suggest you have this delineation surveyed. Upon completion, this survey should be reviewed and verified by the Corps.
Once verified, this survey will provide an accurate depiction of all areas subject to CWA jurisdiction on your property
which, provided there is no change in the law or our published regulations, may be relied upon for a period not to exceed

• ACCEPT: If you received a Standard Permit, you may sign the permit document and return it to the district engineer for final
authorization. If you received a Letter of Permission (LOP), you may accept the LOP and your work is authorized. Your
signature on the Standard Permit or acceptance of the LOP means that you accept the permit in its entirety, and waive all rights
to appeal the permit, including its terms and conditions, and approved jurisdictional determinations associated with the permit.
• OBJECT: If you object to the permit (Standard or LOP) because of certain terms and conditions therein, you may request that
the permit be modified accordingly. You must complete Section II of this form and return the form to the district engineer.
Your objections must be received by the district engineer within 60 days of the date of this notice, or you will forfeit your right
to appeal the permit in the future. Upon receipt of your letter, the district engineer will evaluate your objections and may: (a)
modify the permit to address all of your concerns, (b) modify the permit to address some of your objections, or (c) not modify

The aforementioned project proposes no impervious area. A sediment and erosion
control permit was obtained due to the fact that a disturbed area over 1 acre was
anticipated. The project consists of two grass soccer fields graded to sheet flow to an
existing perimeter ditch. With no impervious area we are requesting an exemption letter
from your office.

Dear Mr. Brown:
On October 28, 2005, the Wilmington Regional Office received a copy of an Erosion Control Plan for
the subject project. The North Carolina Administrative Code requires any project that must receive
either Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to apply for and
receive a Stormwater Management Permit by the Division of Water Quality. Any construction on the
subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and
may result in appropriate enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application
form, fee, and supporting documentation, or a written response regarding the status of this project and
the expected submittal date must be received in this Office no later than January 8, 2006. Failure to
respond to this request may result in the initiation of enforcement action, and construction may
experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval
letter must NOT be considered the Coastal Stormwater Management Permit, which will be signed by
the Water Quality Supervisor. Please reference the Project Number above on all correspondence.

This office has received a soil erosion and sediment control plan for the project listed above which
was submitted as required by the North Carolina Sedimentation Pollution Control Act (G.S. 113A-57 (4)).
The Act requires that all persons disturbing an area of one or more acres of land must obtain approval
of a soil erosion control plan prior to the commencement of the land -disturbing activity (G.S. 113A-54(d) (4)).
The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the approving
authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving
authority to approve or disapprove the submitted plan within the 30-day period will be deemed approval of the
plan.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
The approval of an erosion and sediment control plan is conditioned on the applicant's compliance
with Federal and State water quality laws, regulations and rules.

We received your letter of August 9, 2005, requesting the submittal of a Plan Revision for the CFCC
North Campus Engineering Building. The stormwater permit for this project was originally applied for
in October of 2003 and the permit was received on December 12, 2004. This approved permit
included the construction of the Engineering Building and associated site work. We have attached a
copy of the stormwater management permit received for the project.
The Notice of Violations of the Sedimentation Pollution Control Act referred to in your letter was
received due to an unapproved extension of the proposed stockpile area and use of additional CFCC
property for a staging area for the contractor, but no additional built upon area has been added to the
project. Since receipt of the violation, a revised erosion control plan has been submitted to and
approved by NCDENR.
In light of the above information, we do not believe a Plan Revision for the stormwater permit is

information.

December 11, 2003. Staff review of the plans and specifications has determined that
the project, as proposed, will comply with the Stormwater Regulations set forth in Title
15A NCAC 2H.1000. We are forwarding Permit No. SW8 990923 dated December 12,
2003, for the construction of Cape Fear Community College -North Campus.
This permit shall be effective from the date of issuance until January 28, 2010, (10
years from the original issue date) and shall be subject to the conditions and limitations
as specified therein. Please pay special attention to the Operation and Maintenance
requirements in this permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system will result in future compliance
problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, You
have the right to request an adjudicatory hearing upon written request within thirty - 0)
days following receipt of this permit. This request must be in the form of a written
petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-
7447. Unless such demands are made this permit shall be final and binding.

I. DESIGN STANDARDS
1.- This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described on page 3 of this permit, the Project Data Sheet. The
stormwater controls designated as Ponds 1, and 3, have been designed tj?
handle the runoff from a total of 1,268,467 ft`, 280,526 ft , and 1,219,680 ft`,
respectively, of built -upon area.
3. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
4. The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface except roads.
2. inuring construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch
basins and piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. Decorative spray fountains will not be allowed in the stormwater treatment
system.
6. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
8. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
9. The following items will require a modification to the permit:
a. Any'revision to the approved plans, regardless of size.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the. proJ'ect area.

10. The Director may determine that other revisions to the project should require a
modification to the permit.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construciion.
12. Prior to the sale of any Portion of the property, an access/maintenance easement
to the stormwater facilities shall be granted in favor of the permittee if access to
the stormwater facilities will be restricted by the sale of any portion of the
property.
13. The permittee is responsible for verifying that the proposed built -upon area does
not exceed the allowable built -upon area.
14. The runoff from all built -upon area within the three specified drainage areas on
the project must be directed into the appropriate permitted stormwater control
system.
15. The Director may notify the permittee when the permitted site does not meet one
or more of.the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity without notice to and
approval by the Director. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request
must be submitted to the Division of Water Quality accompanied by document-
tation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and
may or may not be approved. The permittee is responsible for compliance with
all permit conditions until such time as the transfer is approved.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.68.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property for the
purpose of inspecting all components of the permitted stormwater management
facility.

6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.

OnJune 20, 2005, the Wilmington Regional Office received a copy of a Notice of Violations of
the Sedimentation Pollution Control Act for the subject project. The North Carolina
Administrative Code requires any project that must receive either Sedimentation and Erosion
Control Plan approval and/or a CAMA Major permit to apply for and receive a Stormwater
Management Permit by the Division of Water Quality. Any construction on the subject site,
prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may
result in appropriate enforcement action by this Office.
The last update to the approved plans was on June 18, 2004. A Plan Revision for the addition
of the Engineering Building, including 2 sets of plans, must be received in this Office no later
than September 9, 2005. Failure to respond to this request may result in the initiation of
enforcement action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit -that accompanies the Erosion Control Plan
approval letter must NOT be considered the Coastal Stormwater Management Permit, which
will be signed by the Water Quality Supervisor. Please reference the Project Number above

On June 16, 2005, personnel of this office inspected a project located on Sidbury Road, Wilmington
in New Hanover County, North Carolina. This inspection was performed to determine compliance
with the North Carolina Sedimentation Pollution Control Act (Act) of 1973. The inspection revealed
a land -disturbing activity of approximately 58 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform you that this activity was found to be in violation of the Act, G.S.
113A-50 to 66, Title 15A, North Carolina Administrative Code (NCAC), Chapter 4. If you feel that
you are not responsible for the following violations, please notify this office immediately.
The violations that were found are:

approved erosion and sedimentation control plan. 15 NCAC 4B .0113. The slopes of the
pond behind the engineering building and the drainage swales around the stockpile area have

d. Failure on a tract of more than one acre, when more than one acre is uncovered, to provide a
permanent ground cover sufficient to restrain erosion on such exposed areas within 15
working days or 90 calendar days, whichever is shorter, after completion of construction or
development. G.S. 113A-57(3) and 15A NCAC 4B .0107(b). The slopes of the pond behind
the engineering building and the drainage swales around the stockpile area, across from the
engineering building have sparse to no vegetation and are eroding.
e. Failure on a tract of more than one acre, when more than one acre is uncovered, to install
sedimentation and erosion control devices sufficient to retain the sediment generated by the
land -disturbing activity within the boundaries of the tract during construction upon and
development of the tract. G.S. 113A-57(3). The drainage swale, in the area across the road
from the engineering building is eroding and transporting sediment into the storm water
pond downstream.
f. Failure to take all reasonable measures to protect all public and private property from damage
by such land -disturbing activities. 15A NCAC 4B .0105. The swales and ponds associated
with this project have had little to no work done and are eroding.
i. Failure within 15 working days or 30 calendar days (whichever period is shorter) of
completion of any phase of grading to plant or otherwise provide exposed, graded slopes or
fills with ground cover, devices, or structures sufficient to restrain erosion. G.S. 113A-57(2).
The slopes of the pond behind the engineering building and the drainage swales around the
stockpile area have sparse to no vegetation and are eroding.
To correct these violations, you must:
1. All disturbed areas must be seeded, fertilized and mulched per approved plans.
2. Swale across from engineering building must be returned to original conditions. It must be
cleaned out, regraded in eroded areas, and seeded, fertilized and mulched until adequate
vegetation is established.
Please note that merely planting grass seed does not satisfy the requirements of"vegetative cover" or
of "ground cover sufficient to restrain erosion." These requirements are not satisfied until an
adequate cover of grass or other ground cover (such as properly applied and secured, mulched
seeding or appropriate rip -rap) is established which is, in fact, sufficient to restrain accelerated or
man-made erosion.

The penalty for an initial violation could be an assessment of up to $5,000.00. A time period for
compliance is not required for enforcement of this violation pursuant to NCGS 113A-61.1(c) and
NCGS 113A-64(a)(1). Therefore, the initial violation maybe referred to the Director, Division of
Land Resources, for appropriate action.
Please be advised that if these violations are not corrected within 20 days of receipt of this notice the
Director of the Division of Land Resources, will be requested to take appropriate legal action against
you pursuant to NCGS 113A-64. That action could be the assessment of a civil penalty, and the
amount may be up to $5000 per day for each day of the violation. The penalty may be assessed from
the date of the violation, NCGS 113A-64(a)(1). If the violations are corrected within the time period
specified for compliance, no further legal action will be pursued.
Please be advised that any new land -disturbing activity associated with this project should not begin
until the area presently disturbed is brought into compliance with the Act. When corrective actions
are complete, you should notify this office so that work can be inspected. You should not assume
that the property is in compliance with the Act until we have notified you. After installation, all
erosion control measures must be maintained in proper working order until the site is completely
stabilized.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the Act. Copies of
the relevant statute and administrative rules may be examined at this office or will be sent to you
upon request. Should you have questions concerning this notice or the requirements of the Act
please contact either Schuyler Snowdon or me at your earliest convenience.

This office has received the revised soil erosion and sediment control plan submitted for the project
listed above. G.S. 113A-54.1(a) requires that this office approve or disapprove a submitted revised plan within
15 days of receipt of such plan. Failure to act by this office within this time period shall be deemed approval of
the revised plan.
Commencement or continuation of a land -disturbing activity under the jurisdiction of this Act prior to
the approval of an erosion and sediment control plan is a violation of the Act.
We have performed a preliminary review of your submitted plan and have determined that additional
information will be necessary before a final review can be completed. Comment # 7 in the approval letter
dated August 22, 2003 states that the permit allows for land disturbance of 58 acres. Exceeding that is
a violation and requires additional fees. Please calculate the area and submit a letter and appropriate
