This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Please take notice that this certificate of coverage is not transferable except after notice to the Division of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the certificate of coverage. Please be aware that mine dewatering at your site has the potential to impact adjacent wetlands. The specific requirements for thine dewatering at facilities near wetlands can be found in Section C, Part I of your permit (Part III Page 5 of 9). You must have an approved Operation and Monitoring Plan before mine dewatering discharges occur at your -facility. Discharging mine dewatering wastewater without Plan approval will be subject to enforcement action. An Operation and Monitoring Plan for your facility must be submitted to the Wilmington Regional Office within 60 days of your receipt of this permit certificate of coverage. Please submit this package to the attention of Linda Willis. Your Operation and Maintenance Plan must show that your facility is able to comply with State regulations. It should include the following actions: • Delineate wetland boundaries (including flagging). • Place monitoring wells within the wetland boundary adjacent to the mine site and monitor monthly. Make monitoring records available for review by the Division upon request. • Discontinue mine dewatering immediately if treated wastewater flowing over the level spreader causes channelization. Mine dewatering will not resume until the level spreader design is evaluated and corrective measures are put in place to ensure the discharge will leave the site by sheet flow. Vegetative cover must be re-established before dewatering resumes. Mine Dewatering can only resume when authorized by the Division of Water Quality. • Allow no point source discharge from the mine for any treated wastewater. Stormwater should be directed into the pit and should be unable to leave the site as a point source discharge. - • No unauthorized impacts to wetlands will occur. Mine dewatering will cease if immediate and effective measures are unsuccessful at resolving the impacts. Dewatering can only resume when authorized by the Division of Water Quality. This site will discharge to a receiving stream designated as High Quality Waters (HQW) and a Primary Nursery Area (PNA). As a result, a more stringent TSS limit and wastewater discharge volume applies. A supplement sheet is attached outlining the effluent limitations that apply to this discharge and are based on the requirements in the North Carolina Administrative Code Section 15A NCAC 213.0224. (I could send it as it is, but would like to get it to you as close to complete as possible- you're busy enough, so I'd hope to minimize your work as best I can.) First, if you've had any dealing with the USACE on the site, that would be information we need to include in the NOV. I believe Kelly said she didn't think they'd contacted them or had any permits from them, but want to be sure about that. Because we're dealing with wetlands, the Corps will need to be involved anyway. From what Kelly described, I think we can cite the following violations: • Wetland Standards-- hydrology alteration via excavation and a series of ponds/pipes/ditch(es) + fill in wetlands from sidecast spoil from pond excavation • Stream Standards (Removal of Use)-- stream drained on the south property • Failure to Secure a 401 WQC-- (unless you've -heard otherwise from the Corps about a 404?) • Failure to Secure a Permit (Illicit Discharge)-- dug ditch that conveys freshwater drained from wetlands directly to stream, impacting protected saltwater nursery area If you could get back with me to be sure I've got the general grasp and have the pertinent details correct, that would be great. We have had an application for a sand mine from Keith Ludlum (Ludlum Sand Mine), Linda Willis & I went down last week to check out the site. As it turns out, it had been a wetland at one point. They have now dug a series of ponds and ditches to drain it. The site is small (---4.5 acres), but the developer dug a ditch from his system of ponds to a natural stream. I have some pictures and a map. Linda is plamning to send them an NOV. This is further complicated because it drains to Primary Nursery Area waters. So, on top of the normal concerns about draining the wetland and sediment accumulation in the stream, Fish and Wildlife also has concerns about altering the salinity of the water being changed by discharging fresh water at all. (I'll have to talk to Bradley about that). It is just a nasty site. Do you have some time to get together and look at the pictures? Danny mentioned that you have a consistency meeting tomorrow & that Linda may be there. I will be out for grad school this afternoon, but I am in until 11:30 today. The query screen in BIMs says it was issued on December 6, 2006 "statutory". How does that happen? Is this an automatic thing? Their mining permit application calls it a new mine. However, this is an existing mine developed in the last year (with problems) and without anyone's permit. The site already has a lot of problems as indicated by Julie Dorr (DLQ) pursuant to an inspection she conducted December 28, 06. The mine discharges through pipes to surface waters that are HQW, SA, PNA and should not be able to do so under an NCG permit because our permit does not provide strict enough limits to meet 10 mg/L. The buffers between the mine and surface waters do not exist. They should not be in operation as we speak, as far as I can tell. There are problems at this site that need resolving before I would sign off on an O&M plan.' This mine was developed without permits (curs or DLQ's mining permit). I am not inclined to approve anything they propose right now until the existing issues out there get resolved. Their O & M plan, submitted by Norris Kuske & Tunstall do not even mention the discharge pipes on site and the fact that they've already blown their buffers. Julie has pictures that showed filling in what she believes to be wetlands from their discharge. How about some input on where to go on this one. . . and help me understand how they got the NCG without due process? Any impact to the surrounding wetlands will be monitored through two (2) monitoring wells placed along the boundary of the mine and wetlands (see plans). 2. Two (2) stilling basins with level spreaders will mitigate the mine dewatering wastewater. These basins are located along the edge of the wetland boundary. The extracted water will sheet flow through the vegetated buffer into the wetlands. This water will continually recharge the wetland area. 3. All swale and buffers will be required to maintain a vegetated cover over their entirety. 4. The vegetated buffer strip below the level spreader is required to be inspected monthly for evidence of concentrated flow. If concentrated flow is found to exist it will be corrected and new vegetation established. 5. Any accumulated sediment shall be removed from the stilling basins annually or when the minimum storage depth reaches three feet. 6. The entire site is cleared and grubbed. stockpiles of topsoil, debris from clearing, and sand exist on site. Due to the grading activity the topography oa site is different than indicated on the mine map. There is also an area that has been excavated ith water standing in it. Where wetlands are indicated on the mine maplon the south end) there is actually standing water/a pond as well. The proposed SD' min. buffer along the south end of the site is actually a graded berm (recently hydra seeded) with l CaP culverts. One CPP culvert drains water from the existing pond from the excavated area into the ^Het:ands"/Pond. Another drains a ]ow area of the site into the -wetlands"/pond, while the third CPA culvert drains what appears to be a stream that runs through the site and into the "wetlands"/pond- This stream/ natural drainage way is not indicated on the mine map -however the culvert may he indicated with this symbol --- Also be aware that this site is located in a HOW zone. The entire site is cleared and grubbed, stockpiles of topsoil, debris from clearing, and sand exist on site. Due to the grading activity the topography on site is different than indicated on the mine map. There is also an area that has been excavated with water standing in it. Where wetlands are indicated on the mine map(on the south end) there is actually standing water/a pond as well. The proposed 50' min, buffer along the south end of the site is actually a graded benn (recently hydra seeded) with 3 CPP culverts. One CPP culvert drains water from the existing pond frorn the excavated area into the "wetlands"/pond. Another drains a low area of the site into the "wetlands"/pond, while the third CPP culvert drains what appears to be a stream that runs through the site and into the "wetlands"/pond. This stream/ natural drainage way is not indicated on the mine map- ho�vever the culvert may be indicated with this symbol Also be aware that this site is located in a I-IQW zone.
