Western Materials contacted McGill Associates on December 12, 2006 to coordinate the remediation of the stream impact. McGill Associates scheduled a site visit for December 19, 2006 and after the visit produced a letter, which was delivered to NCDENR-DWQ on December 21, 2006. The December 21, 2006 letter addressed two main points: 1) Western Materials acknowledged that sediment from a stockpile area at their Mission Quarry entered an unnamed branch on their property, and 2) Western Materials will do whatever is necessary to repair the stream. A broad outline of the stream repair work was presented in the December 21" letter, addressing the need to first stabilize the source of sedimentation to the stream and then secondly, listed the tasks needed to do the stream repair work. There was not a sufficient amount of tune by December 21 to address all of the issues presented in the November 29, 2006 Notice of Violation Letter. A follow-up letter on January 16, 2007 from McGill Associates to NCDENR-DWQ listed the dates of the stockpile stabilization work and outlined the steps taken to that point to hire a stream repair specialist. Western Materials has hired Soil & Environmental Consultants, a firm that is experienced and respected on stream repair projects. These impacts include the unauthorized placement of rip -rap and in - stream excavation for installation of a sediment control structure, as well as in -stream sediment deposition in the unnamed tributary to the Hiawassee River. This severe impact has resulted in a stream standard violation. Specifically, 15A NCAC 213 .0211 (2) states that the preclusion of best usage, which includes aquatic life propagation, biological integrity, wildlife, secondary recreation, and agriculture represent a water duality standard violation. Item II. Other Waste (In -Stream Sediment) Impact to the stream has occurred on this tract from mining activates. Specifically; of sediment has been deposited in the streatn as a result of an unstable overburden/pond tailing waste pile. Approximately 2.800 linear feet of stream has been impacted. The stream has an average of 5-6 inches of sediment deposited throughout the length of the tributary. Specifically, 15A NCAC 02B .0211 (3)f states that oils; deleterious substances; colored or other wastes: only such amounts as shall not render the waters injurious to public health, secondary recreation or to aquatic life and wildlife or adversely affect the palatability of fish, aesthetic quality or impair the waters for any designated uses. The facility has a failing overburden storage area. The overburden storage area is failing into the headwaters of an unamed tributary to the Hiawassee River. The tributary is filled with sediment from the overburden pile. The facility has installed a sediment trap in the creek. The overburden pile must be stabilized so that it does not contribute sediment to the creek. Once the overburden pile is stabilized remedial action may need to be taken to return the creek to pre -impact conditions. }' The facility was made aware of the failing overburden pile on June 20, 2006. Mary Stone and Starr Silvis walked the length of the creek from downstream to upstream to determine the source of the sediments:.. Depth of sediment ranged from 5-6 inches deep along the entire length of creek observed. During the June 20, 2006 visit it was observed that dust supression water was flowing directly into the creek. Measures must be taken to prevent this illegal discharge from occuring.
