract of more than one acre, when more than one acre is uncovered, to provide a permanent around cover sufficient to restrain erosion on such exposed areas within 15 working days or 90 calendar days, whichever is the shorter after completion of construction or development. All reasonable measures were not taken to protect public and private property from damage_ as a result of land disturbing activities. 4. Failure to retain along a lake or natural watercourse a buffer zone of sufficient width to confine visible siltation by natural or artificial means within the 25 percent of that portion of the buffer zone nearest the land -disturbing activity. G.S. 113A-57(1). The buffer zone is inadequate in areas where off -site sediment has reached wetlands that border the northeast Cape Fear River. 5. Failure to maintain on graded slopes and fills an angle which can be retained by vegetative cover or other adequate erosion control devices or structures. NCGS 113A-57(2) or 15A NCAC 0413.0124(d). Gullies & erosive conditions are evident on various slopes including those associated with : the vegetative filters at the outfall of the stormwaters ponds. 6. Failure within 15 working days of 30 calendar days (whichever period is shorter) of completion of any phase of grading to plant or otherwise provide exposed, graded slopes or fills with ground cover, devices, or structures sufficient to restrain erosion. G.S. 113A-57(2). Groundcover sufficient to restrain erosion has not been established on graded slopes or fills. 7. Failure to maintain satisfactorily all temporary and permanent erosion and sedimentation control measures and facilities during the development of a site. 15 NCAC 413.0113. Silt fence was severely overloaded and washed out in various locations. To correct these violations, you must: 1. Provide adequate groundcover to all exposed and graded areas. 2. Install measures sufficient to retain sediment on site.. 3. Take all reasonable measures to protect public and private property from damage due to land disturbing activities. 4. Provide adequate buffer zone along wetland boundaries. 5. Reshape excessively steep or eroded slopes. 6. Provide groundcover sufficient to restrain erosion on exposed graded slopes or fills. 7. Repair and restore erosion control measures. Mr. J. Lawrence March 5, 2004 Page Three Please note that merely planting grass seed does not satisfy the requirements of "vegetative cover" or of "ground cover sufficient to restrain erosion." These requirements are not satisfied until a standing cover of grass or other ground cover is established which is, in fact, sufficient to restrain accelerated or man-made erosion. The initial one day civil penalty could be an assessment of up to $5,000.00. A time period for compliance is not required for this initial one day civil penalty pursuant to NCGS 113A-61.1 (c) and NCGS 113A-64(a)(1). An initial one day civil penalty is being considered for this project. If the violations described in this Notice are not corrected within 30 days following your receipt of this Notice, the Division of Land Resources may take additional appropriate legal action against you pursuant to NCGS 113A-64. That action could be the assessment of additional civil penalties and may result in the initiation of other remedies as prescribed by the Act. If additional civil penalties are assessed for the violations, the amount may be up to $5,000.00 per day for each day of the violation pursuant to NCGS 133A-64(a)(1). If all violations are corrected within the time period specified for compliance, additional'civil penalties or legal remedies will not be pursued. Any new land -disturbing activity associated with this project should not begin until the area presently disturbed is brought into compliance with the Act. When corrective actions are complete, you should notify this office so that the work can be inspected. You should not assume that the site is in compliance with the Act until we have so notified you. In addition, once compliance has been achieved, all installed measures must be satisfactorily maintained until development is complete and the site is fully stabilized to avoid further violations of the Act.
