I, Michael W. Strader, Jr., P.E., as a duly registered Professional Engineer in the State of North
Carolina, having been authorized to observe the above referenced stormwater management
system, hereby state that the Colony Tire Addition stormwater management, collection and
conveyance has been completed in general conformance of the approved design plans.
It shall be acknowledged that the main permanent pool depth of the wet detention basin is very
close to the required sediment cleanout elevation as specified within the executed Wet
Detention Basin Operation and Maintenance Agreement. The Permittee shall be sure to
remove accumulated sediments and reestablish the berm separating the forebay:frorn the main
pond as well as all other maintenance items associated with the inspection activities specified in
the Wet Detention Basin Operation and Maintenance Agreement. It is also important to
acknowledge that the faircloth skimmer is still installed on the overflow structure as the wet
detention basin served as a sediment basin during construction. Once it has been verified that
the site is fully stabilized and DENR authorizes, the faircloth skimmer shall be removed and the
specified draw down pipe be installed per the basin overflow structure detail.

This letter is in response to the Notice of Inspection for Permit No. SW7111204 for the Colony Tire Addition
in Chowan County, where it was noted that the Designer's Certification for the project had not been received
by your office. As the General Contractor for this project, we submit the following plan of action on behalf
of the owner, Mr. Charles A. Creighton.
We have contacted the surveyor for the project, Paul Toti Land Surveying, as well as the Civil Engineer,
Quible & Associates. An as -built survey will be performed by the surveyor and sent to the Engineer for
review and certification.
As you are aware, we have experienced abnormally high amounts of rainfall recently causing the water level
of the retention pond to be elevated. We would like to allow the water levels to recede to near normal levels
before performing the survey. With this in mind, we plan to have the Designer's Certification delivered to
your office no later than May 20, 2015.
We trust that you will find our plan of action sufficient. If there are any questions or concerns, please do not

On behalf of Mr. Charles A. Creighton, Quible & Associates, PC hereby submit revised/updated
plans and documents per the DWQ Stormwater Review Letter for the Colony Tire Addition
Project dated 12/21/2011.
Please note that the attached plans and documents have been revised or updated in
accordance with the itemized comments in the review letter. A comment response dialog is
provided in the following section that outlines the Division's comments (in black) followed by
responses or actions taken (in blue).
Both the calculations and Wet Detention Supplement form list the permanent pool
elevation as 12.10 fmsl. Please revise the proposed permanent pool elevations from
11.5' to 12.1' shown on pond cross section details A -A & B-B, found on plan sheet 3 of
4.
The Permanent Pool Elevations on the pond cross sections on Sheet 3 of 4 have been
updated to reflect the permanent pool elevation of 12.1'.
2. The Surface Areas for the permanent pool elevation of 12.10 fmsl is given as 15,892 sf
on the supplement, however it is listed as 19,116 sf within the submitted calculations.
Please revise all areas and volumes as needed.
The permanent pool area in the supplement has been updated to reflect the orifice
drawdown elevation of 12.10 ft. Some minor modifications have been made to the pond
and the revised permanent pool area is 19,128 sf. This area is reflected in the
calculations and the wet detention basin supplement.
3. Please review and revise the calculated Average Pond Depth given on page 2 of the
Wet Detention Supplement form. The Calculation option 1 was chosen, however this
option yields and average pond depth of 2.0' not 3.0 as given. Consider using option #2
to determine the Average Pond Depth based on the surface areas and depths between
the top of the sediment storage area and permanent pool elevations. The minimal

average pond depth calculated must be at least 2.75' in order to round up to the nearest
half foot (0.5') to be able to use 3.0' on the SAIDA Table. Please revise the supplement
form, plans and calculations as needed.
The average pond depth calculation has been updated in the calculations and on the
supplement. To accommodate the calculated 3.0' minimum depth, the main pool of the
wet basin was iowerED 1.25'. The wet basin's calculated depth is 3.05' per the "Option
2" identified in the wet detention basin supplement.
4. The Overflow Swale Cross Section found at the top left corner of plan sheet 3 has an
overflow elevation of 13.5' with a rock depth of 12 inches below this point. It is assumed
that once water rises in the pond to elevation 12.5', water could start draining through
the rock at this point which is below the temporary pool elevation of 13.1'. This will not
allow the pond to drain down only through the 2.5 inch small diameter orifice as required
before reaching the Temporary Pool elevation of 13.1'. Please revise this detail in order
to make sure that the pond will only drain down through the small diameter orifice from
elevation 13.1' and lower.
A profile section of the overflow Swale has been provided on sheet 3 of the plans for
clarity. The bottom of the rock (riprap) will be placed below the temporary pool elevation
but will not draw down the pond. The overflow swale is to be excavated into the existing
grade and the rock shall be placed in an excavation 12" lower .than the invert of the
Swale. The rock will extend 8.0' from the pond. At that point the Swale lining shall
transition from rock to soil with vegetation. The soil abutting the rock downstream will
prevent the drawdown of the pond by seepage through the riprap.
5. Please do not forget to have any plans, calculations, supplements, narrative, etc.
revised, signed, sealed and dated as necessary to reflect all changes when re-
submitting.
Updated plans and supplement documents are attached with this letter.
The following items are included with this submittal:
1. Two Copies of the Updated Plan Set
2. One Copy of the Wet Detention Basin Supplement, and O&M Agreement
3. One Copy of the Revised Stormwater Narrative with Calculations.

This office received a Coastal Stormwater permit application and plans for the subject project on December 20, 2011,
A preliminary review of the project indicates that before a State Stormwater permit can be issued the following additional
information is needed.
Both the calculations and Wet Detention Supplement form list the permanent pool elevation as 12.10 fmsl. Please

application fee. If you need additional time to submit the required information, please mail or fax your request for
time extension to this office at the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any development
activity. Construction without a permit is a violation of 15A NCAC 2H.1000 and North Carolina General Statute 143-215.1
and may result in civil penalties of up to $10,000 per day.

At the request of Charles A. Creighton, Colony Tire Corporation, the purpose of this
correspondence is to provide a brief chronology of previous improvements to the two contiguous
parcels owned by Mr. Creighton.
is The original Town of Edenton building permit for the initial buildings and associated
parking improvements was issued prior to 1992/1993. The impervious area constructed
was approximately 22,500 square feet.
• The second building permit for another approximately 22,500 square feet building was C4� �1
obtained in or before 1998. The building was subsequently constructed. j Xlr(,/, r)'J" C"Jtz

• A third building permit was obtained for the construction of approximately. 7,000 square
feet of building and associated improvements. A depressed truck loading zone and i�'�' '�° " 4'°
associated parking and drive aisle improvements were also constructed. Additional ? 0 ws F b IA
asphalt millings were spread in areas to the rear of the newly constructed building. J 1
• Prior to obtaining a fourth building permit to construct a building just over 50,000 square
feet, Barry Hollowell, a District Manager representing Colony Tire Corporation, met at the
NCDENR Washington Regional Office as suggested by the Town's planning staff in
order to obtain stormwater management and other pertinent permit approvals. Mr.
Hollowell met with Pat McClain, Scott Vinson, and David May, representatives of
NCDENR. During the meeting Mr. Hollowell was informed that no permits were
necessary for the proposed improvements because of existing impervious surface areas.
Prior to issuing the building permit, Ms. Anne -Marie Knighton, Town of Edenton, received
the enclosed Fax Cover Sheet and associated Message from Pat McClain. The
Message states that no plan is required by NCDENR and that the project may proceed.
Ms. Knighton subsequently Issued the enclosed building permit.
Additional asphalt millings have been spread further to the rear of the parcel.
Please acknowledge that Holly Colombo, Edenton-Chowan Inspection Office, has informed Mr.
Creighton that they do not keep copies of building permits for anything issued prior to 2004. Ms.
Colombo did however provide the enclosed building permit, associated application and fax to Mr.
Creighton.
Mr. Creighton is taking the position that anything already constructed before, and as a result of,
the enclosed 2005 building permit has been constructed with NCDENR's knowledge and he has
performed due diligence to ensure adequate permits are in place. Mr. Creighton does
acknowledge that any asphalt millings placed after the fourth building permit issuance shall be
considered new impervious surface and proposed to capture stormwater runoff from those new
impervious surfaces accordingly. We therefore respectfully request that the project as proposed
be accepted into the NCDENR Express Permit Program as soon as feasible. The Owner will
subsequently demonstrate adequate stormwater management control of all new impervious
surfaces in accordance with State Regulations.

IV, DEED RESTRICTIONS AND PRUMC IVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table

I. The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without the consent of the State.
2. No more than square feet of any lot shah be covered by structures or impervious materials.

decking or the water surface of swimming pools.
' 3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modiikation prior to
construction.
5. All permitted runoff from ougw-r-ols or future development shall be directed into the permitted stonmwarer control
system. These connections to the stormwater'control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.
