General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S.
Environmental protection Agency, dated October 15, 2007 (or as subsequently amended.)

The General Perniit authorizes discharges of stormwater only, and it specifies your obligations with respect to
stormwater discharge controls, management, monitoring, and record keeping. Please review the new pennit to
familiarize yourself with all changes in the reissued pennit. Significant changes to the General Permit are
outlined in the attached Technical Bulletin.
Your coverage under the General permit is transferable only through the specific action of DWQ.

SUBJECT: Storm Water Discharge Review
On 4/20/04 a representative of NCDENR, storm water division,
reviewed our program and site with us. We found several issues. The
program description was bound to be inadequate and in need of a major
rewrite. The site was in need of BMP overhaul. There were two areas of
concern for secondary spill containment devices connected to storm water
conveyance system that had manually activated valves which were not
lockable (not inside the fence area). There was a secondary control structure
which had an unsealed penetration through it about 24" from the bottom.
The site housekeeping was in need of major attention.
We have done the following items based on exposure for a spill event
and opportunity to correct:
I) Spill containment devices have been closed and locked with a
closure device and master locks.
2) Control structure has had penetration sealed.
3) One storm sump has been removed.
4) One pipe from the dye house driveway, which ran to a storm drain
with a non -locking valve, has been removed.

5) The pipe from " T3" non -contact water cooling tower to the
concrete pad has been plugged. It will be removed.
6) A lagoon high level alarm has been installed which sounds in the
dye house control room. This will notify operations of an
abnormal level in the lagoon to eliminate spills.
7) We are working to install a flow stop in the storm drain to aid in
isolating any spill.
8) We have updated our spill kit for the fuel oil unloading station with
pads and added booms.
9) We have installed a spill kit at the lagoon area with: drain covers,
pump, extension cord, and water line.
10) We have addressed the tower over spray issue and installed a
back-up high-level pump switch to activate the pump should the
primary switch fail.
1 1) Placed locks on fuel oil unloading station valves.
12) We are continuing the rewrite of our procedures for storm water
and spill control and response.
13) We have removed several loads of scrap metal and continue to
work on that issue.
14) We have reviewed our storm water run ways and corrective action
is continuing in this area also.

Amital Spinning Corp. -Craven County
Dear Mr. Ipock:
Mr. Ed Warren of the Washington Regional Office performed an investigation on
April 2, 2004 of a discharge of partially treated process wastewater from Amital Spinning
Corp. into the storm water system serving this facility, and subsequently into an unnamed
tributary to the Neuse River. According to this investigation, it was determined that
approximately 1000 gallons of process wastewater overflowed your aeration lagoon and
entered a storm drain on the property on March 31, 2004 at approximately 1:00 PM.
-- - You are hereby notified that this discharge is a violation ofNorth.Carolina
General Statutes (NCGS or G.S.) 143-215.1 which requires, among other things, that you
apply for and receive a permit before you "Construct or operate any sewer system,
treatment works, or disposal system within the State". Disposal of wastewater from the
subject facility without first obtaining a permit constitutes a violation of this Statute.
You are advised that NCGS 143-215.6 provides that "a civil penalty of not more
than ten thousand dollars ($10,000) may be assessed by the Environmental Management
Commission against any person who is required but fails to apply for or to secure a
permit required by G.S. 143-215.1, or who violates or fails to act in accordance with the
terms, conditions, or requirements of such permit." NCGS 143-215.6 further provides
that "if any action or failure to act is continuous, the Commission may assess a penalty
not to exceed ten thousand dollars ($10,000) per day for so long as the violation
continues."
