In response to comments provided on August 12, 2020 and further direction on August 26, Hazen and
Sawyer offers the following responses to comments on behalf of the City of Durham.
Planning Christina L. Goggin
1. The Falls Lake Nutrient Strategy requires stormwater systems to be designed to control and treat
at a minimum the runoff generated from all surfaces in the project area by one inch of rainfall
[15A NCAC 02B .0277(4)(e)] . The definition of runoff treatment requires this runoff to be
treated in a primary SCM [15A NCAC 02H .1002(43)]. There is no provision in the Falls Lake
Rules that allows for low density developments.
Response: Comment was disregarded my reviewer (email communication, 812612020)
2. Please explain why the nutrient reduction portion of the review was submitted to the Department
but the TSS and peak flow requirements were submitted to the local review program. The Falls
Lake Rules include TSS and peak flow requirements.
Response: After coordination with the reviewer, the peak f ow requirements and information
on low density development option has been included herein.
3. Please complete the Applicant's Certification section of the SWU-101 Application Form.
Response: Updated copy of the SWU-101 Application has been included in this submittal.
4. Please submit a Supplement EZ form for the site. The Supplement EZ form is required for all
developments, including low density. The Supplement EZ form can be found on the Stormwater
Design Manual website.
Response: Signed Supplemental EZ form has been included in this submittal.

5. Please submit an Operation and Maintenance Plan and Agreement. The O&M EZ form has
options for both high and low density. The O&M EZ form can be found on the Stormwater
Design Manual website.
Response: The O&MEZform has been included in this resubmittal. Please note this
form will be signed prior to approval of the plans, but Hazen would like to confirm that
the plans are acceptable prior to getting signatures from the City.
6. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:

Response: Plan sheets have not been revised from these comments. Hard copies will be
submitted to the NC DEQ office.
