On November 10, 2010, Wilmington Regional Office personnel performed a Compliance
Inspection of the subject project, located on South Topsail Drive (Hwy 50) in Surf City,
Pender County, North Carolina. The inspection was performed to determine the status
of compliance with Stormwater Permit Number SW8 040345, issued to you on ,tune 29,
2004.
The project has been found in violation of Stormwater Permit Number SW8 040345,
issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
1. Failure to certify the_stormwater system. A file review revealed that this office
has not received a Designers Certificate. A site inspection revealed constructed
asphalt roads and inhabited townhome buildings.
Permit condition states that upon completion of construction, prior to issuance of a
Certificate of Occupancy, and prior to operation of this permitted facility, 'a certification
must be received from an appropriate designer for the system installed certifying that
the permitted facility has been installed in accordance with this permit, the approved
plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification.
To correct this violation you must:
1. Provide a written "Plan of Action" which outlines the actions you will take to
correct the violation(s) and a time frame for completion of those actions, on or
before December 17, 2010.

construction, operation and maintenance of 2 infiltration basins and 2 infiltration trenches in
compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other supporting
data as attached and on file with and approved by the Division of Water Quality and considered a
part of this permit.
This permit shall be effective from the date of issuance until June 29, 2014, and shall be subject
to the following specified conditions and limitations:
I. DESIGN STANDARDS
I. This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described on page 3 of this permit, the Project Data Sheet. The stormwater control has
been designed to handle the runoff from 40,939 square feet of impervious area. This
system must be operated with a 50' vegetated filter.
3. The tract will be limited to the amount of built -upon area indicated on page 3 page 4 of
this permit, and per approved plans.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this project must
be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure
the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
C. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping.
g. A clear access path to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the conditions of
this pennit, the approved plans and specifications, and other supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an .
appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications
must be noted on the Certification. A modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
8. Access to the stormwater facilities shall be maintained via appropriate easements at all
times.
9. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.

b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage
area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area. The
project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.
10. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by the
Permittee for a minimum of ten years from the date of the completion of construction.
12. The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the permit. Within the time frame specified in the notice,
the permittee shall submit a written time schedule to the Director for modifying the site to
meet minimum requirements. The permittee shall provide copies of revised plans and
certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director. In the
event of a change of ownership, or a name change, the permittee must submit a formal
permit transfer request to the Division of Water Quality, accompanied by a completed
name/ownership change form, documentation from the parties involved, and other
supporting materials as may be appropriate. The approval of this request will be
considered on its merits and may or may not be approved. The permittee is responsible
for compliance with all permit conditions until such time as the Division approves the
transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action by the Division of Water Quality, in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances, which may be imposed by other government
agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
as may be required by this Division, such as the construction of additional or replacement
stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal business
hours for the purpose of inspecting all components of the permitted stormwater
management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance or termination does not
stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.

enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address changes
within 30 days.

hereby issue this Letter of Approval. The enclosed Certificate of Approval must be posted at the job site. This plan approval
shall expire three (3) years following the date of approval, if no land -disturbing activity has been undertaken, as is required
by Title 15A NCAC 48.0029.
Please be advised that Title 15A, of the North Carolina Administrative Code, 4B.0018(a) requires that a copy of the

Carolina General Statute 113A-51 thru 66), this office may require revisions to the plan and its implementation to insure

Acceptance and approval of this plan is!conditioned upon your compliance with federal and state water quafity laws,
regulations, and rules. In particular, if wetlands are effected by this land disturbing activity, the provisions of the Clean Water
Act as mandated by the Environmental Protection Agency must be adhered to. In addition, local city or county ordinances
or rules may also apply to this land -disturbing activity. This approval does not supersede any other permit or approval.
Please be aware that this project will be covered by the enclosed general storm water permit NCGO1000

1. This plan approval shall expire three (3) years following the date of approval, if no land disturbing activity
has been undertaken, as is required by Title 15A NCAC 413.0029.
2. The developer is responsible for the control of sediment on -site. If the approved erosion measures prove
insufficient, the developer must take those additional steps necessary to stop erosion from leaving this site.
Each sediment storage device must be inspected after each storm event. Maintenance and/or clean out
is necessary anytime the device is at 50% capacity.
3. Any and all existing ditches on this project site are assumed to be left undisturbed by the proposed
development unless otherwise noted. The removal of vegetation within any existing ditch or channel is
prohibited unless the ditch or channel is to be regraded with side slopes of 2 horizontal to 1 vertical or less
steep. Bank slopes may be mowed, but stripping of vegetation is considered new earth work and is
subject to the same erosion control requirements as new ditches.
4. The developer is responsible for obtaining any and all permits and approvals necessary for the
development of this project prior to the commencement of this land disturbing activity. This could include
agencies such as the Division of Water Quality's stormwater regulations, their enforcement requirements
within Section 401 of the Clean Water Act, the U.S. Army Corps of Engineers' jurisdiction of Section 404
of the Clean Water Act, the Division of Coastal Management's CAMA requirements, the Division of Solid
Waste Management's landfill regulations, the Environmental Protection Agency and/or The U. S. Army
Corps of Engineers jurisdiction of the Clean Water Act, local County or Municipalities' ordinances, or
others that may be required. This approval cannot supersede any other permit or approval; however, in
the case of a Cease and Desist Order from the Corp of Engineers, that Order would only apply to wetland
areas. All hiahland would still have to be in compliance with the N.C. Sedimentation Pollution Control Act.
5. If any area on site falls within the jurisdiction of Section 401 or 404 of the Clean Water Act, the developer
is responsible for compliance -with the requirements of the Division of Water Quality, the Corps of
Engineers and the Environmental Protection Agency (EPA) respectively. Any erosion control measures
that fall within jurisdictional wetland area must be approved by the aforementioned agencies prior to
installation or our Section must be notified of a relocation of the measures in question to the transition point
between the wetlands and the highlands to assure that the migration of sediment will not occur. If that
relocation presents a problems or contradicts any requirements of DWQ, the Corps or the EPA, it is the
responsibility of the developer to inform the Land Quality Section regional office so that an adequate
contingency plan can be made to assure sufficient erosion control remains on site. Failure to do so will be
considered a violation of this approval.
B. Any borrow material brought onto this site must be from a legally operated mine or other approved source.
A single use borrow site or an area to waste material is only permissible if it is operated under total control
of the Financially Responsible person or firm who is developing this site, is located on or adjacent to this
site, and has been incorporated as part of this plan.

7. This permit allows for a land disturbance, as called for on the application plan, not to exceed 1.6 acres.
Exceeding that acreage will be a violation of this permit and would require a revised plan and additional
application fee. Any addition in impervious surface, over that already noted on the approved plan, would
also require a revised plan to verify the appropriateness of the erosion control measures and stormwater
retention measures.
8. The construction detail for the proposed silt fence requires reinforcing wire and posts a maximum of
8 feet apart. Omission of the reinforcing wire is a construction change that necessitates more posts
needed for support, i.e. the spacing distance needs to be reduced to no greater than 6 feet apart.

construction vehicles during the grading and construction phases of this project. Access and egress from
the project site at a point without a graveled entrance will be considered a violation of this approval.
Routine maintenance of the entrances is critical.
10. The North Carolina Sedimentation Pollution Control Act mandates a shortened time frame in which to
reestablish vegetative groundcover. Slopes (including cuts, fills, and ditch banks) left exposed will, within
15 working days or 30 calendar days (whichever is the shorter) after completion of any phase of grading,
be planted or otherwise provided with groundcover sufficient to permanently restrain erosion.

Enclosed is the Stormwater Management Permit application and two copies of the plans and
specifications for Crosswinds Townhomes, Section H, Phase IV. This letter will serve as the
narrative description for the Stormwater Management Permit application. An Erosion Control
Plan has already been approved for this project.
TP, Inc. plans to continue development for Crosswinds Townhomes. This will be the fourth
phase of section two, the final phase of the development. The first phases of this project were
not developed by TP, Inc. and were established prior to TP, Inc. owning the property. The
area to be disturbed by TP, Inc. is approximately 1.58 acres.
This phase of development will include the addition of four buildings with eight townhomes
per building. It will also include the addition of a connecting road, Lazy Day Drive.
The land disturbing activity to be undertaken by TP, Inc. includes-
- Installation of gravel construction entrances.
- Installation of silt fencing.
- Construction of Build ings/Townhomes.
- Installation of permanent stormwater measures.
- Installation of road.
Silt fencing will be installed in locations, seen in Figure 2, to prevent erosion from the site and
also, to prevent erosion onto the site from undeveloped adjacent properties. The existing
topography at the site is relatively flat. The area will be graded so the stormwater flow from
the roads and buildings will flow into the permanent stormwater measures seen in Figure 2.
The flow arrows seen in Figure 2 reflect this grading activity and not the existing flow which
is, as I have noted, relatively flat.

The area labeled Drainage Area 1 encompasses Building C, a portion of the existing road, and
Lazy Day drive. This area will drain to two infiltration trenches, due to the depth to ground
water. All stormwater from Building C will be drained to the infiltration trenches via gutters.
A speed bump/dike shall be installed, at the location seen in Figure 2, to prevent any
stormwater from flowing back into the existing roadway. After the first inch and a half of
rainfall the stormwater will flow out of the road and into the vegetative filter at the end of
Lazy Day Drive. Drainage Area 2, Buildings D and E, will drain to an infiltration pond via
gutters and drainpipe. The stormwater from Drainage Area 3, Building F, will also drain into
an infiltration pond, via gutters and drainpipe. These two infiltration ponds will drain all
stormwater, after the first inch and a half rainfall into vegetative filters via a bypass
mechanism. These ponds will also have a one -foot wide earth berm around them to prevent
any stormwater from draining out of the ponds. Drainage Area 4, which is only the existing
pavement in front of Building F, will drain into an infiltration trench installed under the
existing gravel area seen in Figure 2. This area of roadway is sloped so that all the stormwater
from the road will run into the trench. No water from Building F will drain into the infiltration
trench. After the first inch and a half of rainfall, the stormwater will drain across Lary Day
Drive into the vegetative filter. The grass areas around the buildings and pavement will drain
by sheet flow via the existing grade.
Construction activities will take place as the following. A temporary gravel construction
entrance, a minimum of 50' long will be installed. The topography will be modified, as
discussed previously, on the subject site therefore silt fencing will be used as necessary. After
the grading has been completed, the buildings will be constructed, and all stormwater
retention devises will be installed. Then the asphalt for the additional road will be installed.
Routine inspections will be made during and after construction to ensure that the silt fencing
and all stormwater retention devices are working properly and free of excess sediment.

On December 1, 2003, personnel of this office inspected a project located on Topsail Drive in Pender
County, North Carolina. This inspection was performed to determine compliance with the North Carolina
Sedimentation Pollution Control Act of 1973. The ir• spection revealed a land -disturbing activity of
approximately 1 .09 acres being conducted.
It is our understanding that you and/or your firm are responsible for this land -disturbing activity. The
purpose of this letter is to inform ydlu that this activity was found to be in violation of the Act, NCGS 1 13A-50
to 66, and Title 15A, North Carolina Administrative Code, Chapter 4. If you feel that you are not responsible
for the following violations, please notify this office immediately.
The violations that were found are:
1. Failure to-fiie an erosion and sedimentation control plan with this office at least 30 days prior to
beginning a land -disturbing activity on a tract comprising more than one acre, when more than one acre
is to be uncovered, failure to secure this office's prior approval of the plan for any land -disturbing
activity prior to beginning the land -disturbing activity. NCGS. 113A-54(d)(4), G. S. 113A-57(4) and
15A NCAC 46.0107(c).
A land disturbing activity greater than one acre has occurred without an erosion and sedimentation
control plan.

An acceptable erosion and sedimentation control plan must be filed with and approved by this office
and implemented on the site sufficient to prevent off -site sedimentation. Until the required plan has
been approved, temporary measures must be provided immediately to control erosion and prevent
sedimentation damage. Any additional land -disturbing activities conducted without an approved erosion
and sedimentation control plan will constitute additional violations of the Act. We will notify you
following our review of the plan if additional measures are required.
2. Failure to take all reasonable measures to protect all public and private property from damage by such
land -disturbing activities. 15A NCAC 4B.0105.
No erosion and sediment control measures were installed at the time of the inspection.
To correct these violations, you must:
1. Submit an erosion and sedimentation control plan to this office for approval.
2. Install adequate and/or necessary erosion and sedimentation control measures.
The initial one day civil penalty could be an assessment of up to $5,000.00. A time period for
comp€lance is not required for this initial one day civil penalty pursuant to NCGS 113A-61.1 (c) and NCGS
113A-64(a)(1). An initial one day civil penalty is being considered for this project.
If the violations described in this Notice are not corrected within 20 days following your receipt of this
Notice, the Division of Land Resources may take additional appropriate legal action against you pursuant to
NCGS 113A-64. That action could be the assessment of additional civil penalties and may result in the
initiation of other remedies as prescribed by the Act. If additional civil penalties are assessed for the violations,
the amount may be up to $5,000.00 per day for each day of the violation pursuant to NCGS 133A-64(a)(1).
If all violations are corrected within the time period specified for compliance, additional civil penalties or legal
remedies will not be pursued. ,
Any new land -disturbing activity associated with this project should not begin until the area presently
disturbed is brought into compliancewith the Act. When corrective actions are complete, you should notify
this office so that the work can be inspected. You should not assume that the site is in compliance with the
Act until we have so notified you. In addition, once compliance has been achieved, all installed measures must
be satisfactorily maintained until development is complete and the site is fully stabilized to avoid further
violations of the Act.
We solicit your cooperation, and would like to avoid taking further enforcement action. At the same
time, it is your responsibility to understand and comply with the requirements of the Act. Copies of the
relevant statute and administrative rules may be examined at this office or will be sent to you upon request.
Should you have questions concerning this Notice or the requirements of the Act, please contact either Trentt

Enclosed is information that will accompany or replace previously submitted information
pertaining to the Stormwater Permit application for Crosswinds Townhomes, in reference to
your Request for Additional Information, dated June 21, 2004. The comments were handled
as follows:
1. A note has been added to the plan stating that no wetlands exist on the site.
2. A note has been added to the plan stating all roof drainage from Building `C' will be
directed to be picked up by the stormwater system.
3. A note explaining that the subject property topography and the proposed topography are
essentially flat.

Dear Mark,
On January 29, 2003, Land Management Group, Inc completed the soil characterization for the above -
mentioned project, as you requested. A site plan prepared by Mark Padgett, PLS, dated 9/16/02, was used
to preform these borings and is referenced in this letter. Two borings were made across this homogeneous
tract. Borings were placed in front of Buildings D and E in the proposed Lazy Day Drive, which are
currently under construction. Both boring were placed 10' off the center of each respective building. The
boring at Building D contained medium, single -grained sands and a 48" seasonal high water table. The
boring at Building E contained the same sandy soils with approximately 6" of sandy loam fill over the
surface. This fill material was placed to form a temporary construction road. The seasonal high water
table is 54" below the existing soil surface. The elevations at these two boring locations can be used to
interpolate the seasonal high water table over the remainder of the tract. The infiltration rates for these
sandy soils range from 15 in/hr to 40 in/hr.

and receive a Stormwater Management Permit by the Division of Water Quality. Any construction on the subject
site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in
appropriate enforcement action by this Office.
Either a Stormwater Permit Application Package including 2 sets of plans, completed application form,
fee, and supporting documentation, or a written response regarding the status of this project and the expected
submittal date must be received in this Office no later than May 31, 2004. Failure to respond to this request may
result in the initiation of enforcement action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the Erosion Control Plan approval letter
must NOT be considered the Coastal Stormwater Management Permit, which will be signed by the Water Quality

submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-57(4)).
Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must
obtain approval of a soil erosion control plan prior to the commencement of said land -disturbing activity (NCGS 1 13A-
54(d)(4)), The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the

lower the water table.
We have performed a preliminary review of your submitted plan and have determined that additional information
will be noressary before a final review can be completed. Enclosed is a checklist of items that must be submitted
