Page 42 Permit # 89-06. The applicant proposes to expand an existing 28 slip marina to 35 slips. 9. Narrative Description: The Morgan Creek Landings, Inc. project is located at 233 Old Causeway Road. The property lies adjacent to Morgan Creek Turning Basin and Beaufort Harbor in 1vlorehead City, Carteret County. The northern part of the tract is bordered by individual lots to the east and mixed use lots to the west while the southern portion of the tract is bounded by Morgan Creek to the west and Beaufort Harbor to the east. Morgan Creek Landing Inc. is 444,539 square feet in its entirety and is an average of F-8' above NHW. Presently there are condominiums units with existing boat slips and other amenities on this tract. Small fringes of coastal marsh mostly Spartina alterniflora are located within the vicinity of the proposed work. They are landward of slips 6-8, east of slip 15 and south of slip 19. The southern boundary of this property includes an oak hammock which is bordered by coastal marsh comprised predominately of Juncus roemerianus, S_.partina alterniflora, and Spartina patens. The undeveloped portion of remaining high ground is comprised mostly of cedars and scrub bushes. The developed high ground has been landscaped previously. The Morehead City Land Use Plan classifies this property as fort Mixed Use, with all AEC's classified Conservation. Morgan Creek Turning Basin and Beaufort harbor are not designated as Primary Nursery Areas. Both are closed to the taking of Shellfish, and both carry water classifications of SC. The adjoining waters of Newport River are classified as SA-HQW. The substrate in Morgan Creek Turning Basin and Beaufort Harbor is mostly silt and sand. 10. Proiect Description: The existing major permit # 89-06, which was issued on June 9, 2006, authorized only the land disturbing activities associated with the establishment•of the Morgan's Creek landing residential condominium complex, as well as the construction of the parking areas, driveways, utilities and storm water collection system. A transfer/minor modification was issued on December 3, 2007 for further upland development not permitted through the original permit. It authorized the grading and other land disturbing activities associated with the construction of a wooden deck, wooden access ramp, the bathroom and pool equipment storage building, outdoor shower, concrete deck and spa -type pool which is located on the peninsula located south of the existing condominiums. The applicant's current proposal is to add seven new slip~ to the existing 28 slip marina for a total of 35 slips. They would be numbered 2-15 on the east side and 1-19 on the west side. The two temporary slips at the proposed floating dock area, which is located at the north side of the basin, would not be numbered. Slips 1-18 on the west side are existing with,P,as the new slip area. Slip area 19 would have a 6' x 30' dock extension from the existing dock and one 4' x 35'finger pier for access with four tie pilings. Page 03 areas located on the east side of the basin would be numbered 6,,7, 8° and .15There would „Y be two 4' x 40' finger piers for access at slips 6-8 and one 4' x 35' finger pier for slip 15. The proposal also includes four boatlifts within slips 6-8 and 15. A floating dock with gangway would be placed along the head of the existing boat basin directly south of the condominiums. This Iocation would account for the final two new slip areas. Five slips would be permanent and two would be used on a temporary basis. The typical boats to be served would be open runabouts with a typical boat length of 25'. The applicants are requesting to construct a pedestrian pier across the marsh located south of the peninsula. This span of marsh contains a high ground oak hammock in the middle. The pedestrian access pier would be 6' x 790' and is proposed to be elevated a minimum of 6' above the coastal wetland substrate and 8' above the creek bed. It would cross a tidal ditch which is dry at nlw. The purpose for the pedestrian pier is for residents to gain access to the oak hammock and enjoy scenic vistas. They are also proposing excavation within the areas of proposed slip 15 and slip 19 locations. The marina basin has previously been excavated to a depth of —6' at nlw. The average existing depths are at -4to 5" to -6' nlw. The final project depth would be-6'nlw. This excavation would remove 170 cubic yards of material. The applicants are also proposing removal of a sunken barge currently located along the east side of Morgan Creek with a crane mounted barge .with chains and a tooth bucket to snag the visible remains. 11. Anticipated Impacts: The proposed slip additions which include the pier, dock and finger piers would shade ,1,350ft2 and incorporate 4,170 ft2 of open waters. The number of slips would increase to 35. The barge removal would be performed with a grab method from a crane mounted barge with minimal bottom disturbance. The removal of this should improve navigation and water quality conditions. A total of 1,232 ft2 of shallow bottom would be disturbed during excavation of slips # 15 and # 19. All excavation is proposed a minimum of 5' from existing coastal wetlands and bulkheads with spoil material hauled off site. The setting of pilings for the new slips would cause temporary increases in turbidity. A total of 2,586 ft2 of coastal wetlands would be incorporated and shaded by construction of the pedestrian pier. A total of 1,674 ft2 of high ground would be incorporated by the pedestrian pier. No new impervious areas proposed. All proposed work would meet the required COE setback of 58' from the Morgan Creek turning basin. Morgan Creek Landing is a 30 unit condominium with a 28 slip marina, swimming pool and other amenities. The property borders Morgan Creek and "Beaufort Harbor" on its south side and Old Causeway Road on its north. The application is seeking permission to: 1) add three finger piers off an existing dock which is located in the water body locally known as Beaufort Harbor. These docks will range in length from 35' to 42' x 4' in width and will accommodate four additional boat lifts/slips. One small area of creek bottom, approximately 22'x 28', is proposed to be excavated to -6' normal low water (nlw) deep; 2) extend the existing main dock in Morgan Creek by an additional length of 30' x Win width and construct an approx. 35' long x 4' wide finger pier (with adjacent tie-up pilings). The dock extension would be immediately south of slip 4 18 and would provide for an additional `in -the - water' boat slip. A small area, approx. 22' x 28', would also be excavated to a depth of -6' nlw within the boat slip. The dock, finger pier and all associated tie-up pilings will be located outside of the US Corps of Engineers' setback policy which has been established for federal navigation projects. (This dock is adjacent to the federally authorized Morgan Creek turning basin); 3) place an approx. 50' long x 6' wide floating dock at the head of the existing boat basin to provide a convenient loading and unloading area for condominium owners. An articulated walkway/ramp, up to 30' in length x 6' wide, will provide access from existing high ground to the floating dock. The floating dock could accommodate two boats; 4) construct an approx. 790' long x 6' wide pedestrian pier which will be elevated above coastal wetlands and through a high ground hammock. The purpose of this pier is to provide pedestrian users with a scenic vista and to gain access to the hammock of the surrounding area. The pier will cross a small tidal creek which is dry at low tide. The pier decking will be elevated at least 8' above the creek bed and at least 6' above the substrate of all coastal wetlands, There will be no mechanical land clearing of the hammock. Only hand clearing will occur; 5) remove an old derelict dredge/barge which is rusting away in Morgan Creek. A crane mounted barge will be used in the removal effort. Chains and a tooth bucket will be used to snag the visible remains of vessel with all removed material being disposed in accordance with applicable local, state and federal regulations. Actual bottom disturbance of Morgan Creek should be de minimis. This project will increase the number of slips for this marina by 7, bring the total to 35. Five will be permanent slips and two will primarily be used on a temporary basis. Excavation of the creek bottom will involve a total area of just over 1200 sq. ft.. A clear benefit of this project will be the removal of a derelict and rusty structure from the waters of Morgan Creek. This should improve water quality in the area, eliminate an eye -sore and a navigational hazard. The proposed pedestrian pier will not impact navigation and will be significantly elevated in height over coastal wetlands. Shading impacts from this structure should be minimized. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 4. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility.
