Based on a file review the site is currently in compliance with the terms and conditions of the current state stormwater permit based on the following: • On May 01, 2009, Centex Homes verbally requested a site inspection for the transfer of this permit to the HOA. As indicated in the May 4, 2009 Inspection Letter addressed to Ken Balough, the Division President, the project was in compliance with the terms and conditions of the permit. • On September 14, 2011, Centex Homes requested an inspection, via email, for the transfer of this permit. In response, DWQ staff met with Craig Hobart onsite on September 21, 2011 and November 22, 2011 and inspected the site. On both occasions the project was again considered compliant with the terms and conditions of the permit. • On December 19, 2011, this office received an incomplete Name / Ownership Change Form submitted by Centex. The Meadowlands Property Owner's Association, Inc. did not respond to the permittee's transfer request and their signature was never received on the form. • On June 23, 2011, Session Law 2011-256 was passed by the Legislature. This law requires the Department of Environment and Natural Resources to transfer a stormwater permit from a Declarant of a Planned Community. Since this permit for Meadowlands at Savannah Lakes met the requirements of this law, Centex homes submitted another transfer request per this session law on, January 5, 2012. State Stormwater Management Permit # SW8 051203 • On February 7, 2012, the Meadowlands Property Owner's Association, Inc. submitted a series of questions concerning the transfer and responsibilities of the POA and Centex Homes. These questions were addressed in an email, to Don Heaton, on February 9, 2012. • On February 15, 2012, DWQ received an inspection report from Bridgette Flora with County of Brunswick. In response to this letter DWQ has determined the following: 1. That the inspection report represents recommendations to improve the system; however these recommendations are not requirements under the state stormwater permit or stormwater rules. Therefore these recommendations do not put the state permit out of compliance. 2. When Mathew Raines requested the original transfer of the permit on May 1, 2009, the system was in compliance and ready for transfer. Subsequent inspections revealed that the stormwater system approved by the state is still in compliance with the state permit; therefore it can be transferred to the HOA. On April 25, 2012, DWQ received a letter from Curt Johnson requesting a follow-up response to an email from this office issued on April 16, 2012 and a meeting request. At this time, the Division has determined that the email response to Don Heaton on February 9, 2012 adequately addressed all transfer information for this permit. o On May 25, 2012 a site inspection was conducted for the pending January 15, 2012 permit transfer request. This final inspection again found the site in compliance. On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval issued by the Division of Water Quality under Article 21 of Chapter 143 of the General Statutes, which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years. The Division is hereby notifying you that permit SW8 051203 has been transferred on May 31, 2012, and shall be effective until November 7, 2020, which includes the extensions. For your records, please find enclosed a copy of the updated page 2 of the previously issued permit, a copy of the inspection report, and a copy of the Name/Ownership Change form submitted on January 5, 2012. Please attach this cover letter and updated page 2 to your high density permit originally issued on March 8, 2006 and as modified thereafter. This permit is subject to the conditions and limitations as specified in the previously issued permit. Please pay special attention to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s), recordation of deed restrictions, procedures for changes of ownership, transferring the permit, and renewing the permit. Failure to establish an adequate system for operation and maintenance of the stormwater management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result in future compliance problems. 2 State Stormwater Management Permit # SW8 051203 If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of this permit. This permit shall be effective from the date of issuance until November 7, 2016 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.5 on page 3 of this permit. The subdivision is permitted for 92, 82, and 100 lots for Phases 1, 2, and 3, respectively, each allowed 4,000 square feet of built -upon area. There is no allotment for future built -upon area at the site. 3. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. Because it is highly unlikely that all of the community's concrete components will fail a^d require replacement in the period of the study, we have programmed funds for the replacement of 60% of the inventory and spread those funds over a 60-year timeframe to reflect the incremental nature of this work. The Association is responsible for the operation of the community's lights at the pool, club house and gazebo area. The lighting system was not on at the time of our site visit. We understand that the lighting sy.-terr is in good operating condition. Entrance Monuments. Brick masonry walls have been erected as entrance monuments to the community. Because the brickwork has a very long life expectancy, we have excluded replacement of these walls. We have, however, included funding for the periodic tuckpointing of mortar joints as exposure to weather over an extended period of time will wash lime out of the mortar and weaken the joint. Periodic tuckpointing of these joints and replacement of damaged brick is required to extend the life of the wall. Unless the wall is damaged by settlement, this work is typically not required until the wall is approximately 35-40 years old. At that point we expect that approximately 10 percent of the surface area will require repair and that an additional 10 percent will require repair every 10 years thereafter. Storm Water Pond. The community is served by seven storm water ponds that have an approximate total surface area of 11,991 sq yrds. The outlet pipes are eroding along the outside of the pipes toward the canal they empty into. This can lead to failure of the earthen dam. The ponds to include the discharge pipes and earthen dams should be routinely inspected by a qualified expert in storm water ponds and appropriate remedial actions taken. These ponds will accumulate silt and over time, lose their Miller - Dodson Associates, Inc. Accordingly, the ponds will require periodic dredging. Estimates of cost and the frequency of dredging the ponds are a function of many variables, including the volume of the pond, the siltation rate, the nature of the material being removed, the method of removal, and the haul distance to a site that will accept the spoil material. Most of this information is unknown and must be assumed for the purpose of Reserve Study planning. The rate of siltation and the cost of periodically dredging the ponds to remove this material are very speculative and will vary greatly with local conditions. As a rule of thumb, dredging should be accomplished when approximately one third of the volume of the pond has been filled with silt. In the absence of accurate information about the original depth of the pond and the local siltation rate, we have assumed that it will be necessary to remove one cubic yard of material over one third of the pond area every 20 years. We have assumed that the material being removed is free of heavy metals and hydrocarbons, and that it will be accepted as fill at a local landfill. The cost to remove, haul and dispose of the material is estimated at $50 to 79/per cubic yard. A more accurate prediction will require a hydrologic analysis and testing of the silt for contaminants, which is beyond the scope of our study. Because of the significance of the cost of this work in establishing the correct reserve contribution, it is recommended that the Association undertake studies to refine the information and replace the assumptions we have had to make with more factual information as a basis for the estimates. We recommend the following: • Periodically remove accumulated debris and vegetation growing in the ponds. • Survey the ponds to establish the current profile of the bottom. After five years of operation, have the pond re -surveyed to establish new depths to determine the local siltation rate. This will establish the frequency required for periodic dredging. • Periodically sample and test for contaminants. • Consult with local contractors to determine the cost of removing and disposing of the spoil once its nature is known. Listed below are a few that I came up with: 1) Wastewater Permit - in April of 2011 Centex inquired about turning over their permits to the POA. At that time Diehl was directed to tell Centex to turn them over to MGC. We need to know the current status of all the wastewater permits for our community. Who currently has control or ownership of them? 2) Property Transfers that are Dart of Stormwater System - Both Centex and MGC deeded property to the POA that is part of the Meadowlands stormwater system. Centex deeded six ponds and MGC deeded a number of drainage ditches, easements, and the Shingletree Canal. Even Jim Cranford admitted that 'Property that is part of the stormwater system can not be deeded to the Association until all phases of the development are complete, if at all.' We need to find out what the State and or County laws are concerning this issue. We may have to get legal advice on this issue. 3) Stormwater Maintenance ProiectsProiects/Responsibili�. The Grounds & Facilities Committee has identified several stomwater related problems that need attention before they get worse and cause additional problems. There are times that email just falls short as the best method of communication and does not allow for interaction and follow up thoughts and questions. As requested by David Cox, here are our follow up questions and issues concerning the permits and storm water system in our development: Current Issues with the Storm Water System — Documentation of these issues was mailed separately to you on 2/14/12. 1) There are erosion issues around the outlet pipes on three of the ponds (ponds #1, #3, & # 5). There are also erosion issues, sink holes, around several of the drainage grates set between property lines that are part of the system covered by Phase 1 & 2 of permit SW8051203. These were all identified prior to the latest compliance inspection on 11122/11. 2) There are erosion issues in several areas of the development covered by permit SW8970631. Questions Concerning Compliance Inspections A Compliance Inspection for permit SW8051203 was completed on 11/22/11. The Report states it was for Phase 1. 2, & 3. The storm water system for Phase 3 has not been completed. 1) How can an inspection be completed for phase 3 if the storm water system has not been completed for this phase? 2) The Inspection report appears to show only Drain Areas for 1, 8A, & 8B. Drain areas for 2-6 are not shown. Can you explain this? 3) What would be considered not compliant as part of an inspection? Would the erosion issues in the ponds and drainage grates we have documented be considered not compliant? Questions Concerninq the Transfer of Permit SW8051203 The Meadowlands POA does not believe this permit should be transferred to us from Centex (Pulte) for the following reasons: 1) There are still issues with the system covered by this permit that we believe are not compliant and should be fixed by the current permit holder prior to any transfer. 2) The permit was issued for Phases 1, 2, & 3 of the Centex development as stated on page 2 of the permit. 3) None of the 100 homes or the related ponds (#6, #8A, & #813) in Phase 3 allowed and covered by this permit, have been built. 4) There has been no compliance review or designer's certification ever completed for Phase 3. 5) Centex (Pulte) has deeded their rights to develop Phase 3 back to Meadowland Golf Club, Inc. on 4/15/09. 6) The Meadowlands POA has nothing to do with the Phase 3 development 7) The permit states on page 6 that "Any items not in compliance must be repaired or replaced to design condition prior to the transfer." 8) When the permit is eventually transferred, it should be transferred to Meadowlands Golf Course, Inc., the current developer of Phase 3 covered by this permit. Other Issues 1) The answer to our previous question #6, that Meadowlands Golf has its own permit SW8970631 infers that this permit will cover Phase 3 of permit SW8051203. SW8970631 was a low density permit issued for the original 135 lots in our development. Permit SW8051203 is a high density permit issued for 274 units in Phase 1, 2, & 3 to be developed by Centex. Please explain how Meadowlands Golf can use their low density permit to build the high density portion of Phase 3 currently covered by SW8050123. 2) Can we get a copy of the Compliance Inspection Report that was done on 5/01/09? 3) Where can we find the Operations and Maintenance Agreement referred to in the answer to question #10? 4) Can we get a copy of the unsigned transfer documents you received from Centex in 2009 referred to in your answer to question #9? 5) The SW8051203 permit expires on 11/7/2016. No, the permit was issued for the tenants of the residential section's use. The Golf Course has its own permit which is SW8 970631. The homeowners benefit from the use of this system. It was required so the subdivision could be constructed and as each individual purchased their residence, they ultimately bought into the system 7) Should permit SW8051203 remain in the Declarant's (developers) name until the entire development is completed? No, he is only required to keep the permit until 50% percent of the total lots are sold to individuals. 8) Who should be the pennit holder of SW8970631? The storm water system is basically completed but there are still 58 vacant lots in this part of the development. This is not the permit being transferred. It is still issued to the golf course. 9) Is the current permit holder responsible for maintenance of the ponds, sweles, ditches, steel grates, culverts, pipes and other parts of the storm water system? Centex is but, the HOA has not accepted the permit and I have already deemed it compliant twice in three years, for the purpose of transfer. This means that Centex met the requirement when all documents were approved in 2009. At that point, it was my understanding that the HOA refused back then, based on the unsigned transfer documents Centex sent me. The whole purpose of the 2011 inspection was to proceed with the new session law 2011-256 transfer procedure. 10) What type of maintenance is required? How often is it required? The requirements are described in the Operations and Maintenance Agreement which is part of the permit. 11) Do you have any records of maintenance being performed? Whoever pays to maintain the ponds should have them. Somebody mows these ponds on a regular basis, keeps your streets clean and all the yards are established and not eroding into the streets. I only request when a pond is in a state of noncompliance and these were not at the time of inspection. 12) There was a Compliance Inspection Report for permit SW8051203 completed on 1112212011. a. Why was this inspection done? Was it requested by Centex Homes? f Yes, for permit transfer. b. What parts of the storm water system were actually inspected? It appears only one pond was inspected. All the ponds were inspected twice. The inspection represents all the BMP's within the permit. c. Are other components of the system inspected such as the catch basins, pipes, drains, and sweles? The consultant's engineer certifies that the system was installed per the plan. We inspect for operations and maintenance of the system. d. Could you explain the findings, if any, of this report? Nothing really to describe other than that the permittee has met the permit requirements. e. What does this report mean to the permit holder? DWQ will honor his transfer request. f. We have identified problems with the system that were not noted on this inspection. Several of these were identified by the Brunswick County during an inspection conducted by them on January 19, 2012 (attached). She addressed the letter to Meadowlands POA, Inc, about these concerns because the common areas are deeded to the POA. This office inspected in 2009 and again in 2011, at both inspections these potential problems were not an issue. According to the complaints, a Mr. William Wells at 702 Royal Fern Ct. in Savannah Lakes, has created an illicit discharge into the canal behind his house. I have witnessed the piped gutter drain. Permit condition requires that all collected runoff must discharge into the stormwater collection system. If this resident continues this action I will pursue fining the HOA for allowing this to continue to happen. Please be reminded that our fines are up to $25,000.00 a day per action. If the resident wants to disccnnect the pipe and allow the gutters to sheetflow to the canal behind his house then this office does not have a problem with that.
