Enclosed are two copies of the revised plans with the corresponding calculations. The back lot swale labeled S lA on Sheet 14 of 16 was previously designed to be piped under Road "B". This culvert was never installed and would now require cutting the street to install it. We propose to connect Swale S lA by a new pipe and junction box connected to the outlet from the outlet structure of Stormwater Pond # 1. Please see Sheets 4, 5, and 14 of 16 and the calculations which demonstrate that this arrangement will function properly. Stormwater Pond #3 was redesigned to treat the additional now from Basin #6. This flow was originally to be treated in a vegetated swale. The proper Swale was not installed. To correct this problem, the pipe sections labeled SD "A" - SD "H" were routed to Stormwater Pond #3 thus separating the offsite flow from the project flow. This solution created an unavoidable grade conflict in the two pipes which required the design of an inverted siphon. Details of the inverted siphon are on Sheet 14 of 16. Also, the dimensions of Stormwater Pond #3 were revised to treat the extra drainage area. Please see Sheets 1, 3, and 14 of 16. Since that time, Mr. Fred Ward of bluegreen and myself have been in contact with you separately regarding this matter and the three of us met at the site yesterday. The purpose of this letter is to outline a Plan of Action in response to the Notice of Violation letter and to update you on the ongoing efforts of bluegreen Corporation to bring this project into compliance with the subject permit. After the initial visit on January 10, 2001, you visited the project again on Friday, January 19, 2001 and you witnessed the remedial construction efforts underway on the stormwater infrastructure. As an overall statement relating to the client's intent regarding this matter, bluegreen fully intends to immediately address all issues contained within the letter dated January 12, 2001. This letter will respond, in the same order, to each of the items of deficiency listed within your letter. The specific item responses are as follows: 1. SW1, SW2, SW3, SW4, SW7, SW8, .and SW9 are under construction such that the pipe is being removed and the swales installed according to the approved plans. SW 10, at Lot 137, is going to be constructed in accordance with the approved plans. It is necessary for the client to obtain an easement from the current lot owner since the lot was conveyed prior to recording an easement. Our site visit confirmed that the Swale could be constructed as designed with minimal impact on the lot. 2. 1) The parking lot Swale will be regraded to allow the runoff from the parking lot to be treated by the swale. If necessary, the pavement grade will be modified to ensure that runoff is directed into the proper Swale for treatment as indicated on the approved plans. 2) Our firm is currently investigating alternatives to address this problem. One alternative, to connect the swale to the outlet structure of Pond # 1, appears to be the most feasible at this time. We are also exploring infiltration and increasing the size of Pond # 1 to accept the water for treatment. Our proposed solution is that Stormwater Pond #3 will be redesigned to include the runoff, which was to have been treated by SW6, and the offsite stormwater will bypass the redesigned pond. Dear Mr. Edwards: On September 13, 2001, the Wilmington Regional Office performed a Compliance Inspection at The Landing @ Southport in Brunswick County, North Carolina. The purpose of the inspection was to determine if the violations, outlined in the Notice of Violation issued on January 12, 2001, had been corrected. It has been determined that The Landing @ Southport is, overall, in compliance with Stormwater Permit Number SW8 971226 Modification issued on April 4, 2001. The only issue that still needs serious attention prior to the transfer of ownership to The Landing's Homeowners' Association is the lack of permanent vegetation on the side slopes of thewater quality swales and the three wet detention ponds. These areas must be vegetated with permanent seeding according to the North Carolina Sedimentation and Erosion Control Manual. Love Grass or Bahia (alone) are not approved vegetation. When mowed to less then six inches, these grasses leave bare, erodible areas. Please do whatever is necessary to establish permanent ground cover that can easily be maintained. This may require the use of sod and/or irrigation. All woody vegetation must be removed from the side slopes ofpond #1. Please be aware that the side slopes of pond #3 have become too steep. If the Landing's HOA does riot feel that these slopes can be maintained, please slope back to 3:1 prior to seeding with the required vegetation.
