Please see the attached. Wayne L. Wagner is the President of the Sunset South Owners Association based on the most current filing on the Secretary of State website. We've revised the Transfer Form accordingly. Please see attached. As an alert, WHA has received e-mail correspondence and voicemails from a variety of homeowners in Sunset South, some claiming to have authority over decision making regarding stormwater, including from Susan Shaloub and Jim Moynahan. However, we have no documentary evidence that there has been a legitimate or official change in office holders for the Association. Please accept the current documentation on record with the Secretary of State to facilitate permit transfer. I understand from your email below and the related letter and Compliance Inspection Report that DEMLR will be transferring the Stormwater Permit to the Sunset South Homeowners Association once you receive the requested documentation. On December 19, 2016, the permittee submitted a request to transfer the permit to the Sunset South Owners Association, as allowed per Session Law 2.011-256. As required by the Session Law, the Division inspected the project for compliance on February 14, 2017. The project was not in compliance at that time due to the unapproved addition of sidewalk within the common area, the standing water in Basin #4, and the lack of documentation verifying that no lot had exceeded the BUA limit. As a result, a modified permit application to address the BUA overages was submitted on June 1, 2017 and approved by the Division on August 1, 2017. A follow-up compliance inspection to facilitate transfer of the permit was conducted on September 27, 2017, and the project was again found to be out of compliance. Basin #4 was still holding water and not drawing down within 5 days. On May 11, 2018, the Division issued a modified permit to the Wilmington Housing Authority which approved a redesign of Basin #4 to allow greater function as an infiltration basin. On January 23, 2019, the consultant emailed a copy of the Designer Certification for Basin #4 to the Division and requested an inspection. Due to office closure after Hurricane Florence, the usual end of year workload crush, and the onset of the drought, DEMLR was unable to set an inspection date until recently. The necessary design storm rain event finally occurred on July 13, 2019, and on July 18, 2019, the Division conducted a follow-up inspection for compliance. DEMLR file review of the previously submitted transfer documents and the most recent site inspection revealed that the site is in compliance with the terms and conditions of this permit and can now be transferred to the Association. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter, which summarizes the findings of the recent inspection. Please review the information provided on the original December 19, 2016 transfer application (copy attached). If there are any changes that need to be made, please submit those changes to the Division on a separate piece of paper, signed and dated. The weather is not cooperating right now. Last year we could not get a stretch of 5 days without rain and this year it seems we can't get rain. I realize that the timing is not great, but I can't make a determination of compliance during a dry spell. I would expect both Sunset South and Bella Sera to be bone dry right now. But, compliance is based on the ability to infiltrate the design storm within 5 days, not to stay dry during a dry spell. As soon as the weather cooperates, I'll do the inspections. The ground water levels do not return to normal levels as quickly as surface ponding can as water travels slowly to reach equilibrium . We believe that the combination of removing the accumulated eroded material and return to normal seasonal high water table levels will prove to bring the basins into compliance . We don't disagree that the 100+ inches of rain we got in 2018 may have contributed to the standing water, but I was careful to inspect after 5 days without any rain. As a matter of fact, in the 13 days leading up to the inspection, we had only a trace amount of rainfall. We've only had a total of about 6 inches of rain so far this year, so I hope that when the first couple inches of soil are removed and replaced in those basins, the ability to infiltrate within 5 days will have been restored. I would also recommend that all of the basins be maintained at design condition after they are restored, so that when the time comes, the inspection will show that the basins are functioning and have been maintained and the permit can be transferred with no more delays. If approved, DEMLR will expect to see the results of the monitoring in the form of recorded daily or weekly readings correlated with rainfall events. How will the monitoring be accomplished? As such we propose to have this work completed by the end of June 2019 3. We are also of the opinion that most of the standing water can be attributed to the abnormal 100 plus inches of rainfall that occurred in 2018. The seasonal high water table is way out of balance due to almost twice the normal average annual rainfall for this area . We propose that the water levels be monitored through the end of June to determine if the water table levels return to its expected and documented level . The seasonal high water table is way out of balance due to almost twice the normal average annual rainfall for this area . The sediment from the eroded slopes may be accumulating in the bottom of the basin and blinding it off, leading to the standing water situation. They also were not inches away from over flowing like this one was. Please understand the frustration the community has over this retention pond. Tens of thousands of our HOA dues have gone to get HEO (the developer) to fix this pond. This has been going on 14yrs! We've had a street that has flooded, again for 14 yrs and HEO would not fix it. The streets were turned over to the city earlier this year and I was finally able to get someone to take a look at the drains. When HEO decided to reroute the roads they failed to connect the pipe to the city pipe, therefore causing the flooding which in turn damaged peoples fences. (Could of been avoided) The city is now going to fix it. So please, again understand our frustration and the lack of trust we have in seeing this pond being fixed correctly, there have been several failed attempts already. I do appreciate your time and on behalf of myself and the other residents we hope this will finally be resolved and instead of our HOA dues being spent on something that should of been done correctly the first time, we can use it to improve our community that will benefit all residents.
