Stormwater Permit No. SW3200903

Dear Mr. Burton:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on September 29, 2020. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
1. On Page 2 of the SWU-101 Application Form (Part III. Lc) the applicant is listed as the
property owner. However, Part III.2.a and the submitted deed show Oakwood Farm, LLC
as the property owner. Please correct this discrepancy. Also, if the applicant is the lessee
or purchaser please also submit a copy of the lease or purchase agreement.
2. Please submit a copy of the proposed grading plan without the existing grading shown.
3. A number of spot elevations on the grading plan appear to be incorrect:
a. Sheet C301: At the northwest corner of the building are three spot elevations at
El. 871.90, 872.46, and 872.36 despite being closest to the El. 874 contour. At the
southwest corner of the building is a TOC/BOC of 871.90/871.40 despite being
between the contours for El. 873 and 874.
b. Sheet C302: At the roadway on the northeast corner there is a TOC/BOC of
873.90/873.40 (also labeled 866.79) despite being between the contours for El.
868 and 869. Also, the rim elevations for the inlets in the northern part of the
parking lot are cut off the sheet and not visible.
4. The temporary pool elevation must be calculated using the total volume from the 1"
storm, not by routing a I", 24-hour storm through the wet pond. The temporary pool
elevation should be calculated as the stage at which the total runoff volume from the 1"
storm is reached.

5. The outlet discharge was calculated assuming a 12" orifice instead of two 6" orifices.
Because the orifice area calculation is not linear this significantly affects the calculated
flow rate leaving the wet pond. Please calculate the drawdown using two 6" orifices
instead of one 12" orifice.
6. Please provide a maintenance access and easement that comply with General MCD 8 and
9. The entire SCM and maintenance access must be located in a permanent recorded
easement that extends to the nearest public right of way. The maintenance access must be
at least ten feet wide and not include lateral or incline slopes greater than 3:1.
7. Please upload a signed and sealed copy of the Supplement EZ form. Also, please use the
Supplement EZ form attached with this letter. An error was found in the form that
excluded a required section. On Page 2, when filling in the number of SCMs, cell B9
should say "Click to Load Forms". This will allow you to fill in information regarding the
drainage area to the SCM. Please also update the Supplement EZ form to reflect any
revisions made as a result of these comments.
8. Please note that the SA/DA charts used on Page 42 of the submitted calculations
document are from an older version of the Stormwater Design Manual and the current
version contains updated charts. The SA/DA for this project is in compliance with the
current charts and no changes are required for this comment.
9. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:

Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to January 2, 2021, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SW3200903 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
