Dear Pastor Tankard:
The Washington Regional Office received a complete Stormwater Management Permit Application for
the second modification of Harvest Church on February 17, 2009. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater
Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW7060108MOD
dated March 4, 2009, for the construction of the subject project. The permit issued for this project on
April 23, 2008 is hereby rescinded and is replaced by this permit.
This permit shall be effective from the date of issuance until March 21, 2016, and shall be subject to
the conditions and limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right
to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150B of the
North Carolina General Statutes, and filed with the Office of Administrative Hearings, 6714 Mai!
Service Center, Raleigh, NC 27699-6714. Unless such demands are made this permit shall be final
and binding.

Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Water Quality and considered a
part of this permit.
This permit shall be effective from the date of issuance until March 21, 2016, and shall be
subject to the following specified conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff
as described in Section 1.6 on page 3 of this permit. The wet detention basin has been
designed to handle the runoff from 98,650 square feet of impervious area within the
3.07 acre drainage area of the pond.
3. The tract will be limited to 135,922 square feet of total built -upon area over the
entire13.35 acre site (24% impervious), per the application and approved plans.
4. All stormwater collection and treatment systems must be located in either dedicated
common areas or recorded easements. The final plats for the project will be recorded
showing all such required easements, in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of the wet
detention basin must be directed into the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping.
g. Access to the outlet structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DWQ. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
5. Decorative spray fountains will not be allowed in the stormwater treatment system.
6. The facilities shall be constructed as shown on the approved plans. This permit shall
become voidable unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting
data.
7. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification, A modification may be required for
those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility.
9. Access to the stormwater facilities shall be maintained via appropriate easements at
all times.
10. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the
drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area.
The project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted future
areas shown on the approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by the
Permittee at all times.
13. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies
of revised plans and certification in writing to the Director that the changes have been
made.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director. In
the event of a change of ownership, or a name change, the permittee must submit a
formal permit transfer request to the Division of Water Quality, accompanied by a
completed name/ownership change form, documentation from the parties involved,
and other supporting materials as may be appropriate. The approval of this request
will be considered on its merits and may or may not be approved. The permittee is
responsible for compliance with all permit conditions until such time as the Division
approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject
the Permittee to enforcement action by the Division of Water Quality, in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing
of a request for a permit modification, revocation and reissuance or termination does
not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual. .
8. Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit.
9. The permittee shall notify the Division any name, ownership or mailing address
changes within 30 days.
10. This permit shall be effective from the date of issuance until March 21, 2016.
Application for permit renewal shall be submitted 180 days prior to the expiration date
of this permit and must be accompanied by the processing fee.

Certification Requirements:

2. The drainage area to the system contains no more than the permitted amount
of built -upon area.
.3. All the built -upon area associated with the project is graded such that the runoff
drains to the system.
4. All roof drains are located such that the runoff is directed into the system.
5. The outlet/bypass structure elevations are per the approved plan.
6. The outlet structure is located per the approved plans.
7. Trash rack is provided on the outlet/bypass structure.
8. All slopes are grassed with permanent vegetation.
9. Vegetated slopes are no steeper than 3:1.
10. The inlets are located per the approved plans and do not cause short-circuiting
of the system.
11. The permitted amounts of surface area and/or volume have been provided.
12. Required drawdown devices are correctly sized per the approved plans.
13. All required design depths are provided.
14. All required parts of the system are provided, such as a vegetated shelf, and a
forebay.
15. The required system dimensions are provided per the approved plans.

I made a slot opening & finished the review of this package this afternoon. It looks good, with
one thing missing. The Letter of Transmittal states that the package comes with 1 copy of the
"Stormwater Permit Application Modification" form. It seems to have been accidentally left
out of the package. Could you please check to see if y'all still have it and forward to me as soon
as you can? Two copies of the revised nar.rati.ve was included which did contain the new Drainage
area tables in both "Acres" and "Square Feet", but no new standard 4 page application form.

The Washington Regional Office received a complete Stormwater Management Permit Application for Harvest
Church on February 29, 2008, Staff review of the plans and specifications has determined that the project, as
proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding
Permit No. SW7060108 dated April 23, 2008 for the construction of the subject project.
This permit shall be effective from the date of issuance until April 23,2018 and shall be subject to the conditions
and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements
in this permit. Failure to establish an adequate system for operation and maintenance of the stormwater
management system will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request
an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request
must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. Unless such
demands are made this permit shall be final and binding.

the provisions. of 15A NCAC 2H .1000 (hereafter referred to as the. "stormwater rules') and the approved
stormwater management plans and specifications and other supporting data as attached and on file with and
approved by the Division of Water Quality and considered a part of this permit,
This permit shall be effective from the date of issuance until April 23, 2018 and shall be subject to the following
specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as described in
Section 1.6 on page 3 of this permit. The stormwater control has been designed to handle the runoff from
114,865 square feet of impervious area.
3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per
approved plans.
4. All stormwater collection and treatment systems must be located in either dedicated common areas or
recorded easements. The final plats for the project will be recorded showing all such required easements,
in accordance with the approved plans.
5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into
the permitted stormwater control system.

II. SCHEDULE OF COMPLIANCE
The stormwater management system shall be constructed in its entirety, vegetated and operational for its
intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be
repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted
stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must
be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited
to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and
piping.
g. Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon request to authorized personnel
of DWQ. The records will indicate the date, activity, name of person performing the work and what
actions were taken.
5. Decorative spray fountains will not be allowed in the stormwater treatment system.
6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable
unless the facilities are constructed in accordance with the conditions of this permit, the approved plans
and specifications, and other supporting data.
Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of
this permitted facility, a certification must be received from an appropriate designer for the system
installed certifying that the permitted facility has been installed in accordance with this permit, the
approved plans and specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification. A modification may be required for
those deviations.
8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition
prior to operation as a stormwater treatment device, and prior to occupancy of the facility.
9. Access to the stormwater facilities shall be maintained via appropriate easements at all times.
10. The permittee shall submit to the Director and shall have received approval for revised plans,
specifications, and calculations prior to construction, for any modification to the approved plans, including,
but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater management
measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is
defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought.

Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the
approved plans, prior to construction.
12. A copy of the approved plans and specifications shall be maintained on file by the Permittee at all times.
13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum
requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a
written time schedule to the Director for modifying the site to meet minimum requirements.. The permittee
shall provide copies of revised plans and certification in writing to the Director that the changes have been
made.
Ill. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director. In the event of a
change of ownership, or a name change, the permittee must submit a formal permit transfer request to
the Division of Water Quality, accompanied by a completed name/ownership change form, documentation
from the parties involved, and other supporting materials as may be appropriate. The approval of this
request will be considered on its merits and may or may not be approved. The permittee is responsible for
compliance with all permit conditions until such time as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to
enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute
143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes,
rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and
federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions,
the Permittee shall take immediate corrective action, including those as may be required by this Division,
such as the construction of additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal business hours for the
purpose of inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a
permit modification, revocation and reissuance or termination does not stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual.
8. Approved plans and specifications for this project are incorporated by reference and are enforceable
parts of the permit.
The permittee shall notify the Division any name, ownership or mailing address changes within 30 days.

submitted 180 days prior to the expiration date of this permit and must be accompanied by the processing
fee.

IV. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
The following italicized deed restrictions and protective covenants are required to be recorded for all
subdivisions, outparcels and future development prior to the sale of any lot. If lot sizes vary significantly, a table
listing each tot number, size and the allowable built -upon area for each lot must be provided as an attachment.
The following covenants are intended to ensure ongoing compliance with state stormwater management permit number
as issued by the Division of Water Quality. These covenants may not be
changed or deleted without (fie consent of the State.
2. No more than square feet of any lot shall be covered by structures or impervious materials.
Impervious materials include asphalt, gravel, concrete, brick, stone, slate or similar material but do not include wood
decking or the water surface of swimming pools.
3. Swales shall not be filled in, piped, or altered except as necessary to provide driveway crossings.
4. Built -upon area in excess of the permitted amount requires a state stormwater management permit modification prior to
construction.
5. All permitted runoff from outparcels or future development shall be directed into the permitted stormwater control
system. These connections to the stormwater control system shall be performed in a manner that maintains the integrity
and performance of the system as permitted.

Grantham Place on March 2, 2006. Staff review of the plans and specifications has determined that the
project, as proposed, will comply with the Stormwater Regulations set forth in Title- 15A NCAC 2H.1000.
We are forwarding Permit,No. SW7060108 dated March'21, 2006, for the construction of the subject
project.
This permit shall be effective from the date of issuance until March 21, 2016, and shall be subject to the
conditions and limitations as specified therein. Please pay special attention to the Operation and
Maintenance requirements in this permit. Failure to establish an adequate system for operation and
maintenance of the stormwater management system will result in future compliance problems.

11. SCHEDULE OF COMPLIANCE '
1. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will
be repaired immediately.
3. The permittee shall at all times provide the operation and maintenance necessary to assure the
permitted stormwater system functions at optimum efficiency. The approved Operation and
Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch
basins and piping.
g. Access to the outlet structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon request to authorized
personnel of DWQ. The records will indicate the date, activity, name of person performing the
work and what actions were taken.
The facilities shall be constructed. as shown on the approved plans. This permit shall become
voidable unless the facilities are constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to
operation of this permitted facility, a certification must be received from an appropriate designer
for the system installed certifying that the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other supporting documentation. Any
deviations from the approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be restored to design
condition prior to operation as a stormwater treatment device, and prior to occupancy of the
facility.
B. Access to the stormwater facilities shall be maintained via appropriate easements at all times.
9. The permittee shall submit to the Director and shall have received approval for revised plans,
specifications, and calculations prior to construction, for any modification to the approved plans,
including, but not limited to, those listed below:.
a. Any revision. to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project
area is defined as all property owned by -the permittee, for which Sedimentation and
Erosion Control Plan approval or a.CAMA Major permit was sought...
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
10. The permittee shall' submit final site layout and grading plans for any permitted future areas shown
on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum often years from the date of the completion of construction.
12. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements. The permittee shall provide copies of revised plans and certification in writing to the
Director that the changes have been made:
13. This permit shall be effective from the date of issuance until March 16, 2016. Application for
permit renewal shall be submitted 180 days prior to the expiration date of this permit and must be
accompanied by the processing fee.

III. GENERAL CONDITIONS
This permit is not transferable except after notice to and approval by the Director. In the event of
a change of ownership, or a name change, the permittee must submit a formal permit transfer
request to the Division of Water Quality, accompanied by a completed name/ownership change
form; documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may not be
approved. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to enforcement action bythe Division of Water Quality, in accordance with North
Carolina General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all '
statutes, rules, regulations, or ordinances, which may be imposed by other government agencies
(local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be
required by this Division, such as the construction of additional or replacement stormwater
management systems.
5. The permittee grants DENR Staff permission to enter the property during normal business hours
for the purpose of inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a
request for a permit modification, revocation and reissuance or termination does not stay any
permit condition.
Unless specified elsewhere, permanent seeding requirements for the stormwater control must
follow the guidelines established in the North Carolina Erosion and Sediment Control Planning
and Design Manual.
$. Approved plans and specifications for this project are incorporated by reference and are enforceable
parts of the permit.
9. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.

A. DESCRIPTION OF PROJECT:
Location of Project:
This site is located in the City of Washington; Beaufort County, North Carolina
east of US HWY 264 and west of HWY 17. The property is accessed from 15°i
Street, approximately 0.15 mi west, from the intersection of US Highway 264 and
SR 1403, 15"' Street. The northern and western boundaries of this property
adjoin the agricultural properties of Anna W. & D Granville Lilly. The eastern
boundary adjoins the business property of the Beaufort County Committee of 100
LTD. The property may be located on a United States Geological Survey
(USGS) Quad Sheet at an approximate latitude of North 35 degrees, 34 minutes.

Predominant Soil Types:
v/ According to the United States Department of Agriculture Soil Survey of ito
County North Carolina, the predominant soil types on this site are Altavista: fine
loamy, mixed, thermic aquic hapludults & State: fine -loamy, mixed, thermic
�J typic hapludults.
Type of Development:
This project is situated on a 13.35 acre tract of undeveloped land of the Christian
Voice Ministries' Lilly Tract and consists of a 36,168 sq. ft. building, 2.16 acres
of parking, one access drive & a 0.21 acre detention pond. The total developed
area of this project includes 5.54 acres (of which 117 acres are impervious),
reserving 7.81 acres for buffers and future buildings and parking areas. The
proposed site development is for a church site.
Earth Disturbing Activities:
Presently the entire tract is being used for agricultural / cultivated farmland. The
earth disturbing activities will be the striping of topsoil, grading for the proposed
parking lots & access drive, grading for the proposed swales, ditches, building
pad, and the excavation for the proposed detention pond. Christian Voice
Ministries has reached an agreement with Beaufort County Committee of 100
LTD to utilize the existing Beaufort County Committee of 100 LTD's drive (to
the old "Lower" building) to avoid another crossing of the existing blueline
stream located between 15`f' Street and the proposed church. The total area of
disturbance equals 8.12 acres.
Existing Drainage Patterns:
The site is a cultivated field which is crowned in the approximate center of the
property. The southern three quarters of this site drains from this center crown
towards the southwest with surface water sheet flowing across the site into the
existing swale prior to flowing into a drainage canal / blue -line stream flowing

southeast to northwest across the southern end of the site. The rear northern
quarter of the site drains by sheet flow from the center crown towards the
northeast to a drainage canal / blue -line stream again flowing southeast to
northwest across the northern end of the site.
Proposed Drainage Patterns:
The intent of the design of the proposed drainage patterns is to match the existing
drainage patterns as much as possible, while maintaining positive drainage for the
development and yet minimizing the impact on the Tar -Pamlico River Buffer
Zones. All drainage on the southern three quarters of the site shall be routed to
flow through vegetated swales and then to the proposed detention pond for
treating the majority of the runoff prior to draining into the southern canal / blue -
line stream. The northern portion of this site shall continue to be drained via
sheet flow with the roof drains of the proposed building flowing into a grass -lined
swale, then sheet flow prior to discharge into the northern stream. Both northern
and southern streams are un-named tributaries to Cherry's Run which flows into
Tranter's Creek which in turn flows into the Tar River. Cherry's Run is classified
as a Class C stream with Nutrient Sensitive Waters (NSW) and Swamp waters
(Sw).
The proposed drainage patterns of the Drainage Areas as shown on Plan Sheet C3
are summarized as shown below:

The new proposed outfalI ditchs have stone velocity dissipating aprons that
reduce the discharge to less than the maximum permissible velocities of the ten-
year storm of'2.5 feet per second for fine sand or sandy loam.
B. STORMWATER TREATMENT AND MANAGEMENT:
l . The proposed initial project built upon area for this site is less than 30
percent (22.8%); however, future expansion plans will exceed low density
requirements. In order to be more pro -active in treating stormwater and to
facilitate future expansion, this design incorporates a wet detention pond
for this initial phase of construction. As stated above under proposed
drainage patterns the majority ofthe stormwater shall be treated by a series
of swales and then either draining into the wet detention pond or through
excavated swales then into sheet flow prior to leaving the site.
2. Maintenance of'grassed swales shall involve the following:
At least once per year (more frequently if needed), remove excess sediment,
especially frorn upstrearn edge, to maintain original contours and grading to
ensure that runoff flows evenly in a thin sheet through the swale.
At least once per year, inspect vegetation and reseed if necessary to maintain a
dense growth of grass.
Grassed swales shall be mowed at least twice annually to a minimum height of
six inches.
Du Not Fertilize s►vales (grass swales are designed to remove nitrogen From
storrn water and shall receive sufficient amounts upon normal filtering action
throughout the year).
3. Maintenance of the Wet Detention Pond shall involve the following:
Periodically clean trash from the grate of the drop inlet as needed.
Maintain the vegetative (grass) cover above the permanent pool elevation in a
like manner as grassed swales as shown above.
Clean out sediment in the Forebay and the main pond area when sediment
exceeds 25 percent of the original depth (when red paint is showing on sediment
Clean out markers.
Adhere to all other maintenance measures as shown on page 3 of 4 of the
permitted Wet Detention basin Supplement.

This office has completed its review of the erosion and sedimentation control plan for the
referenced 9.9 acre disturbance. Based on the information provided, we have determined the
submitted plan for the grading associated with the construction of a stormwater pond, parking
area, building, access road and landscape berms, if properly implemented and responsibly
maintained, should meet the intent and minimum requirements of the Act. We, therefore, issue
this LETTER OF APPROVAL.
In 1973, the Sedimentation Pollution Control Act (copy available upon request) was
enacted. It established a performance oriented program with the OBJECTIVE of PREVENTING
SEDIMENT DAMAGE to adjoining properties and/or natural resources resulting from land
disturbing activities through the use of reasonable and appropriate Best Land Management
Practices, based on the approved plan and changing site conditions, during the course of the
project. AS THE DECLARED RESPONSIBLE PARTY, YOUR LEGAL RESPONSIBILITY
is to understand the Act and comply with the following minimum requirements of the Act and the
above listed modifications (if any):

following the date of initial approval, if no land -disturbing activity has been

-- the LATEST APPROVED soil erosion and sediment control plan will be
used during inspection to determine compliance and a copy of the plan must
be on file at the job site;
-- erosion and sediment control measures or devices are to be installed to
safely withstand the runoff resulting from a 10 year storm event - 6.5 - 7
inches in 24 hours or at the rate of 6.5 - 7 inches in 1 hour.

after it is either tacked, with an acceptable tacking material, or crimped in

the information included on the form. This approval and the financial
responsibility/liability cited in it does not automatically transfer with a
change in project ownership.
Be advised that to ensure compliance with the approved plan and the program
requirements, unannounced periodic inspections will be made. If it is determined that the
implemented plan is inadequate, this office may require the installation of additional measures
and/or that the plan be revised to comply with state law. (Note: Revisions to the scope of this
project without prior approval of the plan showing the changes can be considered a violation).
Failure to comply with any part of the approved plan or with any requirements of this program
could result in the taking of appropriate legal action (civil or criminal) against the financially
responsible parry (Christian Voice Ministries, Inc.). Some options are Stop Work Orders and the
assessing of a civil penalty of up to $5000 for the initial violation plus up to $5000 per day for
each day the site is out of compliance.
In recognizing the desirability of early coordination of sedimentation control, we believe
it would be beneficial for you and your contractor to arrange a preconstruction conference to
discuss the requirements of the approved erosion and sedimentation control plan. Prior to
beginning this project, YOU ARE REQUIRED TO either CONTACT THIS OFFICE TO

START-UP DATE, contractor and on -site contact person OR complete and return the attached

Acceptance and approval of this plan is conditioned upon your compliance with Federal
and State water quality laws, regulations and rules. In addition, the land disturbing activity
described in this plan may also require approval or permitting from other agencies - Federal, State
or local. These could include the U.S. Army Corps of Engineers under Article 4.0.4.

Pamlico River basin with forest vegetation on the adjacent land or "riparian area". In riparian
areas, the rule prohibits all land disturbance, new development and fertilizer use in the first 30
(horizontal) feet directly adjacent to the stream and/or coastal wetland vegetation. , With the
exception of clearing, seeding and a one-time fertilizer use to establish the grass, the rule prohibits
new development in the zone 20 feet landward of the first 30 feet of riparian area. For more
information about the riparian area rule, please contact the Division of Water Quality's
Wetland/401 Unit at 919-733-1786.
Please be advised that all land -disturbing activities affecting 1 or more acres are required
to have a (Federal) NPDES permit. Enclosed is the Construction Activities General NPDES
Permit - NCG010000 for this project. The responsibility for understanding and complying with
this permit rests with you, the financially responsible parry. Be aware that failure to comply with
this permit could result in both the State and Federal governments taking appropriate legal action.

II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will
be repaired immediately.
3.1 The permittee shall at ail times provide the operation and maintenance necessary to assure the
permitted stormwater system functions at optimum efficiency. The approved Operation and
Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
C. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch
basins and piping.
g. Access to the outlet structure must be available at all times.

4. Records of maintenance activities must be kept and made available upon request to authorized
personnel of DWQ. The records will indicate the date, activity, name of person performing the
work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans. This permit shall become
voidable unless the facilities are constructed in accordance with the conditions.of this permit, the
approved plans and specifications, and other supporting data.
6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to
operation of this permitted facility, a certification must be received from an appropriate designer
for the system installed certifying that the permitted facility has been installed in accordance with
this permit, the approved plans and specifications, and other supporting documentation. Any
deviations from the approved plans and specifications must be noted on the Certification. A
modification may be required for those deviations.
7. If thestormwater system was used as an Erosion Control device, it must be restored to design
condition prior to operation as a stormwater treatment device, and prior to occupancy of the
facility.
8. Access to the stormwater facilities shall be maintained via appropriate easements at all times.
9. The permittee shall submit to the Director and shall have received approval for revised plans,
specifications, and calculations prior to construction, for any modification to the approved plans,
including, but not limited to, those listed below:
a: Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Project name change.
C. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area or to the drainage area.
e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project
area is defined as all property owned by the permittee; for which Sedimentation and
Erosion Control Plan approval or a.CAMA Major permit was sought.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
10. The permittee shall submit final site layout and grading plans for any permitted future areas shown
on the approved plans, prior to construction.
11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of construction.
12. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements. The permittee shall provide copies of revised plans and certification in writing to the
Director that the changes have been made.
13. This permit shall be effective from the date of issuance until March 16, 2016. Application for
permit renewal shall be submitted 180 days prior to the expiration date of this permit and must be
accompanied by the processing fee.

Ill. GENERAL CONDITIONS
1. This permit is not transferable except after notice to and approval by the Director. In the event of
a change of ownership, or a name change, the permittee must submit a formal permit transfer
request to the Division of Water Quality, accompanied by a completed name/ownership change
form; documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of this request will be considered on its merits and may or may not be'
approved. The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request.
2. Failure to abide by the conditions and limitations contained in this permit may subject -the
Permittee to enforcement action bythe Division of Water Quality, in accordance with North
Carolina. General Statute 143-215.6A to 143-215.6C.
3. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances, which may be imposed by other government agencies
(local, state, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be
required by this Division, such as the construction of additional or replacement stormwater
management systems.
5. The permittee grants DENR Staff permission to enter the property during normal business hours
for the purpose of inspecting all components of the permitted stormwater management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a
request for a permit modification, revocation and reissuance or termination does not stay any
permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control must
follow the guidelines established in the North Carolina Erosion and Sediment Control Planning
and Design Manual.
8. Approved plans and specifications for this project are incorporated. by reference and are enforceable
parts of the permit.
9. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.

Maintenance activities shall be performed as follows:
After every significant runoff producing rainfall event and at least monthly:
a. Inspect the wet detention basin system for sediment accumulation, erosion, trash accumulation,
vegetated cover, and general condition.
b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within
2 to 5 days as designed.
2. Repair eroded areas immediately, re -seed as necessary to maintain good vegetative cover, mow vegetative
cover to maintain a maximum height of six inches, and remove trash as needed.
Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain
proper functioning,,
4. Remove accumulated sediment from the wet detention basin system semi-annually or when depth is
reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of
in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e.
stockpiling; near a wet detention basin or stream, etc.).
The measuring device used to determine the sediment elevation shall be such that it will give an accurate
depth reading and not readily penetrate into accumulated sediments.
When the permanent pool depth reads .75� feet in the main pond, the sediment shall be removed.
When the penranent pool depth reads y15' feet in the forebay, the sediment shall be removed.

5. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These
plants shall be encouraged to grow along the vegetated shelf and forebay berm.
