Everything looks good except for a few small issues: Please correct the following: - Original Comment 7, Wetland Delineation —The provided wetland determination is acceptable, however we require that a note be placed in the main set of plans (Typically on the tile sheet, a note sheet, or existing site conditions sheet). The note should read something like the following: o "No wetlands were observed on the property. Environmental investigation was conducted by Scott Mitchell, PE, LSS of Mitchell Environmental, PA on August 5, 2020" or something to that extent. Feel free to re-word/modify as needed. - Original Comment 15, Forebav entrance/exit depth — The "Entrance" of the forebay is the distance from the permanent pool surface elevation to the bottom of the forebay near the inlet pipe and the "Exit" is the distance from the permanent pool surface elevation to the bottom of the forebay near the weir into the main pool. The contours clearly show that the entrance is deeper than the exit, however it is not as clear on the cross -sectional view since only one forebay bottom elevation is shown. Please label the forebay entrance depth and the forebay exit depth on the pond cross-section. NOTE: The minimum six-inch sediment storage depth must be maintained over both the forebay entrance and exit. Based on the forebay sediment storage top elevation of 305 ft, the forebay exit elevation must be at or below 304.5 ft and the forebay entrance elevation must be below the forebay exit elevation (Based on the contours, the forebay entrance appears to be at elevation 304 and the exit appears to be at elevation 304.5). - Original Comment 17-b-ii-3, Line 19 of Drainage Area Column 1— Based on the provided calculations, it appears as though the Simple Method was used to determine the design volume of the proposed Wet Pond. If this is correct, please change this item to "Simple". - Original Comment 17-c-v, Line 31— Since Equation 3 was used to determine the average depth of the proposed Wet Pond, please include the width of the submerged portion of the vegetated shelf (Based on the calculations/plans, this value appears to be 3 ft). - Original Comment 17-c-viii, Line 44—The depth of the forebay at the exit is the distance from the permanent pool (Elevation 308) to the forebay exit elevation (Appears to be at elevation 304.5 per the contours), expressed in inches. - New Comments: o General —The on -site drainage areas that bypass the proposed Wet Pond do not need to be included/accounted for in Section IV, 9, Section IV, 10, or the Drainage Areas Sheet of the Supplement- EZ Form (It was appreciated though as it clarified the on -site BUA allocation). Your comments and corresponding responses are summarized below: Division of Energy, Mineral and Land Resources 1. SUBMITTAL REQUIREMENTS Only complete application packages will be accepted and reviewed by the Division of Energy, Mineral and Land Resources (DEMLR). DEED RESTRICTIONS AND PROTECTIVE COVENANTS For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective covenants are required to be recorded prior to the sale of any lot. If lot sizes vary significantly or the proposed BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be provided as an attachment to the completed and notarized deed restriction form. In the instances where the applicant is different than the property owner, it is the responsibility of the property owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring that the deed restrictions are recorded. By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and protective covenants for this project, if required, shall include all the items required in the permit and listed on the forms available on the website, that the covenants will be binding on all parties and persons claiming under them, that they will run with the land, that the required covenants cannot be changed or deleted without concurrence from the NC DEMLR, and that they will be recorded prior to the sale of any lot.
