Wilson, from the Asheville Regional Office of the Division of Water Quality (DWQ), conducted a site inspection regarding stormwater controls for Cason Building Supply - Hendersonville. Tim Fox with Henderson County Erosion Control was also present during the inspection. Several violations of the subject stormwater permit (S W 1090301) were noted during the inspection and file review, which are detailed in the inspection report and summary pages attached to this letter. REQUIRED RESPONSE This Office requests that you respond in writing by October 3, 2011. Your response should be sent to the attention of Susan A. Wilson, Division of Water Quality, 2090 US Highway 70, Swannanoa, NC 28778 and should address the concerns noted in the inspection document. Your original consulting engineer has also been copied with this letter. You should discuss the outstanding items with him prior responding to this Notice of Violation. Although violations of the permit were noted during the inspection, no adverse impacts to surface waters were noted. However, should proper operation and maintenance not be followed, and should the other issues noted in the report not be addressed, it is likely that the stormwater controls will not work properly in the future. In addition, the direct outlet from the eastern side parking area must be eliminated/re-routed. The site is essentially not built as designed (and this office has no record of Engineer's Certification - the engineer will be copied with the inspection letter). It also appears that there has been no consistent maintenance of the BMPs. Sediment is in some basins - which may compromise their treatment capability. Some basins are eroding on the side slopes (as they are too steep) and some of the inlets/outlets are eroding. There are no immediate impacts to surface waters from this site. However, the direct outlet from the eastern side parking lot needs to be directed to a BMP. Signed copy of the Engineer's certification is in the file? Signed copy of the Operation & Maintenance Agreement is in the file? Copy of the recorded deed restrictions is in the file? Comment: ARO has no signed Engineer's Certification on file, Built Upon Area Is the site BUA constructed as per the permit and approval plans? Is the drainage area as per the permit and approved plans? Is the BUA (as permitted) graded such that the runoff drains to the system? Comment: The BUA looks fairly consistent with the plans, however one BMP is missing and there is a drainage outlet from the eastern parking area directly to a roadside drainage Swale. SW Measures Are the SW measures constructed as per the approved plans? Are the inlets located per the approved plans? Are the outlet structures located per the approved plans? Comment: There is one BMP that does not appear to have been built (BMP#2, as designed); it appears that BMP#3 is in its place (and there is no BMP for drainage area #3). For the structures in place, the inlets/outlets appear predominantly as designed, Reason for Visit: Routine Yes No NA NE ■ ❑ ❑ ❑ ❑ MOD ❑ ■ ❑ ❑ Yes No NA NE ❑ ■ ❑ ❑ ■ ❑ ❑ ❑ ■ ❑ ❑ ❑ Operation and Maintenance Yes No NA NE Are the SW measures being maintained and operated as per the permit requirements? ❑ ■ ❑ ❑ Are the SW BMP inspection and maintenance records complete and available for review or provided to t?WQ ❑ ❑ ❑ ■ upon request? Cason Building is fairly confined with no direct access to surface waters.
