Raleigh, NC 27604 Subject: NOTICE OF INSPECTION Weeksville Crossing Shopping Center Permit No. SW7061115 Modification Pasquotank County Dear Mr. Brantley: Dee Freeman Secretary On June 20, 2011, Scott Vinson of the Washington Regional Office of the Division of Water Quality (DWQ) inspected the Weeksville Crossing Shopping Center in Elizabeth City to determine compliance with Stormwater Management Permit Number SW7061115MOD issued on July 18, 2007. DWQ file review and site inspection revealed that the site is not fully compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter. There were several maintenance issues that need to be addressed as soon as possible as listed below: ➢ The bioretention areas do not appear to planted in accordance with the approved plans dated July 18, 2007. Additional plants need to be planted and spaced accordingly. ➢ The wet detention pond's outlet structure was not accessible due to the overgrowth of cattails surrounding it. Access needs to be made to the outlet structure in order for routine maintenance to occur. Please remove excessive growth immediately around the outlet structure for proper maintenance and drainage. ➢ The wet pond is almost completely covered with invasive cattails. Please properly remove the cattails throughout the rest of the pond and properly dispose prior to the end of October, 2011. In the future, cattails are to be removed on a periodic basis once 50% of the basin is covered. ➢ Please provide a copy of the past 2 years of inspections and maintenance records if available. if not, please start keeping these records and make available to DWQ upon request. ➢ The slopes of the bioretention areas were not properly vegetated with the approved grassed strip (Zoysia or similar approved grassed vegetation), nor was there an adequate amount of mulch within the bottom of each bioretention area. Please add the required grassed vegetation along the slopes of each basin and minimum required depth of 4 inches of hardwood shredded mulch (not pine bark) within each bioretention basin. The sediment accumulation in this area may need to be removed and properly replaced with the approved planting media and revegetated with grass or with the approved plants and mulch to allow for proper drainage. The underdrain pipes should also be checked for clogging to help with determining the reason for the standing water. A completely grassed bioretention basin is an acceptable substitute instead of the approved tree, shrub and mulch plantings for this basin if so desired. ➢ There is a shovel wide cut or trench made through the bottom of the berm in biortention area "D" allowing stormwater to drain out of the basin without proper treatment. (This particular basin is located directly across from the front entrance of the deli store.) This cut needs to be filled and revegeated immediately to prevent futher unpermitted discharges of stormwater runoff. This Office requires that you respond to this letter in writing to the address listed at the bottom of the letterhead within 30 calendar days of receipt of this Notice. Please provide a written "Plan of Action" which outlines the actions you will take to correct the above maintenance items and a time frame for completion of those actions. Please be advised that you are required to comply with the terms, conditions and limitations of your Stormwater Management Permit under Title 15A North Carolina Administrative Code 21-1 .1003 and North Carolina General Statute 143-214.7, including operation and maintenance of your permitted stormwater system. The cattails immediatley around the outlet structure need to be removed as soon as possible, however the remaining cattails throughout the rest of the pond do not need to be removed until March 2012 at the latest. Additional mulch needs to be added to the appropriate depths throughout all of the bioretention areas possibly with the only exeception to the bioretention area "E" located behind the shopping center. The standing water needs to be investigated and determined if the underdrains are clogged or more likely if sediment as accumulated and "sealed" the small area causing water to stand and not properly infiltrate. If grass can be established completely in the back biorention area, this would be completely acceptable, we just need to propely modify or revise the approved plans. Is the BUA (as permitted) graded such that the runoff drains to the system? Comment: 5W Measures Are the SW measures constructed as per the approved plans? Are the inlets located per the approved plans? Are the outlet structures located per the approved plans? Comment: 1. The bioretention areas do not appear to be planted in accordance with the approved plans dated July 18, 2007. Need to add the proper plants spaced accordingly or need to contact DWQ for potential modification of the approved plans. 2. The outlet structure was not accessible due to overgrowth of cattails surrounding it. The outlet structure was properly located, however the excessive overgrowth prevented access to be able to inspect the size and elevation of the small diameter outlet orifice and the overflow elevation. Need to remove excessive growth immediatley around outlet structure to provide access for routine inspections and maintenance. 3. Also need to properly remove cattails throughout the rest of the pond and properly dispose before th In the future, cattails are to be removed once 50% of the basin is covered. The bioretention area "E" located in the very back of the shopping mall had standing water in a small portion of the basin.
