Guidelines for Access The staff of Wilmington Regional Office is dedicated to making public records in our custody
readily available to the public for review and copying We also have the responsibility to the public to safeguard these
records and to carry out our day-to-day program obligations Please read carefully the following guidelines signing the
form
i Due to the large public demand for file access, we request that you call at least a day in advance to schedule
an appointment to review the files Appointments will be scheduled between 9 00am and 3 00pm
Viewing time ends at 4 45prn Anyone arriving without an appointment may view the files to the extent
that time and staff supervision is available
2 You must specify files you want to review by facility name The number of files that you may review at one
time will be limited to five
3 You may make copies of a file when the copier is not in use by the staff and if time permits Cast per copy is
$ 05 cents Payment maybe made by check, money order, or cash at the reception desk
PILES MUST BE KEPT IN ORDER YOU FOUND THEM Files may not be taken from the office To
remove, alter, deface, mutilate, or destroy material in one of these files is a misdemeanor for which you can
be fined up to $500 00 No briefcases, large totes, etc are yermitted ui the file review area

date/time at an offsite location at your expense Large plan copies needed should be attached on top of the

The wet ponds are all located in the golf course At the time the project was initially developed, the golf course and
subdivision was the same entity Now they are back under somewhat common ownership, although there are 2 separate
entities (Beaufort Golf Group and Beaufort Club Group) It is my understanding that Beaufort Golf Group owns this land
The basins in the permit for Section One are located in common areas which are part of section one I believe this land is
owned by Beaufort Club Group I am not sure what the ownership status is for the lots within section two Section Three
was never built, although the land that the pool is to be built on is located within the land previously designated as
section three

a Common Area Deeds (7 ponds) You submitted BK1493/PG108 which is a deed of trust from Beaufort
Club Group LLC to C1 Trustee, Inc Is this the deed for the 7 ponds/common areas? If so, Beaufort Club
Group, LLC (the proposed permittee) doesn't own the common area? The proposed permittee needs to
own the common areas Is there a more recent deed?
b Deed Restrictions You submitted BK1194/PG267 with a post -it note on a page that appears to be the
restrictions for SW8 051107 Are the restrictions for SW8 050543 in this same document? If not, please
submit the SW8 050543 restrictions
c Pond Maintenance (excessive vegetation etc) Has this been completed?
2 ) SW8 080718 (Section 3) and SW8 061113 (Section 2) haven't been built, but restrictions have to be recorded
before lots are sold to families Have lots been sold? If so, please forward the deed restrictions If not, please

Thanks for meeting today Please see below for a summary of discussion of the five transfer requests in-house as well as
your future submittal plans
Meeting Summary The numbers correspond to the numbered items in my 3/30/15 letter
1 ) Ownership
a Foreclosure Please submit the letter from the owner stating that the current permittee (Guide Group,
LLC) was foreclosed on and that you have made an attempt to contact them but they cannot be found
b Deeds Please submit common area deeds showing that the proposed permittee owns the common
area of the permits to be transferred
2) Signature Authority Please submit the signature authority letters
a SW9 070207 (Golf Clubhouse) Current transfer form is to Beaufort Club Group, LLC That will be
changed to The Golf Group, LLC Please submit the revised form
b Other Four Permits Will transfer to Beaufort Club Group, LLC
3) Deed Restrictions Please forward a copy of the restrictions
4) Designer Certifications
a SW8 050543 (Master) Partial certification for BMPs is in place Full certification cannot be done yet
because not built out
b SW8 070207 (Golf Clubhouse) Not ready to be certified because it is under construction

Upcoming Submittals
The Golf Clubhouse (SW8 070207) plans to shift BUA around and to also split into two permits There are two potential
paths forward for that which is TBD depending on your Financial and Schedule constraints which are still under
development
1 Option 1 If you decide that you want to build the "shifted BUA" fairly soon, then you could get a Plan Revision
through Express to show the new BUA configuration without an increase in BUA and without any significant
changes to drainage That is $500 in Express (it is $0 in the regular program) If you decide to do this, please
contact Cameron Weaver (cc'd) ASAP to get on the schedule Then, you could come back in later to modify SW8
070207 into two permits When you do that, you will need to submit a full application package for SW8 070207
and a full application package for the new permit that will split off of SW8 070207 Both permits will continue to
drain offsite as SW8 070207 does now
2 Option 2 If you decide not to shift BUA around in the near future, then you can skip the Plan Revision in #1
above and just submit the two full application packages as discussed above Under this scenario, you would just
show the shifted BUA as part of the modification

Section Two of the North River Club I have included the following information (attached) so that
this review may be completed
ZI)A copy of the proposed deed restrictions for the "Captains Point Bungalows" and "The
Reserves - Section Two", which has been signed by Matt Tappero and notarized (original
and one copy)
Sheet SW-3 3a has been revised to include typical condo dimensions as well as the various
type of patio homes Please note that the patio homes have been referred to as "Type A"
and "Type B", with two different models fitting within the "Type A" footprint The typical detail
notes the built upon area associated with the building, maximum backyard amenity package
(many such packages will be much small that this) and the small portion of concrete
driveway located within the "building envelop" This concrete was excluded from street
coverage and accounted for within the patio home coverage due to the fact that this number
will vary upon model selected

The Wilmington Regional Office received a Stormwater Management Permit Application for
North River Club - Section Two on November 21, 2006, for review on November 27, 2006 A
preliminary review of that information has determined that the application is not complete The
following formation is needed to continue the stormwater review
Please provide a copy of the proposed deed restrictions for Section Two to
G include all required conditions and limitations or provide an original, signed,
alD dated, and notarized revision of the Section One deed restrictions since "The
t Reserves" proposed lots for Section Two have BUA of 2700, 4700, and 2700
uare feet in addition to the 3656 square feet permitted under SW8 051107
(Irgection One)
Please dimension typical condo and patio home units, including driveways, and
label the footprint area in square feet on typical details on Sheet #SW-3 3a'
Additional fees, not to exceed 50% of the original permit application fee, may be
r-11arged for subsequent reviews due to the insufficiency of a permit application, as
specified by Section 11 4A of S L 2003-284
Because the application has permitting issues/deficiencies, a resubmittal fee of
$500 will be required in order for this project to remain in the express program
Please note that this request for additional information is in response to a partial, preliminary
review The requested information should be received by this Office prior to December 8,
2006, or the application will be returned as incomplete The return of a project will necessitate
resubmittal of all required items, including the application fee

THIS AMENDED AND RESTATED OPERATING AGREEMENT OF GUIDE GROUP, LLC
is entered into as of this 22nd day of March, 2005 by and among James M. Rose, Jr., David S.
Russotto, and Matthew J. Tappero (the "Class A Members"). and the undersigned Members
which agree to operate a Hn�ted liability company upon the following terms and conditions:
The Company was formed upon the Issuance of its certificate of organization by the
Secretary of State of North Carolina on June 2, 2004 This agreement was originally entered into
as of June 2, 2004 and has been amended and restated to reflect changes to lot options that were
approved by 80% of the members after December 31, 2004 (the Final Closing Date).

The following terms used in this Agreement shall (unless otherwise expressly provided
herein or unless the context otherwise requires) have the following respective meanings.
"
The North Carolina Limited Liability Company Act as sat forth in Chapter 57C of
the North Carolina General Statutes, as it may be amended or superseded from time to time
:Ai ! - r-t
When used with reference to a specified person.
(i) Any person that, directly or indirectly through one or more intermediaries,
controls or is controlled by or is under common control with the specified person,
(u) Any person that is an officer of, partner in, or trustee of, or serves in a
similar capacity with respect to, the specified person or of which the specified person is an
officer, partner or trustee, or with respect to which the specified person serves in a similar
capacity; '
(ui) Any person that, directly or indirectly, is the beneficial ow= of 100% or
more of any class of equity securities of, or otherwise has a substantial beneficial interest in, the
specified person or of which the specified person is directly or Indirectly the owner of 10% or
more of any class of equity securities or in which the specified person has a substantial beneficial
interest; and
(iv) Any relahve or spouse of the specified person
This Operating Agreement, as originally executed and as amended from time to time,
as the context requires

74 -Year Transfers
Members may buy or sell Uruts at any time during the year, but the Seller, as
Record Owner, will remain the owner of such Interests until close of business on December 31at
of such year (the "Record Date") and, as Record Owner, will receive all distributions mid tax
allocations made in respect to that year The Buyer shall become the Record Owner as of
January 1" of the following calendar year
The Class B Members who purchased prior to August 18, 2004, subject to a lunit of 50
investors, shalt have the right to purchase two lots in the North River Club for the published list
price as of June 30, 2005. The option will expire on .tune 30, 2008 Class B Members who
purchase an Interest after the Initial Closing Date of August 18, 2004 and before the December
31, 2004 Closing Date will receive a similar option to purchase two (2) lots per Class B Interest,
however, their option will expire on June 30, 2007 (one year earlier) This is the only difference
in nghts and obligations of Class B Members who purchase Units before the Initial Closing date
of August 18, 2004 and those who purchased after August 18, 2004 and before December 31,
2004, Those who purchase interests after December 31, 2004 shall not receive lot options
81 MMagement
(a) There shall be three (3) Managers of the Company initially, who shall be

fixed from time to time by the affirmative vote of a Majority in Interest of the Class A Members,
but in no instance shall any decrease in the number of Managers have the effect of shortenuig the
Term of any incumbent Manager unless the Manager is removed under the provisions be] ow
Managers need not be residents of the State of North Carolina or Members of the Company
(b) Any Manager of the Company mar :caRgn at arty time oy givins wi uien
notice to the rcmaintng Managers of the Company, The resignation of auy Manager skull take
effect upon receipt of notice thereof or at such later time as shall be specified an such notice, and,
unless otherwisc specified therci i, the acceptance of such resignation skull not be neecssary to make
it effective
(c) At any special meeting of the Class A Members called expressly for that
purpose, all or any lesser number ofMsnagers nzay be removed ai any trine, either with or without
cause, by the afi"irrnative vote of a Majonty in Interest of all the Class A Members In case any
vacancy so created shall not be filled by the Class A Members at such meeting, such vacancy may

Thank you for scheduling the review I intend to provide the package as
early as next week, well in advance of our 11/24 review date The
submittal will be made under the low density parameters we discussed
Linda has recently forwarded the new guidelines and goals of the express
review program Please feel free to have Paul/Linda perform a cursory
review of the package before the review date in order to help facilitate
the goals of the express review program
I also wish to have the North River Club golf course clubhouse site plan
placed into the express review program The golf course itself is
nearing completion of construction and will be opening upon completion
of the "grow -in", anticipated for next July The site identified on the
master plan for the clubhouse will contain parking and a temporary
office structure Runoff will be directed into one of the ponds already
approved within the master plan and constructed within the golf course
itself, the pro3ect should be a simple submittal illustrating the site's
conformance to the master plan coverage parameters and original pond
design I will submit the express review request for this as soon as
possible

I was able to get the two SW reviewers involved in this project
together and they are now in agreement that because of the existing
master permit for this entire pro0ect, the upper limit will be 40W
built upon area for a dense pocket in this Section Part of the
reasoning for this decision is that the total BUA will not exceed 25%
of the area within 1/2 mile and none of the North River project area is
immediately ad3acent to SA waters
Keep in mind this is specific to this project's permits and any other
proDects that you work on will be looked at on a case by case basis as
110% above the required LD density threshold' when determining a pocket
of high density In addition to BUA coverage, other aspects of low
density development will still need to be provided, such as sheet flow,
vegetated conveyances, no piping, etc

"built -upon" area consistent with the applicable regulation governing the density level

Stormwater Narrative
The North River Club is a 629 2 acre Planned Unit Development (PUD) within the Town
of Beaufort in Carteret County The low density project includes a variety of residential
neighborhoods along with commercial and recreational uses The property, which lies
between the US-70 and NC 101, is comprised mostly of level farmland, with several
forested areas scattered within The Carteret County Soils Survey has classified
approximately 90% of the land as Arapahoe soils, with smaller pockets of Tomotley,
State, Altavista, Augusta and Deloss Typical existing grade elevations range from 11 5
to 9 0 feet above sea level (NAVD 1988), with the exception of the east side of the
protect near US 70, which slopes gently to an elevation of 3 0 The existing drainage
system for the property includes lateral farm ditches spaced at 150' to 200' intervals
The lateral ditches connect to collection ditches primarily along the perimeter of the
protect The system appears to dram the property quickly and efficiently, ultimately
producing high peak discharges
Earlier this year, a Master Plan Stormwater Permit (No SW8 050543) was issued for
the project that included conformance parameters to NCDENR low density development
as well as approval of several engineered stormwater management ponds for pockets
of high density accounted for under the overall project built upon area plan A
stormwater management permit was also issued for sec#�on_one of the protect (SW8
051107) under conformance to the Master Plan Permit This portion_of_tl1e_prolect was
also issued under low -density coverage criteria, but provided treatment through
previously approved ponds for areas that included a closed conveyance system
Section Two for the North River Club consists of approximately 47 acres on the
southern portion of the property This project limits include single family home sites (in a
variety of sizes), patio homes and condominiums with common open space shared
within The development winds through portions of the 18-hole golf course, which was,/
included within the aforementioned master plan permit The project has been designed
to conform to the parameters within the Low Density NCDENR Division of Water Quality AV
Stormwater Management Master Plan permit These parameters include maintaining
overall coverage at/below 40% and utilizing open swales as the primary means of
conveyance Add itid-hal stor winwm ater treatment devices such as infiltration areas, wet t
ponds and dry basins hav_e_been mcorpo_ rated into the protect -in order to further reduce
runoff s, i ratencrease water quality and exceed local municipal management goals The
design of these measures has been omitted from this low -density submittal, as they are
not required However, they are being presented to the Town of Beaufort for their
review This extensive stormwater management system eventually conveys all excess

In one way, I feel that since the Master Plan permit I wrote allowed
them up to 40% impervious within the individual tracts, it would be
unfair to turn around and not give them a permit for a low density
project within that area that met those numbers and the intent of low
density development
In another way, there is also an avenue available for us to correct
mistakes by revoking and reissuing the permit with the new allocations
I don't think this is the route to go with the North River Club because
even though some projects within 1/2 mile of SA waters may be 40%
impervious, the total BUA will not exceed 25% of the area within 1/2
mile and none of the North River project area is immediately adjacent SA
waters
However, I also feel that from this point forward on new golf course
projects, we should consider using the "10% over" as a rule of thumb
Within the larger golf course projects, individual housing tracts could
be considered as low density if they didn't exceed 35% impervious within
1/2 mile of SA waters and 40% impervious for non -SA waters In addition
to BUA coverage, other aspects of low density development still need to
be provided, such as sheet flow, vegetated conveyances, no piping, etc

1) Paul Bartlett distributed a handout describing current regional office policy on
wetland area calculations Cameron and Paul noted that the policy compares
differences between the Washington and Wilmington regional offices and
would not affect the Master Plan or previously issued permits
2) A brief description of the North River Club was given, including the previously
approved Master Plan and Golf Course, which includes construction of seven
engineered stormwater wet ponds for future development Cameron noted
that the ponds are permitted in areas further than '/2 mile from SA waters as
shown within the Master Plan
3) A drawing illustrating the various types of development included within
Section Two was reviewed The proposed development includes several
sizes of single-family lots as well as condos and patio homes mixed within the
golf course
4) Extensive discussion pertained to how Paul would require the protect manage
stormwater The recently issued overall low density project Master Plan
permit limits the total project coverage to 25% within % mile of SA waters (as
defined within the approved Master Plan) and 30% elsewhere The permit
also specifies that development tracts that do not exceed 40% BUA would be
considered low -density A subsequent permit was issued for section one
under these criteria Paul informed us that he utilizes BUA limitations of 40%
outside the 1/2 mile and 35% within '/z mile when evaluating a "pocket of high
density" and would not consider otherwise regardless of permit conditions I
noted that the development maintains the NCDENR low densrty requirements

and will also manage a minimum of two inches of runoff, but seeks to ease
the review process by excluding treatment from the permit conditions and
maintaining conformance to the Master Plan permit It is our belief that
development pockets that do not exceed 40% comply with the permit and this
is reinforced by receipt of a permit for Section One in the same manner It
was further noted that these "pockets of development" are surrounded by vast
amounts of open space developed as golf course When considenng the
connected open space, the BUA in these areas would account for far less
than 25% of the area Cameron indicated that they would review the situation
further
5) There was additional discussion relating to the treatment options that
NCDENR would allow if required All of these options require the two -foot
separation from natural grade to the ESHWT, which is at the sole discretion of
the NCDENR soil scientist Cameron indicated that he would schedule
Vincent Lewis to review this portion of the development and requested the
applicable form
8) The stormwater management permit requires built -upon area allocations for
recorded lots to be included within the deed as presented within the permit
application and calculations The North River Club is being developed under a
single entity with a variety of available hometsite plans In order to provide
greater flexibility, it would be advantageous to utilize a system in which overall
lot coverage allocations were used to comply with master plan and permitting
needs, but individual lot coverage would be finalized once buyers selected
their lot options This would need to occur after the permit has been received
NCDENR advised us that this was not possible Further discussion noted that
varying allowable BUA on individual lots could be identified during the
permitting phase or a maximum common BUA could be used on all lots (as
permitted within section one), but that this identifying value would affect the
permit conditions effecting the permitting needs and count against the overall
project coverage regardless of the actual BUA used during development A
third option that would allow for higher lot BUA after permitting would be to
combine lots, allowing larger home plans to utilize the coverage provided
within two combined lots

construction, operation and maintenance of an overall low density subdivision with
collected portions treated in three wet detention ponds in compliance with the provisions
of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data
as attached and on file with and approved by the Division of Water Quality and
considered a part of this permit
This permit shall be effective from the date of issuance until June 12, 2016 and shall be
subject to the following specified conditions and limitations
I. DESIGN STANDARDS
1 This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 This stormwater system has been approved for the management of stormwater
runoff as described in Section 16 on page 3 of this permit The subdivision is
permitted for 111 lots, each allowed a maximum amount of built -upon area as
described in Section II 16 of this permit
3 Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit
4 The overall North River Club subdivision must be maintained at the density levels
specified in the Master Plan stormwater permit, SW8 050543
5 The runoff from the collected portions of Section One will be treated in 3 wet
detention ponds previously approved under the Master Plan permit, SW8
050543 Additionally, several bioretention and infiltration basins are being used
as Best Management Practices for the uncollected parts of the subdivision

II. SCHEDULE OF COMPLIANCE
No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division
2 The permittee is responsible for verifying that the proposed built -upon area for
the entire lot, including driveways and sidewalks, does not exceed the allowable
built -upon area Once the lot transfer is complete, the built -upon area may not be
revised without approval from the Division of Water Quality, and responsibility for
meeting the built -upon area limit is transferred to the individual property owner
3 If an Architectural Review Board or Committee is required to review plans for
compliance with the BUA limit, the plans reviewed must include all proposed
built -upon area Any approvals given by the Board do not relieve the homeowner
of the responsibility to maintain compliance with the permitted BUA limit
4 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made

5 The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
6 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to the approved plans, regardless of size
b Project name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area
e Further subdivision, acquisition, or sale of all or part of the project area
The project area is defined as all property owned by the permittee, for
which Sedimentation and Erosion Control Plan approval or a CAMA Major
permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
7 The Director may determine that other revisions to the project should require a
modification to the permit
8 All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans
9 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
10 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification
11 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
12 Permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual
13 The permittee shall at all times provide the operation and maintenance
necessary to assure that all components of the permitted stormwater system
function at optimum efficiency The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowin.9 and revegetation of side slopes
d Immediate repair of eroded areas
e Maintenance of side slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of structures, orifice, catch basins and
piping
g Access to all components of the system must be available at all times

14 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ The records will indicate the date,
activity, name of person performing the work and what actions were taken
15 This permit shall become voidable unless the facilities are constructed in
accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data
16 Prior to the sale of any lot, the following deed restrictions must be recorded
a The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 051107, as issued
by the Division of Water Quality under NCAC 2H 1000
b The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit
c These covenants are to run with the land and be binding on all persons
and parties claiming under them
d The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality
e Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality
f The maximum built -upon area per lot is as follows

The allotted amount includes any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front
lot line and the edge of the pavement Built upon area includes, but is not
limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina
and parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools
g Lots within CAMA's Area of Environmental Concern may be subject to a
reduction in their allowable built -upon area due to CAMA regulations
h All runoff on those lots within a designated pipe collection area, must drain
into the permitted system This may be accomplished through providing
roof dram gutters, which ultimately drain to the facility, grading the lot to
drain into the facility, or grading perimeter swales and directing them such
that they ultimately drain into the facility
Built -upon area in excess of the permitted amount will require a permit
modification
17 A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots The recorded
copy must contain all of the statements above, the signature of the Permittee, the
deed book number and page, and the stamp/signature of the Register of Deeds

18 Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel The facility must be in compliance with all permit conditions Any
items not in compliance must be repaired or replaced to design condition prior to
the transfer Records of maintenance activities performed to date will be
required
19 Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria
a The fountain must draw its water from less than 2' below the permanent
pool surface
b Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the deepest
part of the pond
c The falling water from the fountain must be centered in the pond, away from
the shoreline
d The maximum horsepower for the fountain's pump is based on the
permanent pool volume The maximum pump power for a fountain in this
pond is fountain HP
20 Built upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina and parking areas, but does not include
raised, open wood decking, or the water surface of swimming pools
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director In the event there is either a desire for the facilities to
change ownership, or there is a name change of the Permittee, a
"Name/Ownership Change Form" must be submitted to the Division of Water
Quality accompanied by appropriate documentation from the parties involved
This may include, but is not limited to, a deed of trust, recorded deed restrictions,
Designer's Certification and a signed Operation and Maintenance plan The
protect must be in good standing with DWQ The approval of this request will be
considered on its merits and may or may not be approved
2 The permittee is responsible for compliance with all of the terms and conditions
of this permit until such time as the Director approves the transfer request
3 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215 6A to 143-215 6C
4 The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction
5 In the event that the facilities fad to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
6 The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition
7 Permittee grants permission to staff of the DWQ to access the property for the
purposes of inspecting the stormwater facilities during normal business hours

8 The permittee shall notify the Division in writing of any name, ownership or
mailing address changes within 30 days
9 A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of

North Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of an overall low density subdivision @25%
within '/z mile of SA waters, and @30% outside the Y2 mile SA zone, with 7 wet
detention ponds for the treatment of the pockets of nigh density outside of the Y2 mile
SA line, in compliance with the provisions of 15A NCAC 2H 1000 (hereafter referred to
as the "stormwater rules') and the approved stormwater management plans and
specifications and other supporting data as attached and on file with and approved by
the Division of Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until May 2, 2016 and shall be
subject to the following specified conditions and limitations
I DESIGN STANDARDS
1 This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 The stormwater systems have been approved for the management of stormwater
runoff as described in Section 17 on page 3 of this permit The various
development tracts identified on the development plans can be submitted as
either separate permits, or modifications to this permit
3 This project must demonstrate and maintain 25% overall low density within the '/Z
mile SA area, and 30% overall low density within the remaining project area Any
areas of the project determined to be or identified as a pocket of high density
must submit a high density application and receive a permit for an engineered
stormwater treatment system prior to construction Each of the seven (7)
permitted wet detention ponds is located outside of the Y2 mile SA line

4 The areas of this project within the '/z mile SA zone, as shown on the approved
plans, must either meet the low density requirements outlined In the stormwater
rules for projects within Y2 mile of and draining to SA waters, or must provide an
engineered infiltration system The infiltration system must meet all of the
requirements as listed In the stormwater rules
5 All stormwater collection and treatment systems must be located In either
dedicated common areas or recorded drainage easements The final plats for the
project will be recorded showing all such required easements, In accordance with
the approved plans
6 Approved plans and specifications for this project are Incorporated by reference
and are enforceable parts of the permit
7 The following design elements have been permitted for the 7 wet detention
ponds, and must be provided In the system at all times

91 758 acres of built -upon area inside the project area that Is within Y2 mile of SA
waters, and no more than 78 10 acres of built -upon area within the remainder of

11. SCHEDULE OF COMPLIANCE
No homeowner/lot owner/developer shall fill In, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division

2 The permittee is responsible for verifying that the proposed built -upon area for
the entire lot, including driveways and sidewalks, does not exceed the allowable
built -upon area Once the lot transfer is complete, the built -upon area may not be
revised without approval from the Division of Water Quality, and responsibility for
meeting the built -upon area limit is transferred to the individual property owner
3 If an Architectural Review Board or Committee is required to review plans for
compliance with the BUA limit, the plans reviewed must include all proposed
built -upon area Any approvals given by the Board do not relieve the homeowner
of the ultimate responsibility to maintain compliance with the permitted BUA limit
4 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to the approved plans, regardless of size
b Project name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area
e Further subdivision, acquisition, or sale of all or part of the project area
The project area is defined as all property owned by the permittee, for
which Sedimentation and Erosion Control Plan approval or a CAMA Major
permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
5 The Director may determine that other revisions to the project should require a
modification to the permit
6 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
7 The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
8 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
9 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification
10 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
11 Permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual

12 Prior to the sale of any lot, the following deed restrictions must be recorded The
permittee shall fill in the blank space in (f) below with the correct maximum
permitted lot BUA for the section being permitted
a The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 050543, as issued
by the Division of Water Quality under NCAC 2H 1000
b The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit
c These covenants are to run with the land and be binding on all persons
and parties claiming under them
d The covenants pertaining to sormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality
e Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality
The maximum built -upon area per lot is square feet This
allotted amount includes any built -upon area constructed within the lot
property boundaries, and that portion of the right-of-way between the front
lot line and the edge of the pavement Built upon area includes, but is not
limited to, structures, asphalt, concrete, gravel, back, stone, slate, coquina
and parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools
g No one may pipe, fill in or alter any vegetated drainage swales within the
low density project areas
h Lots within CAMA's Area of Environmental Concern may be subject to a
reduction in their allowable built -upon area due to CAMA regulations
Built -upon area in excess of the permitted amount will require a permit
modification
13 A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots The recorded
copy must contain all of the statements above, the signature of the Permittee, the
deed book number and page, and the stamp/signature of the Register of Deeds
14 Decorative spray fountains will be allowed in the wet detention ponds, subject to
the following criteria
a The fountain must draw its water from less than 2' below the permanent
pool surface
b Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the deepest
part of the pond
c The falling water from the fountain must be centered in the pond, away from
the shoreline
d The maximum horsepower for the fountain's pump shall not exceed that
shown in Section 17 of this permit

15 Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel The facility must be in compliance with all permit conditions Any
items not in compliance must be repaired or replaced to design condition prior to
the transfer Records of maintenance activities performed to date will be
required ,
16 The permittee shall at all times provide the operation and maintenance
necessary to assure that all components of the permitted stormwater system
function at optimum efficiency The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and revegetation of side slopes
d Immediate repair of eroded areas
e Maintenance of side slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of structures, orifice, catch basins and
piping
g Access to all components of the system must be available at all times
17 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ The records will indicate the date,
activity, name of person performing the work and what actions were taken
18 This permit shall become voidable unless the facilities are constructed in
accordance with the conditions of this permit, the approved plans and
specifications, and other supporting data
19 Built upon area includes, but is not limited to, structures, asphalt, concrete,
gravel, brick, stone, slate, coquina and parking areas, but does not include
raised, open wood decking, or the water surface of swimming pools
20 If at any time the overall built -upon area exceeds the maximum permitted low
density level of 25% or 30% as specified on the application, the permittee shall
submit a permit modification to the Division for an engineered system to treat all
of the runoff generated by all of the built -upon area on the entire protect
21 To be considered for low density within the individual development tracts, the
built -upon area percentage within the specified tract boundaries shall not exceed
40%, and the main means of transporting the runoff shall be vegetated swales
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director In the event there is either a desire for the facilities to
change ownership, or there is a name change of the Permittee, a
"Name/Ownership Change Form" must be submitted to the Division of Water
Quality accompanied by appropriate documentation from the parties involved
This may include, but is not limited to, a deed of trust, recorded deed restrictions,
Designer's Certification and a signed Operation and Maintenance plan The
project must be in good standing with DWQ The approval of this request will be
considered on its merits and may or may not be approved
2 The permittee is responsible for compliance with all of the terms and conditions
of this permit until such time as the Director approves the transfer request

3 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215 6A to 143-215 6C
4 The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances which may be imposed by
other government agencies (local, state, and federal) which have jurisdiction
5 In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
6 The permit maybe modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition
7 Permittee grants permission to staff of the DWQ to access the property for the
purposes of inspecting the stormwater facilities during normal business hours
8 The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days
9 A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction

Stormwater Narrative �'"��
The North River Club is a 629 2 acre Planned Unit Development (PUD) within the Town
of Beaufort in Carteret County The low density project includes a variety of residential
neighborhoods along with commercial and recreational uses The property, which lies
between the US-70 and NC 101, is comprised mostly of level farmland, with several
forested areas scattered within The Carteret County Soils Surrey has classified
approximately 90% of the land as Arapahoe soils, with smaller pockets of Tomotley,
State, Altavista, Augusta and Deloss Typical existing grade elevations range from 11 5
to 9 0 feet above sea level (NAVD 1988), with the exception of the east side of the
project near US 70, which slopes gently to an elevation of 3 0 The existing drainage
system for the property includes lateral farm ditches spaced at 150' to 200' intervals
The lateral ditches connect to collection ditches primarily along the perimeter of the
project The system appears to drain the property quickly and efficiently, ultimately
producing high peak discharges
Earlier this year, a Master Plan Stormwater Permit (No 543 was issued for
the project that included conformance parameters to low density development
as well as approval of several engineered stormwater management ponds for pockets
of high density accounted for under the overall project built upon area plan A
stormwater management permit was also issued for section one of the project Ste_
051107) under conformance to the Master Plan Permit
Section Two for the North River Club consists of approximately 47 acr on the
southern portion of the property This project limits include single fame y home sites (in a
variety of sizes), patio hom d condominiums with common open space shared
within The development winds throng portions of the 18-hole golfcourse. which was
included within the aforementioned master plan mit The project has been
to coFin o the parameters within the Low Density NCDENR Division of Water Quality
Stormwater Managem Ian permit These parameters include maintaining
overall coverage elow 40% d utilizing open swales as the primary means of
conveyance
Additional stormwater management is provided in order to further reduce runoff rates
and exceed local municipal management goals These management measures release
runoff into the existing perimeter ditches surrounding the property Ultimately, this
drainage is conveyed to three of the five project outfalls, including Newby Creek,
Wading Creek, and a manmade canal that connects to the North River The project has
received preliminary plat approval by the Town of Beaufort and construction is
anticipated to begin later this year
