Vulcan discharges both process water and stormwater under the permit through outfalls 001 (mine de -watering) and 002 (stormwater discharge). Part IV, Section D of the permit requires Vulcan to sample the following parameters on a semi-annual basis, unless an effluent limit in Permit Table 8 is exceeded, at which point, sampling frequency must return to quarterly until all results are below the effluent limits for four consecutive quarters are below the effluent limits: Parameter Limits Units Turbidity NIA — See note l NTU TSS No limit — See note 2 m /I H 6.0 — 9.0 Standard Units No effluent limit for turbidity applies, but turbidity in the receiving waters shall not exceed the appropriate water quality standards listed in the permit (See Pen -nit language following Permit Table 8). Exceedances of the water quality standard in the effluent sample are not considered an exceedance of an effluent limit; but rather, require the facility to commence sampling of turbidity in the receiving stream, both upstream and downstream of the effluent outfall, in addition to the effluent, upon the next monitoring period (See Permit Table 7, footnote 3). Vulcan is required to sample TSS but is not subject to the TSS limitations in Permit Table 8 since it is not an Industrial Sand Mine and does not discharge to a HQW, ORW, HQW/ORW Trout, or PNA water (See Table 7 footnote 5 and Table 8 footnote 2). Vulcan performed sampling of its mine de -watering outfal1 001 on September 17, 2018, immediately after the storm effects of Hurricane Florence passed through the area of the facility. As a result, the turbidity in the sample was reported as 86.6 NTU, a value significantly higher than normal and in excess of the receiving water quality standard of 50 NTU (See Attachment 1 for the analytical results for this sample). Again, we believe that the higher than normal value was a direct result of the historic rainfall that had occurred in the days prior to the sample being taken and was not representative of normal mine pit de -watering activities. Therefore? Vulcan-requests_that the-DEQ_allow Yu_ lcanto_disregard th"e sample taken at the -ends of the-HurrieaneFlofence event-(Septemberl7, 2018) and use the October 5, 2018 sample_as_its semi-annual sainple result._ C__. __ ---_ - - In addition, as detailed under the "Monitoring for Mine Dewatering and Authorized Process Wastewater Discharges" section of the permit (See Part IV, Page 10 of 12), the permit requires that "Sample results that exceed an effluent limitation must be submitted to the Regional Office no later than 30 days from the date that the facility receives the sample result and the results be included in a DMR. However, as detailed in the language following Table 8, "This General Permit requires the measurement of turbidity in the permittee's discharge but does not impose a turbidity effluent limit." In addition, Permit Table 7, footnote 3 reads as follows: "Turbidity must be monitored at the effluent (E). If effluent levels exceed the Water Quality Standard of the receiving water, the permittee must begin sampling turbidity directly upstream (U) and downstream (D) of the effluent outfall..., in addition to the effluent, upon the next monitoring period." Based on our review of the permit, -we do not believe that the September 2018 turbidity sample iresult of 86:6-_NTU represented an exceedance of an -"effluent limit" -of the=permit and -therefore, Vulcan is not necessarily required to report'this result "within 30 days.'' During the investigation it was learned that a sediment basin had failed approximately 60 days prior to this inspection and impacted a tributary downstream of the property. Please be advised that G.S. 143 -215.6A provides for a civil penalty assessment of not more than twenty-five thousand dollars ($25,000.00), against any person who is required but fails to act in accordance with the terms, conditions, or requirements of such permit.- Penalties may also be assessed for any damage to the surface waters of the State that may result from the above violations. NCG020000 CERTIFICATE OF COVERAGE No. NCG020172 STORMWATER AND PROCESS WASTEWATER DISCHARGES NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM In compliance with the provision of North Carolina General Statute 143-215.1, other lawful standards and regulations promulgated and adopted by the North Carolina Environmental Management Commission, and the Federal Water Pollution Control Act, as amended, VULCAN CONSTRUCTION MATERIALS, LP is hereby authorized to discharge stormwater and to operate or continue operation of treatment systems and discharges associated with mine dewatering and process wastewater from a facility located at VULCAN CONSTRUCTION MATERIALS, LP - CABARRUS QUARRY POPLAR TENT CHURCH ROAD CONCORD CABARRUSCOUNTY to receiving waters designated as Coddle Creek in the Yadkin - Pee Dee River Basin in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, I1, III, IV, V, and VI of General Permit No. NCG020000 as attached. This certificate of coverage shall become effective February 22, 2000. This Certificate of Coverage shall remain in effect for the duration of the General Permit.
