Dear Jeanette,
We are submitting this letter in response to the email we received from you on October 8, 2020
regarding Annual Reporting guidance.
On December 9, 2019, the US Environmental Protection Agency (EPA) Region 4 and the
Department of Environmental Quality (DEQ) conducted a Compliance Audit of the Town of
Navassa's Phase II Municipal Separate Storm Sewer System (MS4) Program. The following
minimum control measures were evaluated:
■ Program Implementation, Documentation, & Assessment
■ Illicit Discharge Detection & Elimination
■ Post -Construction Site Runoff Controls
■ Pollution Prevention and Good Housekeeping for Municipal Operations
On January 6, 2020, DEQ issued a Notice of Violation (NOV-2020-PC-0006) to the Town of
Navassa. The following required actions have been completed:
1. Within 30 calendar days from the date of receipt of the NOV the Town responded in
writing describing how the Town intends to address the non-compliance items. The
response letter was submitted to DEQ January 16, 2020 and received on January 23,
2020, via email.
2. Within 60 calendar days from the date of receipt of the NOV the Town adopted a
resolution that declared support for a compliant stormwater management program. The
Resolution of Support was submitted to DEQ January 16, 2020 and received on
January 31, 2020, via email.

3. Within 120 calendar days from the date of receipt of the NOV the Town:
a. Conducted a self -audit that included an evaluation of compliance with the permit
conditions found in Part II Section B: Public Education and Outreach; Section C,
Public Involvement and Participation, and Section E: Construction Site Runoff
Controls. The Self -Audit was submitted and received by DEQ on October 8,
2020.
b. Develop a Draft Stormwater Management Plan (SWMP) which details specific
actions, measurable goals, and implementation timelines to bring the stormwater
management program into compliance with NPDES MS4 requirements over the
new 5-year permit term. The Draft SWMP was submitted to DEQ April 27,
2020 and received on May 24, 2020.
Within 30 days of receiving written DEQ concurrence that the submitted Draft SWMP
documents a compliant stormwater management program, the Town shall submit an NPDES
MS4 permit application. In addition, once time has been allotted to respond to public comments
on the Draft SWMP, the Town will submit a Final SWMP for DEQ approval and final permit
issuance.
