Linda,
We prepared the amendment and sent it to DEMLR by letter dated January 16, 2018, but I am happy to send it over
again. Please see the attached.
Wayne L. Wagner is the President of the Sunset South Owners Association based on the most current filing on the
Secretary of State website. We've revised the Transfer Form accordingly. Please see attached. As an alert, WHA has
received e-mail correspondence and voicemails from a variety of homeowners in Sunset South, some claiming to have
authority over decision making regarding stormwater, including from Susan Shaloub and Jim Moynahan. However, we
have no documentary evidence that there has been a legitimate or official change in office holders for the
Association. Please accept the current documentation on record with the Secretary of State to facilitate permit transfer.
I understand from your email below and the related letter and Compliance Inspection Report that DEMLR will be
transferring the Stormwater Permit to the Sunset South Homeowners Association once you receive the requested
documentation. Please let me know if there is anything additional you require.
Thank you,
Amy

IVIs. Redmon:
Do you know if the Housing Authority prepared an amendment for the Association regarding the BUA
limit change for Lot #126?
it was a requirement of the May 2018 permit for WHA to prepare the document, so that when the
permit was eventually transferred to the Association, the Association would only have tU vote to
amend and then get it recorded.
I'd like a copy of the draft amendment (unsigned and unrecorded), to include with the permit to the
H OA.
Thanks,

State Stormwater Management Permit No. SW8 030404
New Hanover County
Dear Ms. Redmon:
On July 18, 2019, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the subject project, located off Carolina Beach Road at Jefferson and
Adams Streets in Wilmington, New Hanover County to determine the status of compliance with the
State Stormwater Management Permit Number SW8 030404 last modified and reissued on August
1, 2017.
On December 19, 2016, the permittee submitted a request to transfer the permit to the Sunset
South Owners Association, as allowed per Session Law 2.011-256. As required by the Session Law,
the Division inspected the project for compliance on February 14, 2017. The project was not in
compliance at that time due to the unapproved addition of sidewalk within the common area, the
standing water in Basin #4, and the lack of documentation verifying that no lot had exceeded the
BUA limit. As a result, a modified permit application to address the BUA overages was submitted on
June 1, 2017 and approved by the Division on August 1, 2017.
A follow-up compliance inspection to facilitate transfer of the permit was conducted on September
27, 2017, and the project was again found to be out of compliance. Basin #4 was still holding water
and not drawing down within 5 days. On May 11, 2018, the Division issued a modified permit to the
Wilmington Housing Authority which approved a redesign of Basin #4 to allow greater function as
an infiltration basin.
On January 23, 2019, the consultant emailed a copy of the Designer Certification for Basin #4 to the
Division and requested an inspection. Due to office closure after Hurricane Florence, the usual end
of year workload crush, and the onset of the drought, DEMLR was unable to set an inspection date
until recently. The necessary design storm rain event finally occurred on July 13, 2019, and on July
18, 2019, the Division conducted a follow-up inspection for compliance. DEMLR file review of the
previously submitted transfer documents and the most recent site inspection revealed that the site
is in compliance with the terms and conditions of this permit and can now be transferred to the
Association. Please find a copy of the completed form entitled "Compliance Inspection Report"
attached to this letter, which summarizes the findings of the recent inspection.
Please review the information provided on the original December 19, 2016 transfer application
(copy attached). If there are any changes that need to be made, please submit those changes to the
Division on a separate piece of paper, signed and dated. Specifically, is the proposed permittee
contact name (Susan Shaloub, president) and mailing address (PO Box 4898 Wilmington NC 28406)
as listed on the original transfer application unchanged?

Overall, the basins were in good shape and were dry after 5 days without rain.
The vegetation was growing tall in the bottom or each basin and almost to the top of the slope. The vegetation should be
mowed more frequently in the summer to keep the vegetation from providing a habitat for rodents and snakes.
The vegetation around the top of the basin was a bit sparse and should be beefed up to avoid erosion.

RE: [External] FW: Sunset Ponds
The plan is to wait for a nice design storm rain event for both Sunset South and for Bella Sera, and
then go out after 5 days to observe. The weather is not cooperating right now. Last year we could not
get a stretch of 5 days without rain and this year it seems we can't get rain.
I realize that the timing is not great, but I can't make a determination of compliance during a dry spell.
I would expect both Sunset South and Bella Sera to be bone dry right now. But, compliance is based
on the ability to infiltrate the design storm within 5 days, not to stay dry during a dry spell.
As soon as the weather cooperates, I'll do the inspections.

OK. The plan of action is approved with the stipulation that monitoring is conducted weekly by a PE or

Linda ,
Thank you for your response . The ground water levels do not return to normal levels as quickly as surface ponding can
as water travels slowly to reach equilibrium . We believe that the combination of removing the accumulated eroded
material and return to normal seasonal high water table levels will prove to bring the basins into compliance . If the Plan
of Action is approved, we would propose that the monitoring be conducted weekly by either a professional engineer or
soil scientist .
Please let us know if this is satisfactory .
Thank you

We don't disagree that the 100+ inches of rain we got in 2018 may have contributed to the standing
water, but I was careful to inspect after 5 days without any rain. As a matter of fact, in the 13 days
leading up to the inspection, we had only a trace amount of rainfall. We've only had a total of about 6
inches of rain so far this year, so I hope that when the first couple inches of soil are removed and
replaced in those basins, the ability to infiltrate within 5 days will have been restored.
I would also recommend that all of the basins be maintained at design condition after they are
restored, so that when the time comes, the inspection will show that the basins are functioning and
have been maintained and the permit can be transferred with no more delays.
If approved, DEMLR will expect to see the results of the monitoring in the form of recorded daily or
weekly readings correlated with rainfall events. How will the monitoring be accomplished? Who will be
taking the readings? Please provide that information before we approve the Plan of Action.
Thanks!

In regard to this email and your Notice of Inspection — Not Compliant letter dated February 11, 2019 regarding the
subject project we are responding as follows :
1. This response is the requested Plan of Action .
2. The owner will contract to have the eroded and bare areas repaired to restore Basins 1,2,and 3 to design
contours .Due to thecurrent wet weather conditions we would like to wait for some Spring weather with more
dry conditions to complete this work. As such we propose to have this work completed by the end of June 2019
3. We are also of the opinion that most of the standing water can be attributed to the abnormal 100 plus inches of
rainfall that occurred in 2018. The seasonal high water table is way out of balance due to almost twice the
normal average annual rainfall for this area . We propose that the water levels be monitored through the end of
June to determine if the water table levels return to its expected and documented level .
Please let us know if this response and Plan of Action is acceptable .

While Basin #4 looks fabulous, the other 3 basins look pretty bad
Basins 1, 2 and 3 all have standing water and thev all have trash, and bare areas on the side slopes
which has caused sloughing and erosion. It has only rained 0.16 inches since February 3, 2019,
making today the fifth day with no rain.
I'll write up the report and send it out on Monday.

State Stormwater Management Permit No. SW8 030404
New Hanover County
Dear Ms. Redmon:
On May 11, 2018, the Division of Energy, Mineral and Land Resources (DEMLR) issued a modified
stormwater management permit to address the deficiencies found in infiltration Basin 94. On January 28,
2019, the Division received the designer's certification documenting that the permitted improvements to
Basin #4 have been installed as per the approved modified plans. On February 8, 2019, the Division re-
inspected Sunset South, located off Southern Boulevard at Jefferson Street in Wilmington, New Hanover
County to determine the status of compliance with the State Stormwater Management Permit, Number
SW8 030404 as modified on May 11, 2018. The DEMLR site inspection revealed that the site is not in
compliance with the terms and conditions of this permit. Please find a copy of the completed form
entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the
most recent inspection.
As indicated in the attached inspection report, it has been 5 days since our area received 0.16 inches of
rain recorded on February 3, 2019. Basin #4 looks great, but Basins 1, 2 and 3 are holding water and are
not drawing down within 5 days; the side slopes are sloughing and bare in many areas; and the slopes are
eroding. The sediment from the eroded slopes may be accumulating in the bottom of the basin and
blinding it off, leading to the standing water situation.
Please be reminded that the project must be in compliance with the rules, the permit conditions and the
approved plans, prior to transferring the permit to the HOA. Until the Division approves of the permit
transfer, the WHA is required to comply with the terms, conditions and limitations of the Stormwater
Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina
General Statute 143-214.7, including the continued operation and maintenance of the permitted
stormwater system.
Failure to provide the requested information, or to respond to this letter with a plan of action, including a
reasonable timeline to restore Basins 1, 2 and 3, by March 11, 2019, are considered violations of the
permit. If the requested information is not submitted to this office by the due date, then DEMLR staff
will re -inspect the site and may issue a Notice of Violation. Please also note that any individual or entity
found to be in noncompliance with the provisions of a stormwater management permit or the stormwater
rules is subject to enforcement action as set forth in NCGS 143 Article 21.

Overall, the basins were in good shape and were dry after 5 days without rain.
The vegetation was growing tali in the bottom or each basin and almost to the top of the slope. The vegetation should be
mowed more frequently in the summer to keep the vegetation from providing a habitat for rodents and snakes.
The vegetation around the top of the basin was a bit sparse and should be beefed up to avoid erosion.

The project was reinspected after the designer submitted the certification for the modified Basin #4.
While Basin 4 looked good, the other 3 basins have bare areas on the side slopes, sloughing and erosion. There was
standing water in Basins 1, 2, and 3, but the last rain occured on February 3, 2019 and was only 0.16 inches, so all the
basins should have been dry.

Here is the inspection report for Sunset South. They did a great job getting Basin #4 fixed, but I think
they left the other 3 basins alone. They've got to get the other 3 basins back into compliance, and at
the same time, keep up with the maintenance of Basin 4.
I'll forward the report to Amy Wang if you are OK with it.

Amy and Phil:
I received this complaint about one of the "ponds" in Sunset South, which I assume is the refurbished Basin #4.
1 don't know what else to do except to let you and Phil know about this lady's concerns. She says she is the
current president of the HOA.
I do note that she said that the pond was "inches away" from overflowing, even after 23 inches of rain, which I
take to mean that it did not overflow, which I find quite remarkable under the circumstances. I'd like to have
been a bit more snarky in my reply to her, but alas, policy forbids it.
Thanks,
Linda

Ms. Lewis,
I completely understand that, however the other retention ponds receded as normal. They also were not
inches away from over flowing like this one was. Please understand the frustration the community has over
this retention pond. Tens of thousands of our HOA dues have gone to get HEO (the developer) to fix this pond.
This has been going on 14yrs! We've had a street that has flooded, again for 14 yrs and HEO would not fix it.
The streets were turned over to the city earlier this year and I was finally able to get someone to take a look at
the drains. When HEO decided to reroute the roads they failed to connect the pipe to the city pipe, therefore
causing the flooding which in turn damaged peoples fences. (Could of been avoided) The city is now going to
fix it. So please, again understand our frustration and the lack of trust we have in seeing this pond being fixed
correctly, there have been several failed attempts already.
I do appreciate your time and on behalf of myself and the other residents we hope this will finally be resolved
and instead of our HOA dues being spent on something that should of been done correctly the first time, we
can use it to improve our community that will benefit all residents.
Kind regards,
Kim

Permit attached. Ms. Redmon, you will be receiving the original hard copy and the stamped
approved plans in the regular mail.
All other cc's — this is the only copy of the permit you will receive.
Please note that the next step in this process is to conduct the work to bring about the permitted
changes to Basin #4, to have Mr. Norris certify that the changes have been made and that the basin
is operating as designed, and then to resubmit the transfer application.
