Crutchfield Timmons Group 610 East Morehead Street, Suite 250 Charlotte, NC 28202 NORTH CAROLINA Environmental Quality October 3, 2019 Subject: Request for Additional Information Stormwater Permit No. SWA000056 Training Area Shelter for Union County Sheriffs Office Union County Dear Mr. Crutchfield: The Division of Energy, Mineral and Land Resources (DEMLR), received a Fast Track Authorization to Construct (ATC) Permit Application for the subject project on September 4, 2019. A review of that information has determined that the application is not complete. The following information is needed to continue the stormwater review: 1. This site was previously permitted under SW3160203. Is this Fast Track ATC intended to cover the same built upon area (BUA) and stormwater system permitted under SW3160203 or is this project an addition to what was constructed under SW3160203? 2. Please update the application to address the following deficiencies: a. Section C, Part 1 of the application lists the application as replacing a previous Fast Track ATC. The previous permit was permitted under the standard process and is not a Fast Track ATC. Therefore, the project shall be considered a major modification to the existing permit. b. Section C, Part 3 of the application lists the existing permit, SW3160203, as an NPDES Industrial Stormwater permit. The existing permit is a post -construction permit, not an industrial permit. Please remove this from this section. c. Section D, Part 1 requires the name and title of the signing official for Union County. Please add this information and their contact information. d. Section E: i. Please provide a brief description of how stormwater will be handled on the site (Part 2). ii. Please provide the drainage basin that the project drains to. The appropriate drainage basin can be found using our Watershed Drainage Area Map (Part 3). Please provide the receiving water information (Part 4). This information can be found using our Waterbody Classification Map. iv. Please update Part 5 to include the following information: 1. The total surface water area. The submitted plans show surface waters on site but no surface water is listed on the application. 2. The application lists the existing BUA as 85,720 sf. Is this BUA associated with the previous permit (SW3160203) or is this BUA that existed when the previous permit was issued? Any BUA constructed under SW3160203 does not meet the definition of existing BUA and cannot be excluded from the density calculations. 3. The project density is defined as the total built upon area divided by the project area, not the property area. Based on the provided project area of 172,062 sf, this project would not meet the low density threshold of 24%. v. If the development permitted by SW3160203 has been completed, a designer's certification is required as part of the application. 3. Please note that the Division does not perform a complete technical review for Fast Track ATC applications. However, as a courtesy, I performed a cursory review of the plans and it is my opinion that when constructed this project will not meet the low density requirements to minimize the use of piping. Piping is permitted on low density developments only for erosion control or culverts under roads and driveways. Connecting to an existing collection system does not meet the intent of the low density regulations to prevent concentration of stormwater flows. I would strongly encourage that the design of the stormwater system is reconsidered prior to construction. 4. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, and 1 hardcopy of other documents. Pdfs must be uploaded using the form at: https:Hedocs.deq.nc.gov/Forms/SW ProjectSubmittal Please note that this request for additional information is in response to a preliminary review. The requested information should be received by this Office prior to November 2, 2019, or the application will be returned as incomplete. The return of a project will necessitate resubmittal of all required items, including the application fee. Please reference the State assigned project number SWA000056 on all correspondence. If you need additional time to submit the information, please submit your request for a time extension to the Division at the contact below. The request must indicate the date by which you expect to submit the required information. The Division is allowed 90 days from the receipt of a completed application to issue the permit. The construction of any impervious surfaces, other than a construction entrance under an approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject to enforcement action pursuant to NCGS 143-215.6A.
