The Site encompasses approximately 310.8 acres and is located at 2090 Alicia Lane in Midland, North Carolina, within Cabarrus County (see Figure 1: Vicinity Map). The Site is bound in all directions by a mix of forested lands, single family homes and agricultural lands. The Site can be accessed from Wallace Road, Alicia Lane, and Pope Road. Two (2) single family homes are located north of Alicia Lane within the central section of the Site. There is a single family home and an agriculture operation center located south of Wallace Road within the central section of the Site. Located within the northern section of the Site at the terminus of Pope Road is a railroad easement that is generally aligned in a west to east direction. Muddy Creek is located in the northern section of the Site south of the railroad and is generally aligned in a west to east direction. The remainder of the Site consists primarily of forested and agricultural lands. The Site is located within the Yadkin -Pee Dee River watershed (HUC 03040105). The northern section of the Site is drained by Muddy Creek, which has a NC Division of Water Resources Stream (DWR) Index Number of 13-17-16 and a Stream Classification of C (DEQ 2018). The southern section of the Site is drained by Clear Creek, which has a DWR Index Number of 13- 17-17 and a Stream Classification of C (DEQ 2018). Ultimately, the Site drains to the Pee Dee River. The Site does not contain a 100-year floodplain (see Figure 3: Environmental Inventory Map). The Site was evaluated for potential jurisdictional Waters of the U.S. based upon the methodology outlined in the 1987 U.S. Army Corps of Engineers (USACE) Wetland Delineation Manual; the Regional Supplement to the USACE Wetland Delineation Manual: Eastern Mountains and Piedmont Region (Version 2.0) and subsequently issued USACE regulatory guidance regarding the identification of jurisdictional stream channels through the recognition of field indicators of an ordinary high-water mark within drainage features (Environmental Laboratory, 1987; USACE, 2012; USACE 2005). Using these methodologies, preliminary wetland and stream assessment mapping was produced and is included along with the attached Site description and discussion for your review. Flagging or marking of the wetland and stream boundaries was not conducted in the field during this effort. During our assessment, approximately 0.03 acres of palustrine emergent (PEM) wetlands, and 0.49 acres of palustrine open water (POW) were identified onsite. In addition, 4,451 linear feet of perennial stream channels (R3), 2,018 linear feet of intermittent stream channels (R4) and 10,030 linear feet of ephemeral stream channels (R6) were identified onsite. Although ephemeral channels are not considered jurisdictional by the USACE, these features may have the potential to be reclassified as intermittent by the USACE during the course of their review for the jurisdictional determination. Also, area land use changes could result in an increased flow to these features which would also potentially change their classification. Therefore, ephemeral channels were assessed strictly for planning purposes. The Site is located within the Yadkin -Pee Dee River watershed (HUC 03040105). The northern section of the Site is drained by Muddy Creek, while the southern section of the Site is drained by Clear Creek (see Figure 2: Hydrologic Unit Code Map). Muddy Creek has a NC Division of Water Resources Stream (DWR) Index Number of 13-17-16 and a Stream Classification of C (DEQ 2018). Clear Creek has a DWR Index Number of 13-17-17 and a Stream Classification of C (DEQ 2018). The Site is located in the Piedmont Physiographic Province. The Site does not contain a 100-year floodplain (see Figure 3: Environmental Inventory Map). 3.2 Site Description The Site is bound in all directions by a mix of forested lands, single family homes and agricultural lands. The Site can be accessed from Wallace Road, Alicia Lane, and Pope Road. Two (2) single family homes are located north of Alicia Lane, within the central section of the Site. There is a single-family home and an agriculture operation center located south of Wallace Road within the central section of the Site. Located within the northern section of the Site at the terminus of Pope Road, is a railroad easement that is generally aligned in a west to east direction. Muddy Creek is located in the northern section of the Site south of the railroad and is generally aligned in a west to east direction. Overhead electrical utility easements are located along Alicia Lane and Wallace Road. There is an additional overhead electrical utility easement located along the extreme southern boundary of the Site that is aligned in a west to east direction. The remainder of the Site consists primarily of forested and agricultural lands. 4.0 METHODS OF EVALUATION 4.1 Preliminary Offsite Investigation/Data Review A review of publicly available resources was performed prior to the onsite field investigation to determine the potential for jurisdictional areas, and if present, the extent of these areas located at the Site. These mapping resources generally included, but were not limited to, U.S. Geological Survey (USGS) topographic maps, QL2 Lidar data, U.S. Fish and Wildlife's National Wetland Inventory mapping, Natural Resource Conservation Service Soil Survey mapping, as well as recent and historic aerial photography. Preliminary Jurisdictional Waters of the U.S. Evaluation Package Timmons Group Speedway Solar September 2018 Page 2 4.2 Field Investigation The Site was evaluated for potential jurisdictional Waters of the U.S. based upon the methodology outlined in the 1987 U.S. Army Corps of Engineers Wetland Delineation Manual; the Regional Supplement to the USACE Wetland Delineation Manual: Eastern Mountains and Piedmont Region (Version 2.0); and subsequently issued USACE regulatory guidance regarding the identification of jurisdictional stream channels through the recognition of field indicators of an ordinary high-water mark within drainage features (Environmental Laboratory, 1987; USACE, 2012; USACE 2005). The wetland boundary was located as accurately as possible using sub - meter GPS equipment. The wetlands and streams were not flagged or marked in the field. 5.0 PRELIMINARY FINDINGS 5.1 Preliminary Offsite Investigation/Data Review Findings A review of the United States Geologic Survey (USGS) topographic map depicts land use at the Site to include residential, forested and agricultural areas. A total of four (4) blue line streams are shown on the Site. Located in the northern section is Muddy Creek and a blue line stream that drains into it. Located in the southern section are two (2) blue line streams that drain south towards Clear Creek. One (1) pond is located in the northern section that discharges towards Muddy Creek. Two (2) ponds are located in the southern section that discharges towards Clear Creek. Topography at the Site is primarily characterized as gently rolling and relatively flat. Elevations at the Site range from 580 feet above mean sea level (MSL) along the ridgelines to 520 feet above MSL, within Muddy Creek. Similar to the USGS topographic mapping, the U.S. Fish and Wildlife National Wetland Inventory (NWI) shows wetlands, ponds, and streams associated with the main drainages/stream channels on the Site (USFWS, accessed 2018). The National Hydrography Dataset (NHD) depicts the same four (4) stream systems shown on the USGS. Mapped NWI and NHD features present within the Site are depicted on Figure 3: Environmental Inventory Map. The U.S. Department of Agriculture Natural Resources Conversation Service (USDA -MRCS) Web Soil Survey(http://websoilsurvey.nres.usda.gov/app/) shows the soils mapped for the Site primarily as silt and sandy Ioams. The Site is underlain by five (5) soil series. Onsite soils include: • Badin channery silt loam at 2 to 8 percent slopes (BaB) • Chewacla sandy loam at 0 to 2 percent slopes (ChA) • Goldston very channery silt loam at 4 to 15 percent slopes (GoC) • Kirksey silt loam at 1 to 6 percent slopes (KkB) • Misenheimer channery silt loam at 0 to 4 percent slopes (MsA) Goldston very channery silt loam and Kirksey silt loam are the dominant soil series at the Site and comprise approximately 70% of the overall soils. Chewacla sandy loam is classified as somewhat poorly drained. All other soils at the Site are classified as well -drained or moderately well -drained (USDA-NRCS, 2007). Chewacla sandy loam is listed as partially hydric for Cabarrus County (USDA-NRCS, 2010). Preliminary Jurisdictional Waters of the U.S. Evaluation Package Timmons Group Speedway Solar September 2018 Page 3 The last reported rainfall event preceding the field assessment was on August 22, 2018 (0.12 inches). A total of 1.6 inches of precipitation was recorded between August 1st to August 22nd 2018. The Palmer Drought Severity Index shows Cabarrus County in near normal precipitation conditions for the week ending on August 31, 2018 (USDOC-NOAA, 2018). 5.2 Jurisdictional Area Summary The onsite investigations evaluated the presence of wetlands depicted on the NWI mapping and determined the wetland systems to be more extensive than mapped. The dominant vegetation within the tree and shrub -scrub stratum of the potential jurisdictional areas onsite was American sycamore (Platanus occidentalis), green ash (Fraxinus pennsylvanica), highbush blueberry (Vaccinium corymbosum), and red maple (Acer rubrum). The herbaceous and vine layers were generally dominated by netted chain fern (Woodwardia areolata), Japanese stiltgrass (Microstegium vimineum), false nettle (Boehmeria cylindrica), jewelweed (Impatiens capensis), poison ivy (Toxicodendron radicans), trumpet creeper (Campsis radicans), and Carolina jasmine (Gelsemium sempervirens). Soils within the wetland areas exhibited medium to low chroma matrix colors and concentrations that are characteristic of reducing anaerobic conditions associated with the formation of hydric soils. The soils generally met the F3 Depleted Matrix hydric soil indicator. Textures within the areas include silt loam or similar soils with inclusions of clay deposits. Primary hydrology indicators observed within the potential jurisdictional areas included oxidized root channels, drift deposits, and water -stained leaves. In addition, secondary hydrology indicators of drainage patterns and geomorphic position were also observed. Muddy Creek is located in the northern section of the Site south of the railroad and is generally aligned in a west to east direction. Although strong geomorphological characteristics were exhibited within Muddy Creek that are indicative of a perennial feature, water was not present within the stream bed at the time of the field assessment. Muddy Creek varied between 10 to 20 feet wide and exhibited, prominently, the following geomorphological characteristics: channel bed and bank continuity, sinuosity, stream substrate particle size, depositional benches, and natural valley. There were a few pooled areas primarily around beaver dam structures. This condition was unusual in that, according to the North Carolina Drought Management Advisory Council, Cabarrus County is currently not experiencing drought conditions (NCDMAC, 2018). Approximately four (4) beaver dams were observed within the central section of Muddy Creek. The presence of several beaver dams on Site is indicative of an active beaver population within the vicinity of the Site which could be severely altering the hydrology of Muddy Creek and resulting in a lowered water table. A summary of the potential jurisdictional areas identified onsite is provided below in Table 1: Potential Jurisdictional Area Summary. The location and size of potential jurisdictional Waters of the U.S. are shown on Figure 6A: Preliminary Wetlands and Stream Assessment Map: Aerial and Figure 613: Preliminary Wetlands and Streams Assessment Map: USGS. Ephemeral streams were included on mapping for planning purposes as the exact location of jurisdictional breaks along these drainage features will need to be determined during the confirmation process by the U.S. Army Corps of Engineers. As shown on Figure 3: Environmental Inventory Map, the majority of the upland areas located within the Site are within the agricultural fields and within the Dry-Mesic Oak -Hickory Forests along the upper slopes and ridgetops (Schafale and Weakley, 1990). Dominant species commonly observed by strata include red oak (Quercus rubra), white oak (Quercus albs), hickory (Carya spp.), sourwood (Oxydendrum arboreum), red maple (Acer rubrum), loblolly pine (Pinus taeda) and tulip poplar (Liriodendron tulipifera) in the canopy and subcanopy, with Chinese privet (Ligustrum sinense), American hornbeam (Carpinus caroliniana), red bud (Cercis canadensis), and paw paw (Asimina triloba) in the shrub layer. The herbaceous and vine layers were sparse in the upland areas. Primary species observed included Christmas fern (Polystichum acrostichoides), ebony spleenwort (Asplenium platyneuron), poison ivy (Toxicodendron radicans), and greenbrier (Smilax rotundifolia). Upland soils were typically red (2.5YR 5/6) within the upper 1 to 10 inches and underlain by reddish brown (2.5YR 5/4) soils below 10 inches. Soil textures primarily include silt loam. Mapped soils present within the Site are depicted on Figure 3: Environmental Inventory Map. Indicators of wetland hydrology were largely absent in upland areas. Hydric soils and/or a dominance of hydrophytic vegetation was not observed within these areas and were therefore, not considered to be jurisdictional features under Sections 404 and 401 of the Clean Water Act regulations. The location and size of upland areas onsite are shown on Figures 6A and 613: Preliminary Wetlands and Streams Assessment Maps. Preliminary Jurisdictional Waters of the U.S. Evaluation Package Timmons Group Speedway Solar September 2018 Page 5 6.0 CONCLUSIONS The preliminary jurisdictional Waters of the U.S. evaluation identified the presence and approximate extent of wetlands and streams at the Site. Four (4) farm ponds, characterized as open water, were identified within the Site. One (1) palustrine emergent wetland was found onsite associated with a farm pond feature located north of Wallace Road. Unnamed tributaries located at the Site vary between 2 to 3 feet wide, while Muddy Creek varies between 10 to 20 feet wide. Wetlands present onsite are characterized as emergent wetland systems. These areas are depicted on the Preliminary Wetland and Streams Assessment Maps included as Figures 6A and 6B. These findings represent Timmons Group's professional opinion regarding the extent of jurisdictional wetlands and stream channels onsite. The mapped areas are approximate in location, shape, and size, and are subject to change pending a wetland delineation and jurisdictional determination by the U.S. Army Corps of Engineers.
