staff supervision are available.
2. You must specify files you want to review by facility name or incident number, as
appropriate. The number of files that you may review at one appointment will be limited to
five.
3. You may make copies of a file when the copier is not -in use by the staff and if time permits.
There is no charge for 25 or less copies.: cost per copy after the initial 25 is 2.5 per copy.
Payment is to be made by check, money order, or cash in the administrative offices.
4. Files must be kept in the order you received them. Files may not be taken from the office.
No briefcases. large totes_,. etc._are_permitted in the fife review area. To remove, alter,
deface, mutilate, or destroy material in public files is a misdemeanor for which you can be
fined up to $500.00.
5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and collected for
checks on which payment has been refused.
6. The customer must present a photo ID, sign -in, and receive a visitor sticker prior to
reviewing files.

I hope you are well. I left you a voicemaiI about this project yesterday, but wanted to also try email. The Contractor has
just finished his remediation work on the site and we need to go certify the facility.
Our action letter that was sent to your office was dated January 31, 2011 and indicates that the work will be completed
within 60 to 90 days which would make the deadline approximately May 1, 2011. Is there any flexibility with this date?
During the bid process BB&T had some cost issues with the Contractor and it significantly delayed construction. We
would prefer to certify the facility once a permanent stand of grass has been established, however this likely will not
occur for another couple of weeks as the facility was just seeded last week. However, I don't want BB&T to receive any
fines if May 1" is indeed the deadline.
The Contractor has told us that they did install matting to help prevent scour and facilitate grass growth. If you.do need
a certification by May I", we could certify it knowing that the permanent stand of grass has not been established and
then revisit the site in the next 3 to 4 weeks (as we make fairly frequent visits to the Wilmington area) to verify that
permanent vegetation has indeed been established.
Please let me know your thoughts on this as soon as possible as we would need to make a site visit this week in order to
meet a May 1" deadline.

It was a pleasure speaking with you today. A co-worker and myself have generated a list of all of the state stormwater
permits issued to facilities and/or owners named BB&T within the NC Coastal Counties. Please find it attached as an
excel table.
As you may know, a state stormwater permit is required for a project within the 20 NC Coastal Counties that has
required a Sediment and Erosion Control Permit (disturbance of more than an acre) or a CAMA ( Coastal Management)
permit or impervious surfaces of >10,000 square feet. As you may recognize in the excel table attached, the state
stormwater permits are issued for a 10 year period. Certain types of permits like low density, redevelopment and offsite
permits are valid without expiration.
In regard to the question you offered to set up a process throughout BB&T, this should be a start. Please note, if you
would like more information about a specific permit, we do offer a file review process. To review the file, simply set up
an appointment with Ms. Jo Casmer (910-796-7336) and come in to the Wilmington office for the review. If an
agreement for Operations & Maintenance applies for a permit, it would be included in the file and typically added to the
back of the stormwater permit. If I can provide any further information, please let me know.

The purpose of this letter is to notify NCDWQ that a notice of violation (NOV) has been
received for the referenced site and that our office is currently working with our site engineer
(Commercial Site Design, PLLC) to address the continents and concerns expressed in the NOV,
Our plan of action includes: 1.) clearing the underbrush and performing any necessary grading
activities within the existing vegetated filter area as well as re-establishing a flow spreader
upstream of the vegetated filter so that it functions in accordance with the originally approved
plans and specifications. 2.) repairing the area of soil erosion against the existing curb line in the
vicinity of the vegetated filter area and 3.) submit an engineer's certification for the stormwater
system. We anticipate that the remedial measures will be completed in 60 to 90 days. Upon the
completion of these measures, we will provide the required professional engineer's design
certification.

On December 21, 2010, Division of Water Quality (DWQ), Wilmington Regional Office
(WiRO) personnel performed a Compliance Inspection of the subject project, located at
the intersection of NC Hwy 210 & 172 in Sneads Ferry, Onslow County, North Carolina.
The inspection was performed to determine the status of compliance with Stormwater
Permit Number SW8 041001 issued to you on November 10, 2004.
The project has been found in violation of Stormwater Permit Number SW8 041001,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
Failure to cedEfy the stormwater system. A file review revealed that this
office has not received a Designers' Certificate.
Permit condition states that upon completion of construction, prior to issuance of a
Certificate of Occupancy, and prior to operation of this permitted facility, a certification
must be received from an appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with this permit, the approved
plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
To correct these violations you must:
1. Provide a written "Plan of Action" which outlines the actions you will take
to correct the violation(s) and a time frame for completion of those actions,
on or before February 4, 2011.

construction, operation and maintenance of an underground infiltration trench in
compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part of this permit.
This permit shall be effective from the date of issuance until November 10, 2014, and
shall be subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.6 on page 3 of this permit. The stormwater
controls number 1-5 have been designed to handle the runoff from 16,499,
13,809, 8,700, 1,725 and 780 square feet of impervious area, respectively. The
system must be operated with a 50' vegetated filter.
3. The tract and each proposed infiltration system, will be limited to the amount of
built -upon area indicated on page 3 of this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements. The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency. The approved Operation and Maintenance Plan must be followed in
its entirety and maintenance must occur at the scheduled intervals including, but
not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
G. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of bypass structure, filter media, flow
spreader, catch basins, piping and vegetated filter.
g. A clear access path to the bypass structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit
shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other
supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate
easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project
area. The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted
future areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction.
12.The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements. The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made.

Ill. GENERAL CONDITIONS
1. This permit is not transferable to any person or entity except after notice to and
approval by the Director. In the event of a change of ownership, or a name
change, the permittee must submit a formal permit transfer request to the
Division of Water Quality, accompanied by a completed name/ownership change
form, documentation from the parties involved, and other supporting materials as
may be appropriate. The approval of this request will be considered on its merits
and may or may not be approved. The permittee is responsible for compliance
with all permit conditions until such time as the Division approves the transfer
request.
2. Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The
filing of a request for a permit modification, revocation and reissuance or
termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.

Site Summary
The proposed BB&T site is located between NC Highway 210 and NC Highway 172 in
Sneads Ferry, North Carolina. The site is 1.40 acres and is currently undeveloped land.
The site slopes gradually downward from east to west. The proposed construction will
consist of a single -story 4,672 square foot building with 32 parking spaces.
Stormwater Quality
The pollutant removal design standard of 85% removal of total suspended solids will be
cruet by use of infiltration devices. Subsurface infiltration areas will be constructed with
Rainstore3 structures, manufactured by Invisible Structures, Inc. Stormwater will be
allowed to exit the Rainstore3 structures and infiltrate into the soil. An infiltration test
was conducted at the site which indicated an infiltration rate of 2.9 inches per hour.
There are 5 separate infiltration areas proposed on the;site; each area is designed to
capture and infiltrate the runoff from the first 1.5 inches of rainfall. Stormwater for the
three largest drainage areas will flow across parking areas, through concrete flumes into
an aboveground vegetated area, consisting of a vegetated layer of sand over the entire
surface area of the Rainstore3 structures. The Rainstore3 structures are covered with a
geotextile filter fabric to prevent the -entry of sediment into the structures. Runoff in
excess of the design volume will enter into drainage inlets installed in the aboveground
vegetated area. This runoff will bypass the infiltration system and enter discharge piping.
The two smallest drainage areas on the site (0.04 and 0.018 acres) are located between
the crown of the parking lot entrance and the right-of-way at the south and west entrances
to the site. Stormwater for these drainage areas will flow across the pavement into trench
drains, then outlet into the Rainstore3 structures. Runoff in excess of the design volume
will bypass the trench drain,

Please find below responses to your request for additional information letter dated
October 29, 2004.
1) On the application forms the drain area 43 information has been revised to include
the "future building area" in the calculations. Yes, all of the future building area
will be draining to Basin #1. The area calculation on the application form has
been revised to include this "future development" area.
2) The above ground storage areas are not needed and have been removed from the
plan to accommodate for the 50' vegetative buffer. All required storage occurs
within the Rainstore units. The infil calculations on the application supplement
form and the plans now show more Rainstore units to be used (there was ample
room) in Basion 41. The other Basins were already not using the above -ground
storage area.
3) The plans have been revised to include by-passes on areas #4 & 45 (see sheet C-
3) and details for construction of the by-passes have been added to sheet to sheet
C-7.
4) All overflows have been re -designed to pass thru 50' vegetative filters. A detail
for the vegetative filter has been added to sheet C-7.

The 50' vegetated filter requirement is in Section .1008 (c)(4) of the rules, not
the BMP manual. The BMP manual is only the "guidebook" for designing the measures
that are required under the rules.
Existing ditches cannot be counted as the vegetated filter because they are
ditches, not filters. Vegetated filters are flat, wide grassed areas that promote
sheet flow. Ditches do not do this. I have a few suggestions for getting the filter
in - can you move or eliminate excess parking, or relocate the outlet to flow in a
different direction, or how about cutting down on the size of Basin #2 and using
the space for the filter? Perhaps two separate 25' foot areas are available? The
filter needs to be located wholly on the BB&T property, or you will need to
establish and record an easement agreement with the affected property owner that
includes restrictions on the use of that area so that the filter remains an open
grassed area, is not destroyed, piped, altered or changed in any way, and which
allows access for inspection and maintenance.
If you cannot provide a 50' vegetated filter, your only other option is to provide
excess storage in the system on the order of twice the design storm (for a total of
3" of runoff). You won't find this option in the rules -it is guidance we
established in house for projects that cannot meet the rules because they cannot
provide either the required filter or the required bypass.

the grassed storage area. How will the runoff ever back up into the storage areas? It
appears that the weir overflow elevation should be set at the elevation within the
basins that will provide what you call the "above -ground storage" volume.
3. There are 5 infiltration areas, but the overflow structure detail on sheet C7 lists
information for only 3 (1 and 1A drain to Basin #1, and have the same bypass
elevations). Areas 4 and 5 will also need bypass structures. (See comment #4).
4. Please provide a detail of the pre -sloped trench drains and how they will bypass the
excess runoff and how they connect into the Rainstore units.
5. All overflows must pass through a 50' vegetated filter prior to discharge. Please
locate and label the required filter on your property and on the plans. Please also
provide a detail of the filter on the plans.

Rainstore Units required, the volume necessary was determined by the
dimensions of the Rainstore Unit (1 Rainstore Unit takes up 3.7 cf of space, and

The Wilmington Regional Office received a Stormwater Management Permit Application for

preliminary review "of that information has determined that the application is not complete. The
following information is needed to continue the stormwater review:

property. Projects that share a common access are considered a common
plan of development and are subject to State Stormwater permitting
requirements. Does the bank also own this property? If not, please provide

does own this property, please make provision to either have a separate
sformwater facility to treat the runoff, or provide for treatment of the runoff
in this system.
9. If the capacity of each Rainstore Unit is 25 gallons, then converting to
cubic feet is 3.34 cubic feet (25 = 7.48 gallonslcf), not 3.70 cubic feet.
This will affect the provided volume reported in the calculations and on the
supplements.

Sounds good! The Infiltration does occur 2 feet above the Seasonal High
Water Table. I have the spots of the test hole labeled on the grading
sheet, but I will make them bigger so they show up better. The pipe is
a solid pipe, I will also label this better. I will also add some
detail to the overflow box detail. Yes, we did get the information from
Vincent Lewis. See email from Brian Soltz.
