This office received a Coastal Stormwater permit application and plans for the subject project on December
27, 2005. A preliminary review of your project indicates that before a State Stormwater permit can be issued the
following additional information is neeJed.
➢ Please note the minimum flow path must have a length to width ratio of 3 to 1, please correct for the area 2 pond. The
water entering through the curb outlet closest to the back of the building does not have a 3:1 flow path. Also, note that
the pond in general does not meet the 3:1 ratio.
Please show the inlet and outler protection for the pipes on the Stormwater plan. This will ensure that they are not seen
as temporary measures and removed once the vegetation is established.
✓;o Please clarify the pond contour:. It appears that part of the pond contours have 2 elevations on them.
➢ Please verify that the pond drains to the Neuse River and not Jack Smith Creek.
✓➢ Please use the SA/DA chart for coastal areas (chart attached) and recalculate volumes and surface areas.
Please label and dimension the permanent and temporary pool elevations on the plan view of the pond.

the Letterhead address.
You should also be aware that the Stormwater Rules require that the permit be issued prior to any development activity.
Construction without a permit is a violation of 15A NCAC 21-1.1000 and North Carolina General Statute 143-215.1 and may
result in civil penalties of up to $10,000 per day.

Please update seeding schedule to represent the most recent Sedimentation and Erosion Control design manual that
does not include weeping love grass as an approved vegetation for slopes. In addition, please note on the seeding specs
what vegetation will be specified for the dry detention basin. Please take into account the frequent inundation periods
ofthe basin.

II. REQUIRED ITEMS CHECKLIST ,.,
The following checklist outlines design requirements per the Stormwater Best Management Practices Manual
(N.C. Department of Environment, Health, and Natural Resources, November, 1995) and Administrative
Section 15A NCAC 2H.1008.
Initial in the blank space provided -in front -of each item to, indicate the following design requirements have
been met and supporting documentation is attached. If the applicant, has designated an agent in the
Stormwater Management Permit Application Form, the agent may initial below. If a requirement has not
been met, please attach written justification.

a. The basin captures the runoff from the 1 year, 24 hour storm and releases it over a period of 48
hours
b OR the basin captures the volume of runoff from the I inch storm and allows it to draw down over

d. Basin sideslopes are no steeper than 3:1.
e. A small permanent pool has been provided at the outlet to reduce clogging.

i. If the basin was used during construction as a sediment basin or trap, it must be cleaned out to .

to the'grasses specified due to the -frequent inundation..
k. The basin must be stabilized within 14 days of construction.
1. The design provides for a sediment storage volume that is equal to 20% of the runoff detention
volume.
m.Inlet and outlet channels have been protected from scour during high flows from large storms.
n. In areas of easily erodible soils, an additional plunge pool at the inlet has been provided; or riprap
is used as an energy dissipator.
.o. A forebayy to capture sediment is provided"to make cieanout easier.
p. The basin is located in uncompacted natural soils.
q. The seasonal high water table is located at least 1 foot below the bottom of the extended dry
detention basin.,
r. An additional BMP has been designed to operate in conjunction with this dry detention Basin to
meet the require&minimum 85% TSS removal.
III. EXTENDED DRY DETENTION OPERATION AND MAINTENANCE AGREEMENT
The extended dry detention system is defined as the dry detention basin, forebay, and the required additional
BMP.
This system (check one) does does not incorporate a vegetated filter.

At a minimum, the following maintenance activities shall be performed:
1. All grassed areas of the system shall be mowed at least twice annually, more frequently during the
summer months, as needed.
2. Monthly or after a runoff -producing rain event- inspect the system to make sure it is functioning
properly. Remove any accumulated debris from the system, outlet and orifice.

3. Repair and revegetate any eroded side slopes and any erosion around the inlets and outlet immediately.
4. Check the depth of the system. If sediment has accumulated to the point that the volume has been
reduced to 75% of the original depth, it must be removed.
5. Inspect and repair the emergency spillway to keep in good working order.
6. Remove woody vegetation from the banks of the system.
7. Any areas of the system found to be deficient shall be repaired or replaced to design standards
immediately.
8. Written records of the inspections and maintenance activities shall be kept on file. See the permit for
specific written record requirements.

project on October 5, 2005. North Carolina Administrative Code 15NCAC 21-1.1000requires that any
project that must receive either a Sedimentation and Erosion Control Plan approval, and/or a CAMA
Major permit, apply for and receive a Stormwater Management Permit by the Division of Water Quality.
To obtain a Stormwater Permit you must submit a completed application form, application fee of
$420.00, two sets of plans and speons showing the proposed project and all stormwater treatment
units along with engineering calculations and a narrative description. This application package should be
received by this office prior to December 19, 2005. If an applicabon package is not received by this date
we will consider the project incomplete. We also have an Express Permitting program. If you are
interested in this program you may contact Ms. Lyn Hardison, One Stop Permit Coordinator, at 252-948-
3842.
Any development of the site prior to receipt of the required permit will constitute a violation of 15A
NCAC 2H.1000 and North Carolina General Statute 143-215.1 and may result in appropriate enforcement

This office has completed its review of the erosion and sedimentation control plan for the referenced
1-8 acre disturbance. Based on the information provided, we have determined the submitted plan for grading
associated with.a cleaning and maintenance facility for automobiles'with parking and storrnwater facilities, if
properly implemented and responsibly maintained, should meet the intent and minimum requirements of the
Act. We, therefore, issue this LETTER OF APPROVAL.
In 1973, the Sedimentation Pollution Control Act (copy available upon request)was enacted.
It established a performance oriented program with the objective of PREVEN7FLNG sediment damage to
adjoining properties .and/or natural resources resulting from land disturbing acriviries through the use of
reasonable and appropriate Best Land Management Practices, based on the approved plan and changing site
conditions, during the course of the project- AS THE DECLARED RESPONSIBLE PARTY -YOUR
RESPONSIBILITY is to understand the Act and comply with the following minimum requirements of -the
Act and the above listed modifications (if any):
an erosion and sedimentation control plan is only valid for 3 Years
following the date of initial approval.. if no land-disrurbing acirivity has beer,
undertaken;
- a copy of the LATESTAPPRO VED soil erosion and control plan must be on
file at the job site;
erosion and sediment control measures or devices are to be installed to
safely withstand the runo1J resulting from a 10 Year storm even: - 6.r -

a buffer zone, sufficient to restrain visible sedimentation. must be provided
and maintained between the land -disturbing activity and any adjacenr
property or watercourse;
new or affected slopes must be at an angle that can be retained by vegetative
cover;
- barren slopes mim be provided with a ground cover (temporan! or
permanent)suffcient to restrain erosion within 21 calendar dais of
completion o�any phase (rough or final) of-rading_. (RYE GRASS IS
NOT in the approved seeding specifications nor is it an ACCEPTABLE
substitute for the providing of a ground cover);
-- unless a temporary, manufactured, lining material has been specified. a
clean straw mulch must be applied, at the minimum rate of 2 tons- acre. to
all seeded areas. The mulch must cover at least 75% of the seeded area
after it is either tacked, with an acceptable tacking material, or crimped in
place,
in order to meet the intent of the Act. the scheduling of the land -disturbing
activities is to be such that both the area of exposure and the time between
the land disturbance and the providing of a ground it minimized:
-- a permanentg round cover, sufficient to restrain erosion, must be provided
within the shorter of li working or 90 calendar dqus after completion of
construction or development, and,
-- except in the case of an emergency, a revised erosion and sedimentation
control plan must be submitted to and approved by this office prior to
initiating am, significant changes in the construction, grading or drainage
plans
-- this approval is based, in port, on the accuracy of the information provided
in the Financial Responsibility/Ownership form submitted with the proiect
plans_ You are required to file an amended form if there Ls any chana a in
the information included on the form. This approval and the financial
responsibility/liability cited in it does not automatically transfer tivith a
change in project ownership.
Be advised that this letter gives notice of our right of periodic inspection to ensure compliance with the
approved plan and the program requirements. If the implemented plan is determined to be inadequate, this
office may require that it be revised to comply with state law. Failure to comply with any part of the approved
plan or with any requirements of this program, could result in the taking of appropriate legal action against the
financially responsible party (Mr_ Allen C. Bardwell, Jr.). One option is the assessing ofa civil penalty of up
to $5000 for the initial violation plus up to $5000 per day for each day the site is out of compliance.
I.n recognizing the desirability of early coordination of sedimentation control, we believe it would be
beneficial for you and your contractor to arrange a preconstruction conference to discuss the requirements of
the approved erosion and sedimentation control plan. Prior to beginning this project you are requires to either

contractor and an on -site contact person OR- please, complete and return the attached Project Information
sheet to the above named_
The land -disturbing activity described in this plan may require approval or permitting from other
Federal, State or local agencies_ These could include the U.S. Army Corps of Engineers under Article 404
jurisdiction, the Division of Water Quality - Surface Water Section under stormwater regulations, county, city
or town agencies under other local ordinances, or other approvals that may be required. This approval does not
supersede any other approval or permit
Please be advised that a rule to protect and maintain existing butlers along watercourses in the ]v euse
River Basin became effective on July 22, 1997. The Neuse River Riparian Area Pmtection and Maintenance
Rule (I5A NCAC 2B.0233) applies to all perennial and intermittent streams, lakes, ponds and estuaries in the
Neuse River basin with forest vegetation on the adjacent land or "riparian area". In riparian areas with existing
forest vegetation in the first 30 feet directly adjacent to the stream, the rule prohibits land disturbance. new
development and fertilizer use within the first 50 feet of land nest to the water. In riparian areas with forest
vegetation that is less than 30 feet wide, the rule prohibits land disturbance, new development and fertilizer use
within the area that contains forest vegetation (but not the entire 50 foot riparian ar°a)_ For more information
about the riparian area rule, Please contact the Division of Water Quality's Wetland/401 Unit at 919-733-1786.
Please be advised that all land disturbing activities affecting at least one acre will be required to have a
(federal) NPDES permit. Enclosed is the Construction Activities General Permit - NCG010000 that for this
project. The responsibility forunderstanding and complying with this permit rests with you. Be aware that
failure to comply with this permit could result in both the State and Federal governments taking appropriate
legal action. Contact the Division of Water Quality - Surface Water Section at (252) 946-6=t81 should you
have any questions regarding monitoring and record keeping requirements of the permit_
