Subject: Rescission of NPDES General Permit Certificate of Coverage NCG080256 Estes Express Lines Moore County Reference is made to your recent request for rescission of coverage under the subject NPDES General Permit. A request was made from Mike Lawyer, in the Fayetteville Regional Office, that your permit be rescinded. He stated that you have no discernible ditches, pipes, etc. on the property that would collect and direct stormwater or other runoff as a point source discharge. In accordance with your request, NPDES General Permit NCG080256 is rescinded, effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the ' site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. Facility is a terminal where freight is received, off-loaded and reloaded onto appropriate trucks for subsequent delivery. This is all conducted under roof, nothing is stored outside. Vehicle maintenance is performed inside a separate building and there is a large diesel tank with secondary containment and a smaller used oil tank that I was informed is double -walled. There is an outside truck wash area with a trench drain that directs wash and rinse water (as well as stormwater) to a filtration system much like an oil/water separator. This system has an outlet hose that drains the "cleaned" water onto the paved area, which then would flow off the pavement through an area of rip -rap before dispersing through a wooded area. While this type of discharge would disqualify the facility for the No Exposure Certification, there are no discernible ditches, pipes, etc. on the property that would collect and direct stormwater or other runoff as a point source discharge. I am of the opinion that even with the filtration system discharge, runoff from this facility would be considered sheet flow. I should also add that the facility appears to be very well maintained and there was no evidence of any kind of spill or leak both on site or off. I advised Mr. Wellons and am recommending to you that the facility should qualify for permit rescission as opposed to no exposure. They are currently covered under permit # NCG080256. I expressed to Mr. Wellons that upon receipt of this e-mail he should generate and submit a permit rescission request letter to take the place of the No Exposure Certification. If more information about this facility is required, please let me know. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw, material, intermediate product, final product or waste product A storm resistant shelter is not required for the foilming industrial materials and activities: - drums, barrels, tanks, and similar containers that are lightly sealed, provided prose containers are not deteriorated and do not teak. 'Sealed' means banded or otherwise secured and without operational taps or valves; - adequately maintained vehicles used in material handling; and - final products, other than products that would he mobilized in storm water discharges (e.g., rock salt} A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPOES permitting is available on a facility -wade basis only, not for individual outfalls.
