Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 and Session Law 2006-246. We are forwarding Permit No. SW3080401, dated August 1, 2012, for the construction, operation and maintenance of the subject project and the Stormwater BMPs. This permit shall be effective from the date of issuance until May 15, 2018, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit. Failure to establish an adequate system for inspection and maintenance of the stormwater management system will result in future compliance problems. If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of this permit. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447, Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding. This project will be kept on file at the Mooresville Regional Office. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.6 on page 3 of this permit. The stormwater control has been designed to handle the runoff from 298,280 square feet of impervious area. 3. The tract will be limited to the amount of built -upon area indicated on page 3 of this permit, and per approved plans. 4. All stormwater collection and treatment systems must be located in either dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required easements, in accordance with the approved plans. 5. The runoff from all built -upon area within the permitted drainage area of this project must be directed into the permitted stormwater control system. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of outlet structure, orifice device, flow spreader, catch basins and piping. g. Access to the outlet structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. Page 2 of 6 State Stormwater Permit Permit No.SW3080401 5. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 7. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations• prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. Page 3 of 6 State Stormwater Permit Permit No.SW3080401 r' III. GENERAL CONDITIONS 1. This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a completed Name/Ownership Change form, to the Division of Water Quality, signed by both parties, and accompanied by supporting documentation as listed on page 2 of the form. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 3. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 4. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until revoked or terminated. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and re -issuance or termination does not stay any permit condition. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006- 246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. 11. The permittee shall notify the Division of any name, ownership or mailing address changes at least 30 days prior to making such changes. Permit issued this the 1st day of August, 2012. Your letter addressed several concerns you had about the construction and maintenance of the wet pond at Poplin Elementary School. After review of your letter we met on site along with your staff and UCPS Operations staff. Based on the input that you and your staff gave us at this visit I offer the following response to your concerns. Please note the format is redacted from your letter, however the permit number you reference is not correct. The Stormwater Management Permit number issued for Poplin Elementary School is SW3080401 not SWO80101. I. DWQ observed the Stormwater Control Structure and Access Easement and Agreement is in draft Form. I have not been able to locate this agreement, however, since this is probably a work product for the recorded access easement I am enclosing a copy of the survey with the easement detailed. The attached survey prepared by Lawrence Associates, P.A. indicates the easement as well as all signatures required for recordation. The easement has been recorded with t{te Union County Register of Deeds. 2. DWQ observed that all vegetative matter as identified on the site drawing was not present at the time of the site visit. This is a violation of Permit Number SWO80101 II Schedule of Compliance Condition 1. (Page 2 of 4), Condition 6. Absence of vegetative matter was observed during our site visit. We are proposing to restore this vegetative shelf as outlines in the attached Plan ofAction. Growing Possibilities.... 3. DWQ observed the operation and maintenance at the site is minimal at this time this is a violation of Permit Number SW080101 11. Schedule of Compliance Condition 3. (Page 2 of 4). Recordkeeping for BMP will be maintained from this point forward This recordkeeping will be formatted to conform to the BMP schedule listed under" Operation and Maintenance "on sheet C-6 of the documents submitted for the approved permit. 5.Title 15A NCAC 21-1 .1008 6) requires that upon completion of construction, the designer for the type of stormwater system installed must certify that the system was inspected during construction, was constructed in substantial conformity with plans and specifications approved by DWQ, and complies with the requirements of this Section. As of the date of this letter, DWQ has not received this certification. Refer to the permit dated March 7, 2008 on page 2 of 4 Item 6 for a list of constructed facilities. A storm water as- built Certification Package, as well as Designer's Certification Letter, was sent to NCDENR- Mooresville, Surface Water Protection on 71112009. I have attached another copy for your reference which indicates that the wet pond was "inspected during construction, was constructed in substantial conformity with plans and specifications approved by DWQ, and complies with the requirements of this Section' You closed your letter with a general summary of items which needed to be included in our response. Please see the following: 1. Provide a plan and schedule for rehabilitation for the perimeter plantings of the pond(s). A Plan of Action is attached which addresses the restoration of the vegetative shelf. 2. Please provide a final version of the Stormwater Control Structure and Access Easement and Agreement. See response to preceding Item # I . 3. Provide examples of updated field documents and recordkeeping that you will use to insure that the permit conditions are being met. The format for BMP recordkeeping will conform to the Operations and Maintenance Schedule listed in item# 4. These records will be kept for site visits performed at one month, 3 months and 6 month intervals. 4. Provide details demonstrating that the system was inspected during construction, was constructed in substantial conformity with plans and specifications approved by DWQ, and complies with the requirements of this Section. Provide details of as -built changes and needed corrective actions. Some areas around the pond had bare spots and vegetation was absent from some locations of the shelf. UCPS will restore the wet pond grassing and vegetative shelf as follows: 1.)Treat invasive plants with herbicide - Fall 2010. 2.)Re-seed grass to stabilize bare spots around wet pond — Fall 2010. 3.)Replant new vegetation at vegetative shelf in locations and quantities as per approved plan - Spring 2011. 4.)Maintain for one growing season and then contact DWQ for site visit and evaluation - Spring 2012. A preliminary review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: DWQ requires a minimum 10-foot wide vegetated shelf be installed around the perimeter of the Wet Detention Basin. The inside edge of the shelf shall be 6" below the permanent (normal) pool elevation; the outside edge of the shelf shall be 6" above the permanent (normal) pool elevation. Details on sheet C-6 indicate the outside edge and normal pool elevation are the both at 626.0 feet. Wet Detension Basin Supplemeet indicates that the Bottom Shelf elevation (625.0 feet) is one foot below the SHWT and the permanent pool elevations (626.0 feet) and the top shelf (626.0) is a foot above the permanent pool. Please resubmit two sets (Sheets sheet C-5, C-6 and C-7) sealed, signed & dated layout & finish grading plans with appropriate details and the corrected Wet Detention Basin Supplement Form. 2. Project does not provide stormwater treatment for added impervious surface for the proposed improvement to Poplin Road. 3. I have revised the permanent pond elevation to 625.5 to the middle of the vegetated shelf as noted. I have revised the calculations as well as the pond level on the grading C-5, detail sheet for the BMP C-6 and road improvements sheet C-7 as requested. I have also revised the supplement form with the new pond elevation and SHWT info. Please find two copies of these items. 2. 1 have added a section of how I am handling water quality for the areas which drain into the roadside ditches per our phone conversion with calculations and ditch sections to handle the flow for water quality to get a total of 35% TSS removal. Sheet C-7 has hatch on the large section of existing pavement which is an overlayment of asphalt, but it was already paved. I only have a small 3 to 5' wide section that will be new impervious area. This is noted in the calculation sections near the back of the calculation books behind the wet pond design and before the soil report. I have also noted some information about the impervious area in the narrative after wet pond design chart. 3. Union County only notes that they follow the State BMP manual for water quality and require a minimum of release at the 1 and 10 year pre -developed rates. We are also noting the release rate of the 50 and 100 year storms. These are not required to be detention, but to be released. If there are additional questions about the information, please call me. We appreciate the fast service on the original review and request that if possible to get a quick return on the second review to get the contractor started as soon as possible for a 2009 fall opening of the school. The following information is needed to continue the stormwater review: DWQ requires a minimum 10-foot wide vegetated shelf be installed around the perimeter of the Wet Detention Basin. The inside edge of the shelf shall be 6" below the permanent (normal) pool elevation; the outside edge of the shelf shall be 6" above the permanent (normal) pool elevation. Details on sheet C-6 indicate the outside edge and normal pool elevation are the both at 626.0 feet. Wet Detension Basin Supplemeet indicates that the Bottom Shelf elevation (625.0 feet) is one foot below the SHWT and the permanent pool elevations (626.0 feet) and the top shelf (626.0) is a foot above the permanent pool. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw water from the surface in the deepest part of the pond. c. The falling water from the fountain must be centered in the pond, away from the shoreline. 6. The facilities shall be constructed as shown on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 7. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 8. If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 9. Access to the stormwater facilities shall be maintained via appropriate easements at all times. 10. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b. Project name change. C. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 11. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 12. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date of the completion of construction. 13. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. 6. The permit may be modified, revoked and reissued or terminated for cause. The filing of a request for a permit modification, revocation and reissuance or termination does not stay any permit condition. 7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a minimum of ten years from the date_ of the completion of construction. 12: The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. GENERAL CONDITIONS 1. This permit is not transferable except after notice to and approval by the Director. The project must be in good standing with the Division. The approval of this request will be considered on its merits and may or may not be approved. 2. Design Summary, Page 2 of 2 NARRATIVE GENERAL, The Poplin Grove Elementary School (Formerly `L' School, SW3080401) is located on Poplin Road in Indian Trail, Union County, NC. The site is situated in the northwest portion of the county in a low density area zoned R-3. Drainage is to North Fork Crooked Creek, a class C water body that is part of the Yadkin River Basin. Soils on site consist of BaB, CmB and ScA, with a hydraulic group classification of C. The existing school complex, consisting of academic buildings, parking, sidewalks and other features include 6.71 acres of impervious area. Prior to original construction in 2008, an existing pond was modified and permitted to treat the full 6.71 acres if impervious area as a wet pond BMP. This BMP still serves the site and has additional treatment capacity The school was originally permitted as a high density area containing 6.71 acres of impervious area on a 30 acre site. Drainage to the BMP was primarily conveyed by a piped storm drainage system. The proposed improvements involved with this modification include the addition of an outdoor basketball court. The court will increase impervious area by 6,000 sf. The court will be placed immediately outside of the existing drainage basin for the BMP, as delineated by parking lot curb and gutter/ drainage features. A small storm drain network will be added to collect runoff from the court directing it to the existing storm drain and BMP for treatment. This permit modification involves updating the permit to account for the increase in impervious area and drainage area associated with the new court.
