This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This certificate 'of coverage is not transferable. if the facility changes ownership or is closed, the Division of Energy Mineral & Land Resources may require modification, revocation or reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part 111, Section E of your permit. You must have an approved Operation and Monitoring. Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering wastewater would be discharged from this facility. This plan has been prepared by Parker & Associates, Inc. 1. SITE PLAN A. See the attached Exhibit 1 — Color Portion of Hubert USGS map, and Exhibit 2 — Portion of Onslow County D.O.T. Map, and Mine Site Plan. B. The FPMM # 1 is an existing sand mining operation, Permit# 67-55. Sand shall be excavated and loaded directly into trucks and hauled off site to other locations. Loading shall be performed with an excavator. Other than normal daily maintenance, all equipment service shall be performed off site. No fuels or lubricants shall be stored near or in the mining area. Excavated material is normally wet so dust shall not be a problem in mine. The haul road shall be monitored and periodically dampened utilizing a water truck when necessary to control any dust created from hauling operations. There shall be no waste generated from this operation, therefore, no disposal plan is needed. The possible pollutants to be concerned with are small amounts of fuel or hydraulic oil created by a ruptured hose or pipe on trucks or equipment. This should not be a normal occurrence but in the unlikely event that it does happen there always shall be someone on site to minimize and contain the spill before it reaches any water source. Any contaminated soils shall be removed and disposed of at a facility certified to treat soils. C. See the attached Mine Site Plan by Parker & Associates, Inc. D. There have been no significant spills or leaks at this location, therefore, no corrective actions have been needed. E. Samples shall be collected and analyzed by a certified laboratory as required in the General Permit — NCG020000 and results shall be kept on site. Results shall also be forwarded to NC DEMLR annually or as required by the General Permit. After such time, if levels have been consistently lower than acceptable levels, samples shall be drawn on a quarterly basis at minimum or as deemed necessary. Daily records shall be maintained on site recording times and amounts of pumping as well as recorded rainfall. 2. EROSION AND SEDIMENTATION CONTROL The mine shall overflow by gravity to the adjacent wetlands as shown on the Plan. A rock check dam/filter shall be installed in front of the existing outlet pipe. The pipe shall discharge to an existing vegetated swale that has an additional rock check dam to filter and slow the runoff prior to entering the wetlands. The excavated mine shall act as its own sediment basin/trap. The facility shall be operated and maintained in compliance with the mining permit issued by the Division of Energy, Mineral and Land Resources. 3. STORMWATER MANAGEMENT PLAN A. All excavation and land disturbance shall be confined to the mine area with only one discharge location. Natural grade in the area prohibits stormwater run-on as all areas sheet flow to wetlands away from mining area. B. An inspection of mine slopes, entrance/exit, and erosion protection devices (BMA's) shall be conducted weekly or within 24 hours of any storm event by the mine operator or other competent person. A rain gauge shall be kept on site and monitored and all rainfall recorded. A record of inspections, deficiencies and corrections shall be recorded and kept on site. C. There shall be no bulk storage of any kind on this site. 4. SPILL PREVENTION AND RESPONSE PLAN SPRP There shall be no bulk storage of any kind on site; therefore, there is no potential for spills. 5. PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PROGRAM All equipment and trucks shall be kept in good working order and kept on a regular maintenance schedule. Operators shall be trained and required to inspect equipment prior to starting work each day and periodically throughout each shift. Operators shall look for fluid Ieaks as well as potential leaks and shall not use equipment if any problems are found. All equipment with any type of leak shall be removed from mine immediately and repaired. Equipment shall be removed from mine and washed periodically to prevent rainwater from washing contaminants from machine onto ground. All equipment shall be checked by mine operator or qualified mechanic weekly. b. EMPLOYEE TRAINING SPPP - 2 Training for all involved in mine operation shall be required semi-annually. This training will include safety, things to look for that could possibly contaminate water, equipment inspections, and instructions on what to do if a spill occurs. All new employees and anyone working in mine area shall be required to receive training before entering mine. Training shall be provided by mine operator. Mine operator shall stay up to date on new references and resources pertaining to mining safety and stormwater management. 7. RESPONSIBLE PARTY The mine operator shall be responsible for all mine and dewatering practices. He shall ensure that all requirements are met and all records are up to date. The operator shall be also responsible for training of employees and personnel. 8. PLAN AMENDMENT The SPPP shall be reviewed annually and amended as needed and all changes incorporated into training and Best Management Practices. 9. PLAN IMPLEMENTATION The SPPP and NCG020000 General Permit Requirements shall be implemented immediately upon approval and a copy maintained on site. Additional copies of the plan and recorded data shall be provided upon request. Information shall be kept on site for a minimum period of five years. 10. Peele Construction NCG20000 application Larry, I looked at the C.R. Peele project yesterday. He is applying for discharge without pumping. If it is not already required for that type of discharge, I would like to see monitoring required for the same parameters as is required for dewatering by pumping. He also has an LCID pit right next to the pit that is discharging. We have had concerns in the past that wet concrete was being dumped at this LCID and chemicals were running into the pit. If allowed under the permit I would like to require that he keep some kind of physical barrier between the LCID and the pit that is dewatering. Please let me know if you need any clarification or any additional information. Thank you. The intent of this plan is to provide a detailed plan/guide for the Operation and Maintenance of the Four Points Mineral Mine # 1 (FPMM #1) so that it complies with Part III Section A of the NPDES General Permit No. NCG020000 for Mine Dewatering. This plan has been prepared by Parker & Associates, Inc. 1. SITE PLAN A. See the attached Exhibit 1 — Color Portion of Hubert USGS map, and Exhibit 2 — Portion of Onslow County D.O.T. Map, and Mine Site Plan. B. The FPMM #1 is an existing sand mining operation, Permit# 67-55. Sand shall be excavated and loaded directly into trucks and hauled off site to other locations. Loading shall be performed with an excavator. Other than normal daily maintenance, all equipment service shall.be performed off site. No fuels or lubricants shall be stored near or in the mining area. Excavated material is normally wet so dust shall not be a problem in mine. The haul road shall be monitored and periodically dampened utilizing a water truck when necessary to control any dust created from hauling operations. There shall be no waste generated from this operation, therefore, no disposal plan is needed. The possible pollutants to be concerned with are small amounts of fuel or hydraulic oil created by a ruptured hose or pipe on trucks or equipment. This should not be a normal occurrence but in the unlikely event that it does happen there always shall be someone on site to minimize and contain the spill before it reaches any water source. Any contaminated soils shall be removed and disposed of at a facility certified to treat soils. C. See the attached Mine Site Plan by Parker & Associates, Inc. D. There have been no significant spills or leaks at this location, therefore, no corrective actions have been needed. E. Samples shall be collected and analyzed by a certified laboratory as required in the General Permit — NCG020000 and results shall be kept on site. Results shall also be forwarded to NC DEMLR annually or as required by the General Permit. After such time, if levels have been consistently lower than acceptable levels, samples shall be drawn on a quarterly basis at minimum or as deemed necessary. Daily records shall be maintained on site recording times and amounts of pumping as well as recorded rainfall. 2. EROSION AND SEDIMENTATION CONTROL The mine shall overflow by gravity to the adjacent wetlands as shown on the Plan. A rock check dam/filter shall be installed in front of the existing outlet pipe. The pipe shall discharge to an existing vegetated swale that has an additional rock check dam to filter and slow the runoff prior to entering the wetlands. The excavated mine shall act as .its own sediment basin/trap. The facility shall be operated and maintained in compliance with the mining permit issued by the Division of Energy, Mineral and Land Resources. 3. STORMWATER MANAGEMENT PLAN A. All excavation and land disturbance shall be confined to the mine area with only one discharge location. Natural grade in the area prohibits stormwater run-on as all areas sheet flow to wetlands away from mining area. B. An inspection of mine slopes, entrance/exit, and erosion protection devices. (BMP's) shall be conducted weekly or within 24 hours of any storm event by the mine operator or other competent person. A rain gauge shall be kept on site and monitored and all rainfall recorded. A record of inspections, deficiencies and corrections shall be recorded and kept on site. C. There shall be no bulk storage of any kind on this site. 4. SPILL PREVENTION AND RESPONSE PLAN SPRP) There shall be no bulk storage of any kind on site; therefore, there is no potential for spills. S. PREVENTATIVE MAINTENANCE AND GOOD HOUSEKEEPING PROGRAM All equipment and trucks shall be kept in good working order and kept on a regular maintenance schedule. Operators shall be trained and required to inspect equipment prior to starting work each day and periodically throughout each shift. Operators shall look for fluid leaks as well as potential leaks and shall not use equipment if any problems are found. All equipment with any type of leak shall be removed from mine immediately and repaired. Equipment shall be removed from mine and washed periodically to prevent rainwater from washing contaminants from machine onto ground. All equipment shall be checked by mine operator or qualified mechanic weekly. 6. EMPLOYEE TRAINING SPPP - 2 Training for all involved in mine operation shall be required semi-annually. This training will include safety, things to look for that could possibly contaminate water, equipment inspections, and instructions on what to do if a spill occurs. All new employees and anyone working in mine area shall be required to receive training before entering mine. Training shall be provided by mine operator. Mine operator shall stay up to date on new references and resources pertaining to mining safety and stormwater management. 7. RESPONSIBLE PARTY The mine operator shall be responsible for all mine and dewatering practices. He shall ensure that all requirements are met and all records are up to date. The operator shall be also responsible for training of employees and personnel. 8. PLAN AMENDMENT The SPPP shall be reviewed annually and amended as needed and all changes incorporated into training and Best Management Practices. 9. PLAN IMPLEMENTATION The SPPP and NCG020000 General Permit Requirements shall be implemented immediately upon approval and a copy maintained on site. Additional copies of the plan and recorded data shall be provided upon request. Information shall be kept on site for a minimum period of five years. 10.
