We also have the responsibility to the public to safeguard these records and to carry out our day-to-day program obligations. Please read carefully the following guidelines signing the form: 1. Due to the large public demand for file access, we request that you call at least a day in advance to schedule an appointment to review the files. Appointments will be scheduled between 9:00am and 3:00pm. Viewing time ends at 4:45pm. Anyone arriving without an appointment may view the files to the extent that time and staff supervision is available. 2. You must specify files you want to review by facility name. The number of files that you may review at one time will be limited to five. 3. You may make copies of a file when the copier is not in use by the staff and if time permits. Cost per copy is $.05 cents. Payment may be made by check, money order, or cash at the reception desk. 4. FILES MUST BE KEPT IN ORDER YOU FOUND THEM. Files may not be taken from the office. To remove, alter, deface, mutilate, or destroy material in one of these files is a misdemeanor for which you can be fined up to $500.00. No briefcases, large totes, etc. are permitted in the file review area. S. The transfer application has a mailing address for the HOA as 114 N. 6th Street in Wilmington, but the NCSOS filing for the HOA has a mailing address of 3530 Lewis Loop Road in Bolivia. The address filed with the NCSOS must match the address listed on the transfer application and vice versa. You can do one of two things, whichever reflects the correct mailing address: 1. Have Mr. Emmart file the necessary paperwork with the NCSOS to change the HOA's mailing address to 114 N. 6th Street to match the transfer application; or, 2. Mark Hargrove, P.E., certified the project in 2015 based on an as -built survey that was prepared by a licensed surveyor. The as -built showed that the pond had been over -excavated to allow for the sediment to accumulate up to the permitted bottom elevation during construction. The drawing you provided to me was not sealed, and we have no way of knowing whether the data was properly collected or if the drawing accurately reflects the locations of the depths. Mark believes, and we concur, that any challenges from unlicensed individuals to what a reputable, licensed professional engineer and surveyor have prepared, carry no weight. The HOA is free to engage, at their expense, a licensed engineer and/or surveyor to conduct a depth survey. If there are any discrepancies found, the HOA is free to negotiate whatever settlement they feel is warranted with the permittee. In the meantime, the Division has no basis to hold this transfer any longer and we will draft the permit for transfer to the HOA based on our finding of compliance with the permit. I have asked Mark Hargrove to verify that the as -built depths from November 2016 will meet the required 4.5' average depth. The calculation of average depth depends on the design depths and elevations and areas shown on the pond details being provided as shown. If the bottom of the pond is not at elevation 16, then that deviation will affect the average depth calculation. I had an as -built done on the pond after it was modified in 2014 and the pond was actually dug a little deeper than required ..... I always get an as -built before I certify the ponds. I don't believe that document was prepared by a licensed surveyor and there are not enough spot shots to determine the average depth........ based on where the shots are shown they could have missed the deepest part of the pond which is in the middle. Someone would have to do a detailed as -built and get 4 times this amount of shots to accurately be able to do the calculations. Mark N. The following is a response to your comments dated June 9, 2016: 1. Add the permitted swale, catch basin and piping behind the newest phase of buildings to collect runoff and direct it into the pond. Response: The swales have been regraded behind each set of units and the existing catch basin was uncovered. When you inspected it, the drop inlet still had filter cloth across the inlet to prevent sediment from entering the drainage system and could not be seen. 2. Grade and vegetate the pond slope behind the newest phase of buildings. Response: The slopes of the pond have been regraded, seeded and excelsior matting has been installed on the newly graded areas. 3. Check the sediment level in the pond and remove as per the O&M agreement. Response: The sediment level was adequate and does not need to be removed at this time. 4. Remove the still -attached skimmer from the outlet structure and allow the 2.5" orifice to control the drawdown rate. Response: The site is still being inspected by New Hanover County and the skimmer cannot be removed until the County releases the site. 5. Reinstate the now -dissolved LLC or initiate transfer of the permit to the new owner or to the HOA.
