Notice of Violation (NOV-2010-DV-0418) Pender County Dear Mr. Walker, An inspection of the Walker Pallet Company Inc. site was conducted on December 13, 2010. This inspection was conducted to investigate a complaint. The inspection resulted in the issuance of a Notice of Violation for operating without a permit for stormwater discharges from the facility. You were requested to apply for the permit. The Division received a notice of intent from you and responded with the issuance of a certificate of coverage NCG210400 on January 21, 2011. Enclosed with this correspondence is a "Compliance Inspection Report". Please note the requirements to monitor your stormwater discharges from the facility. You should begin working on a written Stormwater Pollution Prevention Plan. It is not due until January 21, 2012. Please ensure in the meantime that good housekeeping practices and. best management practices are being exercised at the facility to prevent the pollution of stormwater. The Division has not received a written response to the Notice of Violation. You are required to respond to the notice in writing. Please contact this office immediately if you have any questions concerning this correspondence or the enclosed inspection report. A follow up inspection will be conducted within the next two weeks to ensure the issues on site have been resolved. The owner applied for the permit promptly. Application date 01/11/2011. Mr. Walker received coverage under the NPDES Permit NCG210 on January 21, 2011. The owner responded to the notice of violation by phone. Mr. Walker advised DWQ that the debris in the ditch had been removed and that the oil in the parking area had been cleaned up and disposed of properly. A follow up inspection will be conducted to verify the remedial actions. Permittee is required to respond in writing to this office in accordance with NOV-2010-DV-0418. You should prevent the migration of your product into the surrounding ditches which can convey debris to surface waters. The Stormwater Pollution Prevention Plan (written plan) is due on January 21, 2012. Comment: This site requires the NCG210000 permit for stormwater discharges from the site. The owner was advised to apply for the NPDES Permit. A notice of violation was issued for discharge without a permit. The owner applied for the permit and received coverage on January 21, 2011. The site had debris in the ditches and an oil spill in the parking area that required clean up. The owner was advised in the notice to resolve both issues.
