(Pilot) is pleased to submit this report of the stream/wetland determination for two drainage swales located on a property southwest of South Jim Minor Road in Mebane, Alamance County, North Carolina. Background Wetlands are defined by the United States Army Corps of Engineers (USACE) and the United States Environmental Protection Agency (EPA) as "those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions." In order for an area to be classified as wetland, hydrophytic vegetation, hydric soils, and wetland hydrology indicators must be present. Section 404 of the Clean Water Act (CWA) regulates the discharge of dredge and fill materials into waters of the United States (lakes, rivers, ponds, streams, etc.), including wetlands. Waters of the United States include the territorial seas, navigable coastal and inland lakes, rivers and streams, intermittent streams, and wetlands. The EPA and the USACE jointly administer the Section 404 program. Section 401 of the Clean Water Act grants each state the authority to approve, condition, or deny any Federal permits that could result in a discharge to State waters. Jurisdictional features include wetlands, open waters, ponds, lakes and perennial/intermittent streams. Jurisdictional features are regulated by the USACE and North Carolina Department of Environmental Quality -Division of Water Resources (NCDEQ-DWR). Permits are required priorto impacting any jurisdictional feature. The type of permit required is specific to the type, location and amount of impacts. Stormwater management plans and/or mitigation for proposed impacts could be a requirement of the permit approval process. Changes including, but not limited to, regulations, weather, timber/vegetation removal and usage/development of the site or nearby properties can alter the findings and opinions presented in this report. We recommend that this report only be used for preliminary planning purposes. Agency verification(s), followed by a survey of jurisdictional features, are required to determine the exact extent and locations of jurisdictional features and are valid for a period of up to five years following issuance of a USACE Jurisdictional Determination (JD) and/or NCDEQ-DWR Site Determination Letter. Scope of Services Pilot was contracted to perform a stream/wetland determination for two drainage swales located on a property southwest of South Jim Minor Road in Mebane, Alamance County, North Carolina. The drainage swales are located on the parcel identified on the Alamance County Geographic Information System (GIS) as parcel identification number (PIN) 9802589583. The scope of services included a determination of jurisdictional features (streams, wetlands and other surface waters) within the drainage swales. Literature Review We reviewed the U.S. Geological Survey (USGS) Topographic Map and the U.S. Department of Agriculture (USDA) Soil Survey of Alamance County. • The USGS Topographic Map (Drawing 1) does not depict surface waters or wetlands within the drainage swales that were evaluated during this study. Haw Creek and an unnamed tributary to Haw Creek are located immediately down -gradient of the drainage swales. • The Published Soil Survey of Alamance County (Drawing 2) depicts an unnamed tributary to Haw Creek and wet areas within the southern drainage Swale. Features are not depicted in the northern drainage Swale. Field Determination Pilot conducted the site visit on August 23, 2019. The areas evaluated include two drainage swales that contain wooded land. Ponds, streams and wetlands were not observed within the drainage swales. The drainage swales contain erosional features that are vegetated with low- lying herbaceous species, including Japanese stilt grass. Hardwood trees and saplings were observed in several areas within the base of the Swale. The soils within the features are bright and appear well -drained. Neither standing nor flowing water was present. Based on our observations, the drainage swales do not contain jurisdictional streams or wetlands subject to regulation by the USACE or NCDEQ-DWR. An NCDEQ Stream Identification Form, documenting iA Wetland Determination Pilot Project 5090 August 26, 2019 our observations that streams are not present, was completed within the southern Swale (the larger Swale where stream is depicted on the USDA Soil Survey). Streams were observed immediately down -gradient of the evaluated swales. Drawing 3 shows the approximate locations of the adjacent streams. Watershed Classification According to the NCDEQ-DWR, the site is located in the Cape Fear River Basin. Back Creek and an unnamed tributary to Back Creek are located immediately down -gradient of the drainage swales that were evaluated. The NCDEQ-DWR has classified Back Creek, the receiving waters of the drainage swales, as WS-V; nutrient sensitive waters (NSW). Additionally, the site is located in the Jordan Lake Watershed. State regulated riparian buffers are required adjacent to intermittent and perennial streams as depicted on the most recent versions of the USGS Topographic Map (Drawing 1) and the last published USDA Soil Survey (Drawing 2). A stream is depicted within the southern drainage Swale that was evaluated on the last published USDA Soil Survey (Drawing 2). Based on our observations, a stream is not located within the drainage Swale. A buffer determination by the NCDEQ-DWR or local designated buffer authority is required since there is a discrepancy between USDA Soil Survey and that observed in the field. The streams located immediately down -gradient of the evaluated drainage swales are depicted on Drawings 1 and 2 and were observed during our site visit. These streams are subject to state regulated riparian buffer requirements. Additionally, consultation with the local zoning authority is recommended to determine local buffers/stormwater setback requirements. Summary Pilot has completed a stream/wetland determination on the site. Pilot has prepared the necessary submittals to request concurrence by the NCDEQ-DWR. The determination is based on our field observations and is subject to change during verification(s) by the regulatory agencies.
