J A N - 3 2007 Subject: Rescission ofNPDES General Permit Certificate of Coverage NCG 100092 Southern Concrete Materials Buncombe County Dear Mr. Jeff Lamm: QUALITY SECTION Reference is made to your recent request for rescission of the subject NPDES General Permit. In your letter received on 9/6/2006, you staled that you do not intend to operate the site as a used vehicle stoarge yard. Asheville regional staff made a visit to the subject site, and verified that the facility is vacant and there are no manufacturing activities occurring. In accordance with your request, NPDES General Permit NCG 100092 is rescinded, effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Enforcement action will be certain for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. Starr and I have confirmed via site visits that the following requests for rescissions are valid: NCG070113 - Asheville Mica Co. in Buncombe County - facility is closed; no remaining exposure NCCt180083 - Broyhill Furniture in McDowell County - facility is closed and has been purchased by Bryant and Young, who do need an NCG21 permit. We delivered NOT so you may expect application. O.K. to rescind Broyhill's permit. NCG100092 - Southern Concrete Materials in Buncombe County - salvage yard of previous owner has not been operational for years; no exposure as all vehicles have been removed. NCG170221 - Shuford Mills, Shurspun in Caldwell County - facility has closed and property is up for sale; no exposure as all stormwater from parking lot drains to property permiter and does not enter streams. The following requests for rescission are denied: NCG210081 - S2S Lumber in Caldwell County - facility has closed and property is up for sale. One fuel tank which contains Fluids remains on -site and lacks secondary containment. ARO recommends that tank be drained and/or removed with proper disposal before rescission of permit is granted. NCG020597 - Cool Springs Quarry in Rutherford County - controversial mining operation has never broken ground however their DLQ mining permit is active until 2012 (confirmed via Judy Weaner of DLQ). ARO recommends denying their recission request until they request and recieve rescission of their DLQ mining permit. Let its know when S2S Lumber indicates that they have complied and ARO will verify fuel tank has been removed. Thanks for soliciting our verifications. The current owner, Mr. Brownie Hyder, converted the salvage yard to a ready -mix facility. No salvage yard activities are now being conducted. There are about 5 old vehicles sitting near the perimeter of the property, which is bermed so that any runoff from the grassed area drains to an onsite stormwater pond. No parts are being sold from the old vehicles, nor are planned for salvage. The site now only functions as a ready -mix facility (NCG140309). Any permittee that has not requested renewal at least I80 days prior to expiration or permittee that does not have a permit after the expiration and has not requested renewal at least 180 drys prior to expiration, will be subjected to enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq. In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). This permit expires on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued coverage under the general permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal legislation has extended the "no exposure exclusion' to all operators of industrial facilities in any of the 1 I categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion.
