1.0 Introduction and Background
1.1 Introduction
Lowes Home Improvement operates store #2436 located at 401 WB McClean Road in Cape
Carteret, NC. Figure 1 illustrates the location of this facility on the Swansboro Quadrangle
U.S.G.S. Topographic Map. The site contains one permanent commercial building with paved
parking and driveways with a storm water retention system and impoundments on the property
grounds. Figure 2 contains a site map illustrating the layout of the facility which comprises this
site.
A spill occurred at this facility on Wednesday, July 7, 2010 when a brief rainfall event occurred
during application of a coal tar sealant on the facility's paved asphalt parking lot. The sealant had
not dried at the time of the rainfall event, resulting in a runoff surface spill of this material into the
facility's storm drainage runoff system. After surface waters leached into the soils of the two initial
outfall basins at the site, the coal tar sealant deposited onto surface soils at these locations.
In response to this release, Eagle SWS was employed to recovery the spilled coal tar sealant. A
summary of cleanup activities is contained herein.
1.2 Scope of Services
This report contains documentation concerning the following activities which were conducted at
this facility:
o Excavation, transportation and disposal of contaminated soils by Eagle SWS of Greensboro,
NC
o Collection of confirmatory soil samples by Henry Nemargut Engineering Services at the
limits of the remedial excavation

2.0 Abatement Activities, Sampling and Analyses
2.1 Initial Abatement Activities
A spill occurred at this facility on Wednesday, July 7, 2010 when a brief rainfall event occurred
during application of a coal tar sealant on the facility's paved asphalt parking lot. The sealant had
not dried at the time of the rainfall event, resulting in a runoff surface spill of this material into the
facility's storm drainage runoff system. Eagle SWS first responded to this incident on Saturday,
July 10, 2010 to attempt to recovery the sealant using booms and absorbent pads; however, upon
arrival on this date, surface waters had leached into the soils of the two initial outfall basins at the
site, and the coal tar sealant deposited onto surface soils at these locations. .
Eagle returned to the site on July 13, 2010 with long -reach excavation equipment to remove the
surface soils in the two initial outfall basins to ensure recovery of the spilled coat tar sealant.
Excavation was continued through Friday, July 16, 2010 to remediate soils impacted by the release,
and confirmatory samples were collected to document the condition of remaining in -situ soils.
The soil area impacted by the surface spill had approximate dimensions of 42' X 50' in outfall
Basin #1, and approximate dimensions of 50' X 54' in outfall Basin #2. The layout of the spill site
is illustrated graphically on Figures 2 & 3. The depth of excavation in these areas averaged 1' to
ensure complete removal of impacted soils. The dimensions of the basins excavation are
approximated on the map included as Figure 3.
Approximately 199.14 tons of contaminated soils were excavated and disposed of from this site
during initial abatement activities. All petroleum contaminated soils generated from this site were
disposed of at Soilworks, Inc. in Selma, NC. Appendix A contains disposal manifests for soils
disposed of from this site.
2.2 Soil Sampling
After excavation operations were completed at the site, soil samples were collected at the limits of
the remedial excavation on July 16, 2010. Four soil samples were collected from the quadrants of
the remedial excavation in each outfall basin. An additional composite sample was obtained from
the worst case remediated soils on July 16, 2010 for disposal purposes and to assess the levels and
type of TPH contaminants contained in the soils. A TECO photoionization detector (PID) was used
to assist in determining areas exhibiting petroleum off -gases; however, all sampled were below the
detection limits of this field instrument. Figure 3 illustrates the locations of the in -situ soil samples
collected at the site during abatement activities.
The soil samples selected for laboratory analysis were placed into new glass jars provided by the
certified laboratory. The soil and groundwater samples were labeled with sample location, analyses
to be performed, time, date, and the sampler's name. They were then immediately placed in a
cooler and chilled with ice to approximately 4oC in preparation for transportation to the analytical
laboratory, utilizing EPA approved chain -of -custody procedures.

2.3 Laboratory Analyses
Based on a review of the MSDS for the spilled material, in -situ soil samples collected were
submitted to Prism Laboratories for analyses according to EPA Method 9071 as agreed upon by the
NCDENR to confirm cleanup of this spill. Per the agreement with Rick Shiver of the NCDENR,
the worst -case composite stockpile soil sample was analyzed via EPA Methods 9071/5035/3550 to
determine if lower boiling point TPH contaminants were present in the excavated material. Method
5035 tests for low boiling point hydrocarbons such as gasoline and gasohol, and its current action
level is 10 mg/kg for surface releases. Method 3550 tests for high boiling point hydrocarbons such
as diesel and heating oil, and its current action level is 40 mg/kg for surface releases. Method 9071
tests for TPH compounds in the range of oil and grease, and its current action level is 250 mg/kg
for surface spills.
Results from soil samples were below current NCDENR action levels for all in -situ soil samples
collected following remedial excavation. The worst -case stockpile soil composite sample SP
indicated 3550 compounds at a level of 70 mg/kg and 9071 compounds at a level of 66 mg/kg,
indicating an equal ratio of 9071/3550 compounds in the soils remediated at this site. 5035
compounds were not found present in the composite stockpile soil sample. The results of the
laboratory analyses for soil samples are summarized in Table 1, and a copy of the laboratory
analytical report and the chain of custody record for the soil samples are contained in Appendix B.
The laboratory analytical results are depicted graphically on Figure 3.
3.0 Conclusions
3.1 General Summary
Based on a review of all information gathered during this Spill Cleanup Assessment, Henry
Nemargut Engineering Services makes the following conclusions:
o An unknown quantity of coal tar sealant was spilled into the storm water runoff system and
was deposited onto surface soils in two initial outfall basins at the Lowes Home Improvement
#2436 property at 401 WB McClean Road in Cape Carteret, NC on July 7, 2010.
o Eagle SWS responded to the spill at 401 WB McClean Road in Cape Carteret, NC and
excavated impacted soils resulting in generation of 199.14 tons of contaminated soils. All
contaminated soils were disposed of at Soilworks, Inc. in Selma, NC.
o Contaminated soils impacted by the spill at this facility have been remediated to below
current NCDENR action levels for 9071 compounds as confirmed by laboratory analytical results.

3.2 Recommendations
Based on all information gathered during AST spill Assessment activities, Henry Nemargut
Engineering Services makes the following recommendations:

I, Barry T. Simmons, P.E., as a duly registered Professional Engineer in the State of North
Carolina, have been engaged to review the constructed stormwater ponds for compliance with
the above referenced permit. Based upon review of the topographic survey information, original
design plans, and original stormwater permit, it is my professional opinion and belief that the
ponds have been constructed in substantial compliance and intent with the approved
stormwater permit. It should be noted that a 36" pipe connecting ponds #1 and #2 has been
constructed that was not in the original plans. The ponds were reviewed both individually
(assuming no connection) and as one large pond (with connection) and the ponds met the
design standards in both circumstances. Given this condition, we feel it appropriate to leave the
pipe in place and certify the pond as stated above.

Hi Todd: The best thing to do, if possible, is to schedule a file review appointment. That way you (or your
representative) can go through the file and copy anything they wish out of it. We don't have the staff resources to hunt
through and copy requested documentation for the public. File review appointments give everyone the opportunity to
look through the entire file and copy what they wish. I know you are out of the area and I wad more than happy to help
previously, but it is difficult for me to a lot of time doing so. I realize you are out of the area — is it possible to send
someone to do this for you? I believe someone had actually shown up initially however an appointment had not be
made.
The appointment needs to be scheduled through me so let me what you would like to do. Do hope you understand our

Inspection Summary:
The following deficiencies were noted during the inspection:
1.No renewal request has been received by the Division.
2.No Engineer's Certifications have been received for any of the stormwater BMPs.
3.There were some small areas where the berm separating the forebay and main pond in pond #3 had been dug into,
probably by animals. If this burrowing isn't kept in check it could eventually cause the berm to fail.
To bring this system into compliance you must:
9.Submit a renewal request and its associated materials.
2.Submit the required Engineer's Certifications for the 3 ponds. If one has been done in the past just send a copy of it.
3.17111 in the holes in the berm, and ensure that the berm is inspected periodically to ensure that the burrowing doesn't get
worse.

Attached you should find a copy of the renewal request letter that was mailed to Blanton Hamilton's attention
on January 13, 2009 for the stormwater permit at the Lowe's of Morehead City that expired on July 12, 2009.

find a copy of the renewal application materials that were enclosed with the original letter.
In addition I have attached the inspection report that I generated from my July 14, 2009 site visit.
Please respond to me by Friday, August 7, 2009 with what the timeline for your plan of action (POA) will be. If
I have not received a response by this date I will follow up with a Notice of Violation letter for the lack of a
timely renewal.

The 2 Lowe's ponds that appeared to be interconnected actually were approved as
independent ponds, each outletting into the same wetlands ditch that was extended
through the property.
Pond #2 is the pond immediately adjacent Pond E.
Pond #2
DA = 2.6 acres
BUA = 96,268 sf (most of this is OP 43 at 90% impervious or 82449 sf BUA, the rest
is street)
Required SA = 8438 sf
Provided SA = 20,164 sf
Required volume = 7692 cf
Provided volume = 45252 cf.
As you can see, there is a lot of area and volume available in this pond. I'll have
Jo scan the spreadsheet, the calcs and the BUA brreakdown table tomorrow.
