I wanted to follow up on this and get Janet Boyer from Mining in the loop. From below, I understand that now the quarry operation/industrial activities under NCG0200172 includes the area that has been permitted under NCG140420. Since there is no longer a ready -mix operation, and the area has essentially been re -allocated to the quarry operation, it needs to be reflected in the Mining Permit. !f revisions are necessary to the MP 13-27, that may be all that is needed.— even for the NCG020172 to remain valid as is. NCG020172 SW/WW permit: This COC covers both wastewater and stormwater (according to the copy in the file). Because a stipulation of the NCG02 General Permit is to comply with the Mining Permit, it may not be necessary to revise NCG020172 at all to account for this change. We only need to revise NCG020172 if (1) the original NCG02 application did not include wastewater or stormwater discharges (sometimes the COCs are restricted to stormwater only, for example), and/or (2) the original application and COC does not include all the correct receiving waters (i.e., new outfalls to new waters are added, outfalls removed, etc.). #2 is not an issue since this area drains to the same basin they already monitor. I'm not sure #1 is really an issue in this case, either. NCG02 GP requires the permittee to revise details about the mine areas and outfalls in their site plan/map and SPPP, but there is not necessarily anything to revise in the permit CDC #NCG020172. Compliance with the Mining Permit is a stipulation of the General Permit, so it's important that they have their bases covered on that. I'm not sure what may or may not be different at the quarry now given these changes in storage areas, etc. Janet, should Tony Johnson with Vulcan apply for a Mining Permit revision for the Cabarrus Quarry? Or do you need more information to determine that? Yes, once we are sure the MP is addressed if necessary, then we can rescind NCG140420. We (Stormwater Program) need a written request from the owner of that permit to rescind based on removal of the ready -mix concrete activities there. Because they are using it I conjunction with the quarry, shouldn't they revise their Certificate of Coverage for their mining activities, NCG020172. Then, once it is covered under their mining certificate of coverage, we will be able to rescind NCG140420 for the asphalt activities, correct? Additionally, I'd like to note that the basin that was used for sampling of NCG140420 activities drains into another basin that is'already being monitored under NCG020172, so they will not have to add another outfall if they include this area in their COC for mining. He has requested information on what he needs to submit in order to get this area permitted as part of the Cabarrus Quarry stormwater permit. I think this is the one that Holliday went to and felt that the basins and storage piles onsite kept it from being rescinded. In your letter of June 23, 2010, you requested an extension to August 3151 to comply with sampling requirements at several Vulcan facilities across the state. Your letter cited reasons to support the request that included: , • -Hard copies of the new NCG020000 permit not being received until mid -February, when the permit had become effective January 1, 20101 • Spotty weather patterns resulting in -storm events during non -operating hours that prevent sample collection, and • The need for additional time to train Sampling Personnel on significant changes in the permit. One of the reasons for your request was the new provision that monthly monitoring will apply for the remainder of the permit term, should the mine ever fail to collect a sample during a scheduled monitoring period (footnote 1 of Table 1 in Part Ill). While considering your request, the Stormwater Permitting Unit (SPU) realized this provision may unfairly affect permittees who obtain coverage under NCG020000 in the middle of a monitoring period. The SPU has written up guidance to address this situation and related conflicts in the permit text (see attachment). Recognizing there were possible conflicts with this provision that our guidance now addresses, DWQ will grant your request for an extension to collect a stormwater sample by August 31, 2010. However, we note that Vulcan Materials Company should have been prepared to comply with permit monitoring requirements prior to receiving hard copies of the permit in mid -February. Vulcan Materials is a member of NCAA, and a representative of the company attended the initial meeting. • The provision that triggers monthly monitoring for failure to sample came out of discussions with industry representatives during these meetings and was incorporated into the final permit as a result. • The definition of representative storm event also changed as a result of these discussions with NCAA to increase sampling opportunities during operating hours. A representative storm -event in NCG020000 now only requires a period of 48 hours of no rain prior to the event. • An advance copy of the final permit was forwarded to the Executive Director of the NCAA on December 29, 2009 and subsequently distributed to NCAA members. The final NCG020000 permit was available to all permittees on the DWQ website when it became effective in January 2010. • Stormwater sampling requirements are not new with this renewal, even though sampling is now semi- annual (instead of annual in the previous permit).
