Freeman Secretary On August 5, 2009, the Governor signed Session Law 2009-406 This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any pant between January 1, 2008, and December 31, 2010 The law extends the effective period of any stormwater permit that is set to expire during this time frame to three (3) years from its current expiration date On August 2, 2010, the Governor signed Session Law 2010- 177 which grants an extra year for a total of four (4) years extension Accordingly, Stormwater Permit # SW8 000521 which has already expired on January 16, 2011, is now in effect until January 16, 2015 Please resubmit the renewal application and fee at least 180 days review of the subject project, located at Hwy 211 in Southport, Brunswick County, North Carolina The inspection was performed to determine the status of compliance with Stormwater Permit Number SW8 000521, issued to you on January 16, 2001 The project has been found to violation of Stormwater Permit Number SW8 000521, issued pursuant to the requirements of 15A NCAC 2H 1000 The violations found are Failure to certify the stormwater system A file review revealed that this office has not received a Designers Certificate Permit condition states that upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation Any deviations from the approved plans and states that the runoff from all onsite and offsite built -upon area permitted with this project must be directed into the permitted stormwater collection system Specifically, North Carolina Administrative Code 15A NCAC 02H 1008(e)(4) states that the inlet structure must be designed to minimize turbulence using baffles or other appropriate design features and shall be located in a manner that avoids short- circuiting the pond To correct these violations you must Provide a written "Plan of Action" which outlines the actions you will take to correct the violation(s) and a time frame for completion of those actions, on or before upon 30 days of receipt of this notice 2 Submit the required Designers Certificate along with an as built that shows all field modifications Specifically, the modification of the installation of the inverted crown parking lot instead of the approved Swale used for directing runoff to the forebay 3 Direct all runoff to the forebay Failure to provide the (b) According to the permitted plans, there is supposed to be a grass Swale that runs along the eastern edge of the site and drains into the fore bay of pond #1 What happened to this swale ? (c) The slopes of the pond are in desperate need of grass. This site has been in full operation for several years The pond slopes must be seeded or have sod placed on them ASAP (d) The pond and surrounding area was full of trash and debris The trash is not only an eyesore, it can also effect the operation of the pond Trash can clog the outlet structure and eventually cause the sides of the pond to blow out Please include trash/debris pickup among your routine maintenance for the pond (e) Please send us a copy of the designers certificate and a copy of the deed restrictions for this site (f) If your plans are different than ours, please send us a SCHEDULE OF COMPLIANCE The stormwater management system shall be constructed in it's entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface 2 During construction, erosion shall be kept to a minimum and any eroded ai eas ofthe system will be iepan ed immediately The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled plans This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropi late designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation Any deviations from the approved plans and specifications must be noted on the Certification 8 If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility 9 A modification must be permitted prior to any construction The following items will require a mode f ication to the permit a Any revision to the approved plans, regardless of size b Project name change c Transfer of ownership d Redesign or addition to the approved amount of built -upon area e Further subdivision, acquisition, or sale of the project area The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought f Filling in, altering, or piping of any vegetative conveyance shown on the approved plan 10 The Director may determine that other revisions to the project should require a modification to the permit 11 A copy of the approved plans Prior to the sale of any portion of the property, an access/maintenance easement to the stormwater faLdities shall be granted in favor of the permittee if access to the stormwater facilities will be restricted by the sale of any portion of the property 13 The permittee is responsible for verifying that the proposed built -upon area does not exceed the allowable built -upon area 14 The Director may notify the permittee when the permitted site does not meet one or more of the minimum regw rements of the permit Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements The permittec shall provide copies of revised plans and certification in writing to the Director that the changes have been made 15 Me permittee shall notify the Division of any name, ownership or mailing address changes within 30 days III GENERAL CONDITIONS This permit is not transferable in the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Water Quality accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate The approval of this request will be considered on its merits and may or may not be approved 2 Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215 6A to 143-215 6C The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction 4 In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee
