The following items were requested: 1. Provide proof, such as copies of the signed return receipts from certified mail, that the new adjoining landowners and county manager have been properly notified. Please see Attachment 1 — Copies of the certified mail receipts. 2. Provide more detailed information regarding the proposed pumping of the settling basin and the discharge form the basin, including a construction detail for the basin (as well as its inlet and outlet). Explain how the basin will function without being short circuited, as the inlet and outlet are in close proximity to one another. Please see the revised Mining Plan (Attachment 2), which depicts a baffle has been incorporated into the design of the settling basin. Also, you will find, for your records, a copy of the sediment basin design calculations, which were prepared by Tripp Engineering. 3. Please contact Linda Willis with DWQ, to discuss permitting requirements and additional information required to process your NPDES application. An O&M Plan may also be required by the DWQ. It it is, please provide a copy of your approved O&M Plan to this oifce as well. An O&M Plan has been provided to the DWQ (see Attachment 3). This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for mine dewatering at facilities near wetlands can be found in Part 111, Section E of your permit. You must have an approved Operation and Monitoring Plan before mine dewatering discharges occur at your facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit. Please note that mine dewatering wastewater includes wet pit overflows caused solely by direct rainfall and groundwater seepage for this type of mining operation. Any discharge of this water (and any stormwater commingled with it) is subject to the effluent limitations in this permit. This general permit allows the discharge of stormwater and certain types of wastewater from your facility. In your application, you specified that only mine dewatering water would be discharged from this facility. If separate point -source discharges of stormwater occur (i.e., stormwater not combined with mine dewatering water), you will be required to adhere to the conditions in this permit for stormwater discharges.
