General Provisions (R-3 ZONING) (SINGLE FAMILY) These Development Standards are a part of the Conditional District Site Plan (Sheet CD-2) associated with the Conditional District Zoning application fled by Historic Ventures, LLC to accommodate a Central Business District development on this site (the "Site"). Development of the Site will be governed by the Conditional District Site Plan, these Development Standards and the applicable provisions of the Waxhaw Unified Development Ordinance (the "UDO"). Unless the Conditional District Site Plan or these Development Standards establish more stringent standards, the regulations established under the UDO for the C4 (Central Business District) zoning classification shall govern all development taking place on the Site. The building configurations, placements, and sizes as well as the locations of all development shown on the Conditional District Site Plan (Sheet CD-2) are schematic in nature and may be altered or modified during the design development and construction document phases within the maximum development limits established by buffers and setbacks. Such changes will be subject to review and approval by the Zoning Administrator to ensure any changes are consistent with the overall intent of the Conditional District Site Plan, and any such changes are subject to and may also be approved in accordance with Section 16.2.8 of the UDO. I 2. Permitted Uses; Buildings I A. The Site may be devoted to any use allowed by right or allowed by right with supplemental regulations in the C-4 zoning district, any conditional use or I.. The uses and the related parking calculations set out in the Table on Sheet CD-2 are the current projected uses of the buildings to be located on the Site and /W�/ the parking requirements for such uses. However, subject to paragraph A above, the actual uses of the buildings to be located on the Site may differ from the X O uses set out in the Table provided that the parking calculation chart is revised accordingly pursuant to Section 5 of these development standards and that the tY uses can meet the minimum parking requirements of the UDO with the shared parking reduction. All applicable planning and zoning permits shall be obtained from the Planning and Community Development Department for all uses within the site at the time of building permit application. WAXHAW UNITE METHODIST 3. Maximum Building Area CHURCH A maximum of 201,600 square feet of total gross heated floor area may be developed on the Site. Areas devoted to surface and structured parking, outdoor (5 PARCELS TOT L) dining, courtyards and plazas shall not be considered a part of or counted towards the maximum total gross heated floor area. (R-3 ZONING) (CHURCH) 4. Setbacks, Side Yards and Rear Yards - A. All buildings constructed on the Site shall satisfy or exceed the setback, rear yard and side yard requirements established under the LIDO for the CA zoning district. If subdivided, all outparcels shall meet the minimum lot size and setback requirements. B. Price Street Frontage- A 20' setback shall be provided along the project frontage. C. Broad Street Frontage- A 25' setback shall be provided along the project frontage. (Parking will be allowed in that portion of the setback identified on the --- Conditional District Site Plan). D. Broome Street Frontage- The buildings along Broome Street shall have an average setback of 10 feet and a minimum setback of 5 feet. 5. Parking A. Parking shall be provided in accordance with Section 12 of the LIDO. Parking calculations provided on the Conditional District Site Plan are subjectto change as building uses are determined. Adjustments may be necessary in order to accommodate stormwater treatment requirements and natural site discharge points. I C. In order to achieve the maximum regulatory credits with respect to pollutant removal per the NCDENR Stormwater BMP Manual, a monitoring program shall be established. After the water quality pond is established, it shall be inspected on a regular basis. Records of operation and maintenance shall be kept in a I known location and shall be available upon request by the Town of Waxhaw. Any problems found during inspection shall be repaired immediately. Monitoring -� shall include an evaluation of the following elements: a) Aquatic environment: water clarity and algal growth b) Vegetation: The vegetated shelf shall be properly maintained in order to achieve additional pollutant removal and in order to prevent bank erosion. Bare spots, weeds, and invasive species shall be noted and remedied as soon as possible to prevent larger problems. Grass shall be cut (where appropriate) and debris shall be removed in order to ensure a functional and attractive BMP facility. c) Sediment Build-up; Water Depth: Sediment accumulation shall be monitored through a visual inspection of the basin bottom and the sediment accumulation depth marker. When the specified depth of sediment has been reached in the forebay or main basin, the sediment shall be removed and repaired as designed. The detention pond shall maintain a minimum of three feet of water at its center point. This requirement is subject to any drought limitations imposed by the owner's water supplier or applicable law. d) Benchmark testing will be established prior to development to ensure water quality does not diminish below North Carolina standards or to levels adverse to drinking by domestic animals. The quality of the water shall be monitored at least once a year to ensure that the pond is functioning as designed. W ILLIA M. D. Lighting Exterior lighting shall comply with Section 12.10 of the LIDO. The quality of street lights installed by the Petitioner shall be compatible with existing street lights in downtown Waxhaw (match or closely resemble existing street lights) and will be designed to direct light away from adjoining and nearby parcels. 8. Vehicular Access Vehicular access to the Site shall be as generally depicted on the Conditional District Site Plan. The placement and configuration of these access points are subject to modifications required to accommodate final site and architectural construction plans and designs and to any adjustments required for approval by the Town of Waxhaw and NCDOT. All turning radii shall be constructed so as to be accessible by emergency vehicles (full roadway movements are allowed in emergency situations). I 9. Architectural Controls J A. Schematic architectural renderings of the elevations of the buildings and improvements proposed to be constructed on the site submitted with the Conditional District Site Plan are intended to depict the general conceptual architectural style, character and elements of the proposed buildings and improvements. -- - - Accordingly, the proposed buildings and improvements shall be designed and constructed so that they are substantially similar in appearance to the schematic architectural renderings. Changes and alterations which do not materially change the overall conceptual architectural style and character are Permitted based upon final design/construction drawings. C. No land clearing activity shall commence on the Site until the Petitioner has obtained adequate water and sewer rapacity for the initial buildings 1' at are to be constructed. Minimize downtime for businesses that are relocating to the new development. 15. Open Space A. Amenity areas shall be constructed contemporaneously with adjacent buildings. B. A centrally located open space (town square) shall be provided as depicted on Sheet CD-2. The town square shall be designed for versatility in uses and shall be for public use. A centrally located focal element shall be erected within the town square and landscape plantings shall be installed to enliven the space (seasonal color provided at key focal elements). The minimum size of the open space (as measured from right of way to right of way and building facade to building facade) shall be 0.75 acres. C. Additional public amenities shall be provided in the pedestrian zone (area between the back of curb and the building edge) along the proposed streets. Amenities may include but are not limited to outdoor dining, shelters, seating areas, public art displays, fountains, etc. D. A gazebo shall be constructed adjacent to the proposed pond in the location generally depicted on sheet CD-2. A Certificate of Occupancy shall not be granted on Building E until completion of the gazebo. 16. Road Improvements A. Price Street- Price Street shall be widened to provide a 20 foot minimum travel width from Broad Street to Broome Street. Curb and gutter is not proposed along Price Street. A 5 foot sidewalk shall be constructed only along the project frontage. B. Church Street- Church Street shall be improved to provide a 20 foot minimum travel width along the project frontage. Curb and gutter and a 5 foot sidewalk shall be installed along the project frontage (Site side of street). C. Bivens Street- Bivens Street shall be improved to provide a 20 foot minimum travel width from Hicks Street to Broome Street. Curb and gutter and a 5 foot sidewalk shall be installed along the project frontage (Site side of street). D. Hwy 161 Broome Street- Broome Street shall be improved to include a 3- lane cross section along the project frontage. The north and south bound through lanes shall be a minimum of 12 feet in width and the center lane (turn lane) shall be a minimum of 11 feet in width. Curb and gutter and a 6 foot sidewalk shall be installed along the project frontage. E. Road Improvements shall be completed in accordance with the Project Phasing Map and Section 14 hereof.
