On November 15, 2012, Roger Thorpe of the Washington Regional Office of the Division of Water Quality
(DWQ) inspected the Sugar Creek South Condominiums development located at 7200 S. Croatan Highway in
Nags Head, NC, to determine compliance with Stormwater Management Permit Number SW7060929, which
was issued on December 14, 2006. The DWO site inspection revealed that the project is in not in compliance
with the approved permit.
A breach in the dike of the infiltration basin was observed. The breach was located next to the swimming pool
beneath the wooden deck. This breach needs to be immediately repaired. Condition 1I. 2. of the permit requires
that the facilities be properly maintained and operated at all times. And condition 11 3. D. requires the
i mmed iate. repair of eroded areas.
Please be advised that you are required to comply with the terms, conditions and limitations of your
Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North
Carolina General Statute 143-214.7, including operation and maintenance of your permitted stormwater
system. Please advise as soon as the repairs have been completed but no later than 30 days from today. A
follow up inspection will be conducted in the near future.
Please be advised that violations of your Stormwater Management Permit may be subject to the assessment of
civil penalties of up to $25,000 per day per violation. If you have any questions please contact me at the
