. On August 11,1999, the Wilmington Regional Office requested that the stormwater management permit
application be signed by a person of at least the level of President or Vice President, in accordance with the
rules. The letter was addressed to Mr. Richard Hayes, who did not respond to that request. As a result, the
permit for Applebee's is being unnecessarily held up for a simple item. I am ready to issue the permit, however,
I cannot until this relatively minor item is addressed.
I have enclosed the signature page of the application. Please either initial where requested, sign and
return it to me so that I can issued this permit, or provide a letter authorizing Mr. Haves to sign on yourbehalf..
Please also complete the agent authorization section with the name and address of the registered professional
who has submitted the plans on your behalf, if any.

The Wilmington Regional Office received a Stormwater Management Permit Application for
Applebee's- Morehead City on June 17 1999. A preliminary review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
As previously requested, please send in an original, completed application and supplement with
required signatures, per NCAC 2H .1003 (e). In the case of a corporation, the application and
supplement must be signed by a principal executive officer of at least the level of vice president,
or an authorized representative. The signature of an authorized representative will be accepted
only if accompanied by a letter of authorization from a principal executive officer in the
corporation of at least the level of vice president. On June 29, 1999, the Division received a
copy of the first page of the completed application. Unfortunately, since the original page 2 was
on the back of page 1, and only page 1 was copied and returned, the application is now missing
page 2, the signature page (Page 3) has not been returned, and a new supplement has not been
provided.

Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to September 11, 1999, or the application will
be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including
the application fee. The Division is allowed 90 days from the receipt of a completed application to issue the
permit.
The construction of any impervious surfaces associated with this project prior to receipt of the
stormwater permit is considered a violation of NCGS 143-215.1, and is subject to enforcement action.

Applebee's Morehead City on April 16, 1999. A preliminary review of that information has determined that
the application is not complete. The following information is needed to continue the stormwater review:
1. The rules provide for who may sign the permit application and supplement. In the case of
corporations, a principal executive officer of at least the level of vice-president must sign. If
anyone other than that signs, a letter of authorization must be provided. Please either have a
vice president sign, or provide a letter of authorization from a vice-president or above
authorizing you to sign the application.
2. Portions of the application have been left blank. Section I, parts 6 and 7 must be completed.
3. The permit for Lowe's has not yet been issued. This application will be placed on hold
pending the issuance of that permit.
Please note that this request for additional information is in response to a preliminary review. The
requested information should be received by this Office prior to July 17, 1999, or the application will be

I am- writing you regarding the Storm Water Permit for the Applebee's in Morehead City.
On March 23, 1999 the engineers for the shopping center (Isom & Associates) notified me
that we were required to obtain a storm water permit. Isom copied me on a report from
Scott Vinson dated March 8,1999 stating that outparcel # 3 was under construction without
a permit. I started working with Mr. Vinson who has helped me through the process. I
apologize that we had not previously applied for the permit, as I was unaware that we need
one.

appropriate fees.
