Based on Jenny Graznak's site inspection on August 2, 2012, we are approving this request. In accordance with 40 CFR §122.21(g) (7), you are authorized to sample Outfall 1 and Outfall 3 as the representative outfalls. This approval is effective with the next sampling event. However, this approval is contingent on the following requirements: (1) All outfalls, regardless of representative status, must have a cleared path and the right of way to the outfall must be properly maintained. (2) The permit still requires Qualitative Monitoring be performed at all Stormwater Discharge Outfallsregardless of representative status. In addition, please remember that any actions you initiate in response to benchmark exceedences as directed in the tiered response provisions of your permit must address all drainage areas represented by the Outfall 1 and Outfall 3, where appropriate. DWQ may grant Representative Outfall Status if stormwater discharges from a single outfall are representative of discharges from multiple outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply. If Representative Outfall Status is granted, ALL out are still subject to the qualitative monitoring requirements of the facility's permit —unless otherwise allowed by the permit (such as NCG020000) and DWQ approval. Representative Outfall Status Request 4) Detailed explanation about why the outfalls above should be granted Representative Status: (Or, attach a letter or narrative to discuss this information.) For example, describe how activities and/or materials are similar. The drainage areas for outfalls 1_ and 5 will store processed (coarse ground) wood, though the area served by utfall 5 will not be -used regularly to store mulch, so outfall 1 will be more representative of these areas. The drainage areas for outfalls 2 through 4 constitute the entire treatment and processing, area (1.2.17_acres), where raw feedstocks will be separated and stored. Feedstocks will include land -clearing debris (stumps, trees, limbs,), untreated and unpainted wood waste (excluding dimension lumber), uncontaminated pallets (owner -generated only), uncontaminated soil, and storm debris. There will be no "treatment" though this is a term used to characterize a class of non -disposal _ solid waste facilities by the NC Div. of Waste Mgmt. "Processing" is limited to separating wastes, removing - soil, and occasionallygrinding the wood wastes togenerate mulch. The princling occurs on the area � perimeter and the ground wood is then relocated to the other areas. Outfall 2 drains a smaller area than OF3 and OF4 captures mostly access road -drainage. 5) Certification: North Carolina General Statute 143-215.6 B(i) provides that: Any person who knowingly makes any false statement, representation, or certification in any application, record, report, plan, or other document filed or required to be maintained under this Article or a rule implementing this Article; or who knowingly makes a false statement of a material fact in a rulemaking proceeding or contested case under this Article; or who falsifies, tampers with, or knowingly renders inaccurate any recording or monitoring device or method required to be operated or maintained under this Article or rules of the [Environmental Management] Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may include a fine not to exceed ten thousand dollars ($10,000). I hereby request Representative Outfall Status for my NPDES Permit. I understand that ALL outfalls are stilt subject to the qualitative monitoring requirements of the permit, unless otherwise allowed by the permit and regional office approval. I must notify DWQ in writing if any changes to the facility or its operations take place after ROS is granted that may affect this status. If ROS no longer applies, I understand I must resume monitoring of all outfalls as specified in my NPDES permit. You assume all risk of use. http://www.mapquest.com/print?a=app.core.f064fOd8eac6d260faO54dab 11/16/2011 Pickle, Ken From: Pickle, Ken Sent: Wednesday, May 30, 2012 12:43 PM To: 'Mark Taylor' Cc: Bennett, Bradley Subject: RE: Carolina Resource Recovery NCG210421 Hi Mark, Summary: Yes, SPPP implementation must be completed within one year from the COC, or February 2013.* OK, here's how I recall their history, and how I see the timing of the SPPP implementation: a) Permit requirement: I note that Part III Section Al of NCG21 requires existing facilities to have a SPPP in place within 12 months; but requires new facilities (as well as facilities previously permitted under NCG21) to have a SPPP in place prior to discharges from the industrial activity, bjQuestion: Now in 2012 upon rectifying the proper permitting both for DWM (from compost + LCID, to T&P for mulch or boiler fuel), and for DWQ (from landfill, to timber products), the question becomes for me is this an existing site, or a new site. c) Background: The site was previously mis-permitted as an NCG12, and did not have a requirement for an SPPP. I think it's your interpretation that the mismatch between the site activities and the actual DWQ permit came about, at least in part, from the permittee's expectation of developing two businesses that never materialized. (Composting and LCID landfilling). We permit people all the time based on their expectations of a business. It doesn't happen very often that the business never materializes, but it did in this case. Under NCG12 in 2000 when this site was permitted there would not have been o requirement for on SPPP. d) So, no SPPP was required under the mismatch of the NCG12 permit, and this is a facility that has been operating for years. It sounds to me like the common-sense approach here is -to consider that this site is an "existing" site for the purposes of NCG21, and that the SPPP must be implemented within 12 months, as per the permit boilerplate. e) *Caution: Mark, please note that only the written SPPP itself is eligible for the 12-month delay. All other Provisions of__the permit are effective immediately as of the date of the COC. 1 mean, Carolina Resource must sample, must report sample results, must respond via the Tiered structure of the permit, etc., all as of the effective date of February 1, 2012. We also intend to request Representative OutfalI Status for the new permit coverage, but that application is required to be directed to the DWQ Raleigh Regional Office.
