Due to the large public demand for file access, we request that you call at least a day in advance to schedule
an appointment to review the files. Appointments will be scheduled between 9:00am and 3:00pm.,
Viewing time ends at 4:45pm. Anyone arri*bg without an appointment may view_ the files to the extent
that time and staff supervision is available.
You must specify files you want to review by facility name. The number of files that you may review at one
time will be limited to five.
You may make copies of a file when the copier is not in use by the staff and if time permits. Cost per copy is
$.05 cents. Payment may be made by, check, money order, or cash at the reception desk.
FILES MUST BE KEPT LN ORDER YOU FOUND THEM. Files may not betaken from the office. To
remove, alter, deface, mutilate, or destroy material in one of these files is a misdemeanor for which you can
be fined up to $500.00. No briefcases, lame totes, etc. are permitted in the file review area.

Dear Ms. Scott:
The undersigned and this law firm represent Brunswick Plantation Property Owners
Association, Inc. (the "Association"). The following stormxvater management permits
affect. the Brunswick Plantation Community: SVV8 910108, S1j'S 940528,
S\V8 940706, SkV8 970637, SW8 990323, SW8 030234, S«'8 031026, S«18 060444,
SNA S 920611, S«`8 970221, and SN'V8 970805 (collectively the "Permits"). Caw Caw
Land Corporation is the Permittee under the Permits (the "Permittee"). Some of the
Permits appear to affect the golf course that is located within the Brunswick
Planation Community, but is owned and maintained by an entity that is unrelated to
the Association ("Golf Course") and the Permittee.
It is our understanding that the Permittee intends at sonic time in the near future to
contact, the Division of Energy, 1Vlineral and Land Resources ("DEIVILR") to requesL
that some or all of the Permits be transferred to the Association. Subject to the
satisfaction of the requirements imposed by North Carolina law, the Permittee's cure
of any violations, and the Permittee's compliance with DEAMR.'s policies and
procedures; the Association is prepared to cooperate with the transfer. In light of the
fact that the Association will be responsible for the maintenance and repair of the
stormwater nnanagennent. facilities after any such transfer and that some of the
Permits affect property owned and maintained by the Golf Course, the Association
requests that it be included in the transfer process and that it be afforded an
opportunity to review the required certifications from the Permittee's engineer prior
to any transfer of any of the Permits to the Association.
The Association also requests that, it receive notice of any proposed transfer. The

Dear Mr. Anderson:
On October 25, 2013, the Wilmington Regional Office of the Division of Energy. Mineral and Land
Resources (DEMLR) inspected The Hamptons in Brunswick County to determine the status of
compliance with the State Stormwater Management Permit Number SW8 031026 issued on February 13,
2008. DEMLR file review and site inspection revealed that the site is not compliant with the terms and
conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection
Report" attached to this letter, which summarizes the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. Submit the required Engineer's Certification.
2: Submit the required Restrictive Covenants.
Please inform this Office in writing before November 29, 2013, of the specific actions that will be
undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the
requested information, or to respond to this letter by the due date, may initiate enforcement action
including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by November 29, 2013 then DEMLR staff will re -inspect the site and issue a
Notice of Violation if the listed deficiencies have not been addressed.
If the project has changed its name, ownership, or mailing address, it is your responsibility to submit a
completed and signed Name/Ownership Change form to DEMLR at least 30 calendar days prior to
making the changes. Please include the name, mailing address and phone number of the person or
entity that is now responsible for this permit on the Name/Ownership Change form.

AN ACT TO (1) REQUIRE THE DEPARTMENT OF ENVIRONMENT AND NATURAL:
RESOURCES TO TRANSFER A PERMIT FOR A STORMWATER MANAGEMENT
SYSTEM FROM A DECLARANT OF A CONDOMINIUM OR PLANNED
COMMUNITY TO AN OWNERS ASSOCIATION UPON REQUEST OF THE
PERMITTEE AND SUBMISSION OF DOCUMENTATION THAT DECLARANT
CONTROL HAS TERMINATED, (2) PROVIDE THAT THE RULES OF A SANITARY
DISTRICT MAY NOT BE MORE RESTRICTIVE THAN OR CONFLICT WITH THE
REQUIREMENTS OR ORDINANCES OF A COUNTY WITH JURISDICTION OVER
THE AREA; AND (3) PROHIBIT ANY PERSON FROM CONTRACTING OR
SUBCONTRACTING TO RENT OR LEASE TO ANOTHER A PORTABLE TOILET
OR MANAGE OR DISPOSE OF WASTE FROM A PORTABLE TOILET UNLESS
THAT PERSON IS PERMITTED TO OPERATE A SEPTAGE MANAGEMENT FIRM.
The General Assembly of North Carolina enacts: .
SECTION 1. G.S. 143-214.7 is amended by adding a new subsection to read:
"(c2) The Department shall transfer a permit issued under this section for a stormwater
management system from the declarant of a condominium or a planned community to the unit
owners association, owners association, or other management entity identified in the
condominium or planned community's declaration upon request of a permittee if the
Department finds that i common areas related to the operation and maintenance of the
stormwater management system have been conveyed to the unit owners association or owners
association in accordance with the declaration; (ii) the declarant has conveyed at least fifty
percent (50%) of the units or lots to owners other than a declarant; and (iii) the stormwater
management system _ is in substantial _compliance with the stormwater permit issued to the
permittee by the Department. In support of a request made pursuant to this subsection, a
permittee shall submit documentation to the Department sufficient to demonstrate that
ownership of the common area related to the operation and maintenance of the stormwater
management system has been conveyed_ from the declarant to the association _and that the
declarant has conveyed at least fifty percent (50%) of the units or lots to owners other than a
declarant. For purposes of this subsection, declarant of a condominium_ shall have the same
meaning as provided in Chapter 47C of the General Statutes, and declarant of a planned
community shall have the same meaning as in Chapter 47F of the General Statutes."
SECTION 2. G.S. 130A-55 reads as rewritten:
1 130A-55. Corporate powers.
A sanitary district board shall be a body politic and corporate and may sue and be sued in
matters relating to the sanitary district. Notwithstanding any limitation in the petition under
G.S. 130A-48, but subject to the provisions of G.S. 130A-55(l7)e, each sanitary district may
exercise all of the powers granted to sanitary districts by this Article. In addition, the sanitary
district board shall have the following powers:
(7) To adopt rules necessary for the proper functioning of the district. However,
these rules shall not conflict with rules adopted by the Commission for
Public Health, Environmental Management Commission, or the local board
of health having jurisdiction over the area. Further, such rules shall be no
more restrictive than or conflict with requirements or ordinances of any
county having jurisdiction over the area, and, if a conflict should arise, the
requirements or ordinances of the county having jurisdiction over the area
shall control.
SECTION 3.(a) In addition to the other portable sanitation permitting provisions
of 15A NCAC 13B .0832(b), from the effective date of This act the Department of Environment
and Natural Resources shall prohibit any person from contracting or subcontracting to rent or
lease to another a portable toilet or manage or dispose of waste from a portable toilet,
regardless of ownership of the portable toilet, unless that person is permitted to operate a
septage management firm.
SECTION 3.(b) No later than January 1, 2014, the Commission for Public Health
shall adopt rules consistent with the provisions of Section 3(a) of this act. Notwithstanding
G.S. 150B-19(4), the rules adopted by the Commission pursuant to this section shall be
substantively identical to the provisions of Section 3(a) of this act.
SECTION 4. This act is effective when it becomes law.

On October 25, 2013, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected The Hamptons in Brunswick County to determine the status of

2008. A letter dated October 28, 2013, was sent to your listed mailing address of PO Box 4969, but was
returned on November 8, 2013 marked, "Not Deliverable as Addressed" and "Unable to Forward". The
Division is attempting to send the attached inspection report to you at this alternate address as found
from the NC Secretary of State (NCSOS) website. Please note that the Registered Agent and Principal
Office mailing address on file with the NCSOS for Caw Caw Land Corporation is PO Box 4969, Calabash,
NC. If this is no longer the correct mailing address, please update the Division and the NCSOS.

I have included the recent inspection findings for the permits that have had recent inspections, but it would be best to
conduct a file review to confirm the compliance history and the current status. Historical compliance records may not
appear on the server or in the database. Also, some of the correspondence in the files may provide some insight too.
Any expired permit would also be considered non -compliant.

The state stormwater files are public record and I can assist in scheduling a time for your firm to take a look at the files
for Brunswick Plantation here in WIRO. When I searched on Brunswick Plantation, I found the following stormwater
files in the database:

SW8 031026 — The Hamptons Phase I and II formerly Brunswick Plantation North Addition
took a quick look through the files on our server and saw indications that one or two of these may have been inspected
and found non -compliant. Also, as you can see from the notations above, several permits are expired and will need to
be renewed. Currently the renewal is only 8 years, so some of these may need to be renewed twice in order to bring
them into an active status. For instance, if the permit expired in 2006, the first renewal would extend the permit until
2014; just in time for the permit to be renewed again.
Generally, only 4-5 files are allowed to be reviewed at a time. But we can try to work with you if you need to see more
while in town. If you wish to do a file review, a standard copier/scanner will be available for you to use. (it has the ability
to scan to a USB drive) Unfortunately, we do not have the equipment to scan or copy large plans. If you think you will
want those, I can get you in touch with the Permit Assistance folks who generally help make those arrangements.

Brunswick Plantation has hired our firm to go and perform an analysis on the stormwater infrastructure in their
community (BMPs, swales, underground pipe networks, etc). In preparation for our site visit next week, we wanted to
contact NCDENR to find out if you knew of any outstanding issues or concerns with the stormwater devices, permitting
issues, etc.
Also, if you had any documents for the permitting of the BMPs, that would be welcome as well. Any information you

On January 6, 2004, the Wilmington Regional Office issued a Stormwater Management Permit
to you for Brunswick Plantation -North Addition. Per the requirements of the permit, a copy of
the recorded deed restrictions must be forwarded within 30 days of the date of recording. A
review of our files indicates that, as of this date, a copy of the recorded deed restrictions has
not been received in this Office.
Failure to record and/or provide a copy of the recorded deed restrictions prior to selling lots is a
violation of your permit, and subject to enforcement action. Please forward a copy of the
recorded deed restrictions to this Office at the address below by February 7, 2005, or
enforcement action may be initiated and may include recommendations for civil penalties and
revocation of the permit.
