I received a Permit Information Update Form and a Renewal Application with a $505.00 check from Mr. Venters (#2809), accepted or. December 11, 2018. I also received a Penrnit Information Update Form and a Renewal Application with a separate $505.00 check (#1886) from Wilmington Auto Group Properties, Mr. Jon Vincent on January 31, 2019. Since the first renewal application and fee from Mr. Venters has already been accepted and the check has been deposited, the second renewal application is unnecessary. The permit will be renewed and updated today, and it will be effective until 8 years from the February 26, 2018 expiration date, which will be February 26, 2026. The SW8 000647 state stormwater permit (electronic copy attached) authorizes the development of a commercial subdivision with 3 lots, and a common stormwater control measure to treat the runoff from the assigned built -upon areas on those lots. Each lot also has its own individual permit which authorizes the individual lot owner to build a limited amount of built -upon area and to utilize the pond to treat the runoff. The SW8 000647 permit is referred to as the Master permit because it contains the design criteria for the pond and limits the built -upon area on each lot. The Master permit has expired and has not been renewed. The individual lot permits do not expire. Please have the Master permittee (Carmar Park Association) complete, sign and submit the permit renewal application (download from our website), the $505.00 application fee, and any required documentation as listed on the application form. I am unable to process the pending transfer of one of the individual lot permits to its new owner until the Master permit is renewed and has been inspected for compliance. I've been all through the stormwater permit file, and I see no paperwork regarding a change of mailing address for this permit. A change of registered agent form has been filed with the NCSOS, but we are not affiliated with the NCSOS. The stormwater permit requires notification to the permitting authority, i.e., the Division of Energy, Mineral and Land Resources. Please note that a management company cannot be the permit holder. We are happy to put the management company into our database as a permit "contact", but not as a permit owner. That privilege remains with the land owner or with the entity that is leasing the property, or developing the property or in the process of purchasing the property. This means that we could not accept your signature on the renewal application — we must have the signature of the current permittee. Per the New Hanover County Tax Records, Carmar Park Association is the current owner of the pond tract, so they get to hold the permit until such time as the pond tract is conveyed to a new owner. Then, Carmar Park Association should apply to the Division to transfer the permit to that new owner. Linda Lewis, E.I. Vincent, President 1508 Military Cutoff Road, Suite 302 Wilmington, NC 28403 Subject: Request for Permit Renewal and Notice of Inspection - Compliant Carmar Park Commercial Subdivision State Stormwater Management Permit No. SW8 000647 New Hanover County Dear Mr. Vincent: Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are modified. Please note that this letter references DEMLR as the Division responsible for compliance with the permit. On October 18, 2018, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR) inspected the subject project, located at 5810 Market Street in Wilmington, New Hanover County to determine the status of compliance with the State Stormwater Management Permit Number SW8 000647 which was transferred and reissued to you on July 27, 2012. One of the lots in this commercial subdivision under SW8 120617, is changing ownership which required an inspection of the stormwater facilities which treat the runoff. DEMLR file review and site inspection revealed that the subject pond is mostly in compliance with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. The only real compliance issue is that the permit has expired and has not been renewed. In order to approve the transfer of the SW8 120617 permit to its new owner, the master permit must be renewed. Please submit a permit renewal application and fee prior to November 19, 2018. Potential maintenance issues include a check of the forebay for accumulated sediment and the need to extend the trash rack over the face of the open weir in the outlet structure. If ownership of the Carmar Park project will change in the future, please submit a completed permit transfer application form and the supporting documentation to the Division at least 60 days prior to the sale. Please be advised that until you receive approval from the Division to transfer this Master permit to a new owner, you are required to comply with the terms, conditions and limitations of the Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, to include renewing the permit, and operating and maintaining the permitted stormwater system. Failure to provide the requested renewal application by November 19, 2018, is considered a violation of the permit. If the requested information is not submitted to this office by the due date, then DEMLR staff will re- inspect the site and may issue a Notice of Violation. Please also note that any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the stormwater rules is subject to enforcement action as set forth in NCGS 143 Article 21, including the assessment of civil penalties of up to $25,000 per day. s.
