Stormwater Permit No. SW6200204

Dear Mr. Rose:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Permit Application for the subject project on February 25, 2020. A review of that
information has determined that the application is not complete. The following information is
needed to continue the stormwater review:
Based on the information provided with this submittal, this project meets the definition of
"Redevelopment" (15A NCAC 02H .1002(41)). Redevelopment is defined as, "Any land -
disturbing activity that does not result in a net increase in built -upon area and that
provides greater or equal stormwater control to that of the previous development. " Since
the project results in a net decrease in BUA (92,834 sf of total on -site BUA pre -
construction per plan sheet SP1 and 69,676 sf of total on -site BUA post -construction per
plan sheet SP6, which results in a net decrease of 23,158 sf of BUA) and provides equal
or greater stormwater control (Provided through the reduction in on -site BUA and the
inclusion of an infiltration basin). Per 15A NCAC 02H .1001(1)(f), State post -
construction stormwater management rules do not apply to redevelopment projects and
therefore, a post -construction stormwater permit is not required. There are 2 options for
how to proceed:
a. Option 1 — Rescind the State post -construction stormwater permit application
since the permit is not required. NOTE: By law, the $505 permit review fee is
non-refundable (15A NCAC 02H .1042(2)).
b. Option 2 - Get a State post -construction stormwater permit for the site to treat
future BUA associated with Phase 2 of the project. To do this, you will need to
provide quantity and location information for the future Phase 2 BUA. Please
email me if you would like more information on this option.

2. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other
documents. Pdfs must be uploaded using the form at:
https://edocs.deq.nc.gov/Forms/SW Project Submittal
Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to April 30, 2020, or the
application will be returned as incomplete. The return of a project will necessitate resubmittal
of all required items, including the application fee. Please reference the State assigned project
number SW6200204 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
