Nash County Dee Freeman Secretary On March 20, 2008, the Division of Water Quality received your request to rescind you coverage under Certificate of Coverage Number NCG020145. In accordance with your request, Certificate of Coverage Number NCG020145, under NPDES General Pert -nit NCG020000, is rescinded, effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential need for NPDES permit coverage. The borrow pit mine is located out of the 100 year flood plain. There is a detention pond with sufficient storage for controlling the 25 year storm event. Therefore the Raleigh Regional Office recommends the granting of the general stormwater permit NCG020145 to S.T. Wooten Corporation. I think Jimmy is trustworthy, and it very well may be that he sent us a rescission request that fell in a crack somewhere up here. But, as far as we know, we have no prior paper on this rescission request. Sarah now has a copy of the March 14 request from Jimmy. There is no specific DWQ rescission form. We typically just ask folks to send us a letterhead communication that requests rescission. So, no, now that we have a copy of the March 14 request, we need no other communication from Jimmy. It's true that Jimmy may have jumped the gun by ceasing monitoring without finalization of the rescission. However, my impression of your visit is that the site is ok. And, given the possibility that we may have delayed processing his request by losing the original paper, unless you have contrary feelings, my opinion is that this is a case of, "No harm, no foul", and that we should consider that the appropriate DWQ action is simply to grant the rescission. My feelings would change if your opinion is that the site is a water quality risk as of today. Contrary feelings? Ken Dave Parnell wrote: Good Morning Ken, I met with Jimmy Washburn of ST Wooten at Williamson Pit, outside of Sims in Nash County. He did not have records of monitoring and assumed the permit had been rescinded. He e-mailed me a letter he had sent on March 14 to Stormwater and General Permits Unit requesting the rescission. The site now is a contained water body that has no apparent discharge. No mining appears to have taken place in some time. The vegetation is fairly well established indicating no recent activity. The road into the pit drains back from the state road back into the pit, no offsite discharge from it. Is their rescission in the works or does he need to fill out a form rather than send in a letter. Not having monitoring data will not give them a very good inspection result, so I am waiting to hear from you before going into BIMS. The access road drains back into the pit/pond. I concur that the rescission should go forward. I will take this under consideration while filling out the CEI forms.
