Upon review of the plan, I have identified some missing items and would like to direct you to address the following: • Please address the maintenance of Pond B (i.e. how often it is cleaned or when it is cleaned). • Please submit a site map that illustrates and identifies the locations of all ponds and outfalls. A hand -drawn map is sufficient, but please include the surface waters to which the outfalls discharge. An indication of disturbed areas and heavily vegetated areas should be included on this map. Any best management practices employed to Keep sediment from disturbed areas on -site should be indicated on the map and described in the best management plan. Note that you may have used a map for your mining permit application that contains ail of this information. Please indicate in the plan the source of any makeup water used in the washing process. Once your plan is completed, be sure to keep a copy of it on -site, along with inspection records of your ponds and other best management practices, a copy of your permit, and sampling records and data. Franklin NC 28734 " Cn I What follows is the BMP (best management plan) for Sheffield Mine: All raw material from mine is washed in a flume using only recycled water and screens. The fine material that passes through the screens is directed by the flumes to a catch pond called Pond A. Between this input and its discharge point are a culvert and vegetation used to filter silt. The culvert leads to an adjacent pond, Pond B, used to recycle the water. During a non- rain period all waters travel from pond A to B through the connecting culvert. During any rain event, runoff from a heavily vegetated area drains into ponds A and B and out of discharge Point # 1. Pond A has the silt cleaned out at it's 50% level of capacity. The material removed is so laden with moisture that it is set aside near Pond C, 40 feet west of pond A, to allow moisture to drain until the material is dry enough to be removed by a contractor. Pond C is used to catch the runoff from the areas that are disturbed. Before the majority of runoff reaches pond C it must pass through a small catch basin a culvert. The catch basin is cleaned out before the material reaches the bottom of the culvert to assist with silt catch. Pond C is also C7 • cleaned out at 50% of its capacity and any excess runoff goes out of discharge Point # 2. A log will be kept and all measurements recorded from water testing will be included in the log along with date of samples, location of samples, and rainfall levels during rain events. All sampling will be taken during business operations which normally occur from April Is' thru Oct 315`. All test results of water samples will be sent to the appropriate agencies as they are obtained. All mechanical equipment owned and operated by the mine have most major repairs performed off premises. During the course of any oil changes that are done on site, the oil is recaptured and taken to a local recycle location. In the event that there is an oil, or oil -like, spill it will be cleaned up and taken to the appropriate disposal center. Oil usage for all equipment averages less than 5 quarts per month. Reporting Part IV (page 9 of 11), Permit NCG02000 requires filing of monitoring reports. Sheffield Mine had not submitted any required monitoring reports. This permit shall be effective from the date of issuance until September 30, 1994, and shall be subject to the following specified conditions and limitations: 1. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans, specifications, and other supporting data. J 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal permit request must be submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of the request will be.considered on its merits and may or may not be approved. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. 6. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited. 10. Freeboard in the settling basin shall not be less than one foot at any time. 11. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Environmental Management or other permitting authority. 14. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site and facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. 15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 16. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6. 17. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 18. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 4 0 • 19. Noncompliance Notification: +� The Permittee shall report by telephone to the Asheville Regional Office, telephone no. 704/251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. C. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not reoccur. 20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Sheffield Mine Macon County FOR THE continued operation of a 90,000 GPD recycle system consisting of a settling basin, dual 150 GPM recirculation pumps, approximately 150 linear feet of 2-inch force main, and a water storage pored to serve the Sheffield Gem Mine with no dis:;harge of wastes to the surface waters, pursuant to the application received July 24, 1989 and in conformity with the project plan, specifications, and other supporting data subsequently filed and approved by the Department of Environment, Health and Natural Resources and considered a part of this permit. This permit shall be effective from the date of issuance until September 30, 1994, and shall be subject to the following specified conditions and limitations: This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans, specifications, and other supporting data. 2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of the Permittee,- a formal permit request must b.-- submitted to the Division of Environmental Management accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of the request will be considered on its merits and may or may not be approved. 5. In the event that the facilities fail -to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. 6. The sludge generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a manner approved by the North Carolina Division of Environmental Management. 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 8. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. 9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited. 10. Freeboard in the settling basin shall not be less than one foot at any time. 11. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log ;�;f inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Environmental Management or other permitting authority. 14. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the disposal site and facility at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. 15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4). 16. , Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6. 17. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 18. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone no. 704/251-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. C. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility has gone out of compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not reoccur. 20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. W W —4 I - - ti = LL THE MINE WITH A DIFFERENCE After leaving the asphalt road, you will travel half a mile on a gentle mountain road to reach the mine. After parking in the spacious area under the trees, you'll descend the mine's excavated walls by stairway or footpath, admiring ferns and wildflowers along the way. You'll sit at the sluice line at the bottom of the hollow amid a beautiful forest of deciduous trees and listen to the symphony of the wilderness. . . bird songs and chirps, cooing doves, "Bob White" calls of the quails, with bass notes provided by the frogs that live in the ponds nearby. The forest's chorus will be interrupted occasionally by the noise of gasoline powered pumps to refill the upper pond, (otherwise no noise makersi are allowed). We recirculate water in the ponds thru the sluice, complying with environmental regulations effective July 1, 1981. As you wash the clay from the stones, you will enjoy both sunshine and shade as the sun moves across the sky, but it is the sun which lights up the gemstones in your screening tray. In any case, we are very happy to assist you in identifying the gems. And of course, we fur- nish the equipment you'll need. Mother Nature placed the gemstones in beds of clay where they have remained undisturb- ed for perhaps millions of years until we excavated them from the hill and shoveled the gem - bearing clay into buckets from which you work ... maybe a little harder than in the creek -bed mines of the valley. Our gemstones look different, too. They appear in all sizes and shapes including the typical hexagonal form and in all colors from pink to dark red and purple. They most likely will have a rough coat, which has not been tumbled away in a creek, but at least one shim- mering surface or corner will signal your watchful eye to "Take me home with you." A cut and polished Sheffield gem is not only beautiful, it's distinctive. Please plan to spend a day or two with us. It will be a rewarding experience. We are open daily 8 a.m. to 5 p.m. from April 1 to October 31.
