(TOBY) VINSON, JR. fnferim Director Subject: NOTICE OF INSPECTION / NOTICE OF PERMIT EXTENSION AND REQUEST FOR DESIGNERS CERTIFICATION State Stormwater Management Permit No. SW8 060606 Sonic Drive-in Jacksonville, NC Onslow County Dear Mr. Junkin: Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for issuance of the subject stormwater management permit. PERMIT EXTENSION On August 5, 2009, the Governor signed Session Law 2009-406. This law impacted any development approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010. The law extended the effective period of any stormwater permit that was set to expire during this time frame to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for a total of four (4) years extension. Accordingly, this permit shall now be effective from the date of issuance until October 24, 2020. Please note that per NCAC 02H.1042(3) of the stormwater rules, you are required to submit a renewal application to the Division 180 days prior to the expiration date of the permit. DESIGNERS CERTIFICATION On October 24, 2006, the Division of Energy, Mineral and Land Resources issued a Stormwater Management Permit to you for the subject project. Per Schedule of Compliance Condition 11.7 of the permit, the designer for the type of system installed must certify that the system was inspected during construction, was constructed in substantial conformity with plans and specifications approved by the Division and complies with the permit requirements. As of this date, our records indicate the required designer's certification has not been received. Please submit the required certification (blank copy attached). The project is located at 261 Freedom Way, Jacksonville, NC 28544. Please be reminded that routine operation and maintenance of the permitted wet detention pond stormwatcr system is required under Schedule of Compliance Condition 11.3 of the permit. The specific Operation and Maintenance procedures are listed in Section I II of the signed Wet Detention Basin Supplement form that was attached to the Permit application. Please provide the necessary maintenance to restore the permitted stormwater system to its design condition and provide the routine maintenance as specified in the O&M agreement. Please either provide the requested information, or provide your response to this letter, by April 27, 2018. As stated in the City of Jacksonville, NC Stormwater Utility Credit Policy, credits are given to customers who "undertake specific, approved actions that reduce the demand for stormwater service on the public stormwater system, or provide an ongoing public benefit related to stormwater management. A credit is an ongoing reduction in the fee." We are writing to advise you that an inspection of your facility was made on February 26, 2018. According to 410 of the Ownership and Maintenance Requirements section of the Stormwater Utility Credit Policy, "The stormwater detention/retention facilities must be operated and maintained in proper condition to control the peak runoff rate as presented above, in accordance with the maintenance standards presented in this manual. If the applicant does not operate and maintain the facility as required, the credit will be discontinued." The following problems were found at your BMP and need to be fixed (see documentation on the following pages). List of problems or discrepancies: 1. The fence is badly damaged in one section and needs to be repaired. 2. The 3:1 slope ratio is not present in certain sections of the pond. 3. No wetland plants were observed on the vegetative shelf, though this cannot be confirmed until regrowth further into spring. 4. There is a large tree in the middle of the pond that needs to be removed. 5. Trash and debris has accumulated throughout the pond. 6. The inlet structure appears to be partially filled in with sediment and vegetation. 7. The outlet structure appeared to be clogged and not draining. 8. The adjacent ditch is very clogged and should be cleared to facilitate proper flow of Stormwater. Item 411 of the Ownership and Maintenance Requirements sections states: "In order for storm water retention and detention facilities to operate as they were intended, maintenance must be routinely performed. Improperly maintained stormwater facilities do not reduce stormwater impacts effectively and are therefore ineligible for credit." The following minimum maintenance items are not being met at your stormwater facility: a. No woody vegetation shall be allowed to grow on the embankment without special design provisions. b. Debris shall be removed from blocking inlet and outlet structures and from other areas of potential clogging (i.e., weirs, pipes, grates, etc.). This is especially important after major storms. Extended detention control devices should be checked often for debris accumulation and clogging. c. The control structures shall remain unaltered and be kept structurally intact, free from erosion, and functioning as originally designed. Please let us know when these issues have been resolved so we can re -inspect. If these issues are not resolved by April 2, 2019 we will no longer be able to issue you a monthly credit towards the stormwater fee. The outlet structure is clogged and the pond is therefore not draining. The receiving ditch is not draining either and we are getting some flooding. If an inspector is going to be in the Jacksonville area any time soon can you get them to look at it please? Will send more pictures in another email. The stormwater control has been designed to handle the runoff from 37,928 square feet of impervious area. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. , During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowin.9 and re -vegetation of slopes and the vegetated, filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name'of person performing the work and what actions were taken. 5. Decorative spray fountains will be allowed in the stormwater treatment system, subject to the following criteria: a. The fountain must draw its water from less than 2' below the permanent pool surface. b. Separated units, where the nozzle, pump and intake are connected by tubing; may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. d. The maximum horsepower for a fountain in this pond is 118 horsepower. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become void unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built-upon.area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. III. GENERAL CONDITIONS 1. This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual, 8. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximurn height of six inches, and reninve trash as needed. 3. Inspect and repair the collection system (i.c. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. 4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is reduced to 75% of the'original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (ix. stockpiling near a wet detention basin or stream, etc.). The measuti.ng device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the permanent pool depth reads 3.37 feet in the train pond, the sediment shall be removed. When the permanent pool depth reacts 2.62 feet in the ferebay. the sediment shall be removed. Rogers Corp. proposes to construct a restaurant facility on a 1.06 acre lot located near the intersection of NC 24 and Piney Green Road in Jacksonville, Onslow County. The site is currently vacant, however, previously accommodated a car repair shop which has recently been removed. The project site is tributary to an UT of Wallace Creek (SB;NSW) in the White Oak Basin. The proposed development activities are high density (percent impervious > 25 %); therefore, stormwater treatment facilities are required. The attached Stormwater Plan includes a 3,064 sf wet detention basin located at the eastern side of the site (across Glade Lane). The proposed pond is sized for-90% TSS removal. The pond does corporate pretreatment, other than the forebay. The pond doesnot include a vegetated filter at the outiet All stormwater emanating from new impervious surfaces that is generated on -site shall be collected and directed to the wet pond. The treatment system will require periodic maintenance, Maintenance frequency shall be dictated by pond depths. Pond depths shall be checked bytithe­ owner on a quarterly basis. When measured depths are less than that specified on the application, the pond shall be manually dewatered (pump) and accumulated sediment removed and properly disposed of. Site topography is gently sloping (0 - 5%) with the lowest elevations towards the northerly boundary of the tract. Significant fill materials will be required to raise site to required grade. The entire area designated within "Clearing Limits" will be disturbed during initial construction, and will include grading for parking, swales and storm drainage. During construction, all runoff will be diverted by a series of temporary diversion ditches and/or storm drain pipes to the Treatment Pond. The treatment pond is of adequate size and volume to contain sediment from the entire disturbed area during construction.
