It appears the "Non -Exposure Applicaton" was submitted in error and that the request should have been for 'Representative Outfall Status" in hopes of reducing the required monitoring locations. Many of the basins that are currently required to be monitored have had no industrial flow for several years and they would Ike to remove them from monitoring. The only issue noted is that the facility is currently in "Tier II" monitoring because of elevated results for certain parameters at three sample locations. NCDEQ would prefer that the cause of elevated samples be determined and corrective action take place to bring results back into the required parameters before "RO Status" is issued. Once the "RO Application" is submitted, a full inspection will take place to review all records and monitoring data. At that time, Analytical monitoring locations may be reduced dependent on results of past sample data. A condition of no exposure at an industrial facility means all industrial materials and activities are protected by a storm resistant shelter (with some exceptions) to prevent exposure to rain, snow, snowmelt, andlor runoff. For permitted facilities in North Carolina, DEMLR must approve your application for No Exposure Certification before this exclusion is effective. Until you are issued a No Exposure Certification and your NPDES permit is rescinded, your facility must continue to abide by the terms and conditions of the current permit. Industrial materials or activities include, but are not limited to: material handling equipment or activities, industrial machinery, raw materials, intermediate products, by-products, final products, or waste products. Material handling activities include the storage, loading and unloading, transportation, or conveyance of any raw material, intermediate product, final product or waste product. A storm resistant shelter is not required for the following industrial materials and activities: drums, barrels, tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak. "Sealed" means banded or otherwise secured and with locked or non -operational taps or valves; adequately maintained vehicles used in material handling; and final products, other than products that would be mobilized in stormwater discharges (e.g., rock salt). A No Exposure Certification must be provided for each facility qualifying for the no exposure exclusion. In addition, the exclusion from NPDES permitting is available on a facility -wide basis only —not for individual outfalls. if any industrial activities or materials are, or will be, exposed to precipitation, the facility is not eligible for the no exposure exclusion. The Commission is submitting this Work Plan to maintain compliance with the general stormwater permit and document the planned compliance actions for the facility. The stormwater samples for the first semi-annual compliance period were collected on March 27, 2015 and April 20, 2015. Of the eleven outfalls at the facility, ten had available flow to sample on these dates; Outfall 8 was not sampled during the second semi-annual event. Based on the analytical data, the permit benchmark value for fecal coliform was exceeded at Outfall 4, Outfall 5, Outfall 7, and Outfall 11. The stormwater samples for the second semi-annual compliance period were collected on November 9, 2015. Of the eleven outfalls at the facility, ten had available flow to sample on this date; Outfall 11 was not sampled during the second semi-annual event. Based on the analytical data, the pen -nit benchmark value for fecal coliform was exceeded at Outfall 1, Outfall 2, Outfall 4, Outfall 5, Outfall 6, and Outfall 10. Sgrrsour Based on noted wildlife activities in the vicinity of multiple site ponds, and the absence of other compliance issues, it is likely that the fecal coliform exceedances are unrelated to landfill activities (see attached photographs). Recent fecal coliform benchmark exceedances for Pond 2, Pond 4, and Pond 5, which are located adjacent to closed landfill areas, serve as additional evidence that the fecal coliform exceedances are unrelated to landfill activity. Therefore, we respectfully request that the monthly monitoring requirement under Tier Two be waived until the completion of activities contained within this Work Plan. The Commission has completed the first requirement of Tier One of Permit No. NCG120034: "Conduct a stormwater management inspection of the facility within two weeks of receiving sampling results." We have prepared this Work Plan to address these benchmark value exceedances in accordance with the additional Tier One requirements. Specifically, the purpose of the Work Plan is to "identify and evaluate possible causes of the benchmark value exceedance(s)" and "identify potential, and select the specific improvements to reduce concentrations of the parameters of concern, or to bring concentrations within the benchmark range." The Work Plan is also designed to meet the Tier One requirements to "implement the selected actions within two months of the inspection." The implementation of the Work Plan is dependent upon the occurrence of a qualifying storm event during non -holiday hours that a laboratory can receive samples within holding times, which may not occur within the required two -month period. The Commission will strive to complete these assessment activities in a timely manner and prior to the first semi-annual compliance sampling event for 2016. The details of the Work Plan are presented below. Work Plan As noted in the attached correspondence, several ponds at the facility are not located in areas of recent or future landfill activity. As shown on the attached figure, Pond #2, #3, #4 and #5 receive stormwater runoff from closed landfill areas and/or haul roads that are no longer in use for primary traffic. Therefore, the Commission is requesting that Pond #2, #3, #4, and #5 be removed from the compliance monitoring network and receive "no -exposure" certifications as requested in the attached correspondence, and therefore no additional compliance actions are recommended for these ponds. The Commission will obtain additional non-compliance samples and conduct analysis for the constituents of concern from several sampling locations in an effort to isolate the potential source(s) of constituents of concern. To address the fecal coliform issues, the following samples will be collected. We propose to sample the sediment ponds associated with Outfall 1, Outfall 6, Outfall 7, Outfall 10, and Outfall 11 for analysis of fecal coliform at a time that does not coincide with a stormwater event, to help evaluate the effects of standing water in the ponds during non - storm periods. Also, upstream and downstream samples will be collected along three site drainages and creeks as shown on Figure 2, which correlate with sampling locations specified in the facility's solid waste permit (i.e., upstream point SW -I, and downstream points SW-2, SW-3, and SW-4). These samples will be used to help determine the background concentrations in surface water features and evaluate the potential contributions of the on -site outfalls to the concentrations of constituents of concern. No on -site drainages occur on site in the vicinity of the borrow area and associated ponds (Pond 10 and Pond 11). Sample Collection Procedures The stream locations will be sampled as soon as possible during the storm event after discharge is noted from one or more of the adjacent ponds. Qualityssurance/Quality Control Samples will be analyzed by a laboratory certified for fecal coliform. Schedule The Commission will collect samples from the sediment basins associated with Outfall 1, Outfall 6, Outfall 7, Outfall 10, and Outfall 11 for analysis of fecal coliform as soon as possible (and not during a rain event). The Commission will attempt to collect all other stormwater samples as soon as a qualifying event occurs during hours that a certified laboratory can receive samples, and as soon as possible so that sampling can hopefully be completed prior to the first semi-annual compliance event for 2016. Other Action Items The Commission will evaluate the existing Erosion and Sediment Control Plan and stormwater features at the facility and evaluate specific structural Best Management Practice (BMP) improvements that may help reduce concentrations for parameters of concern. The Commission is also requesting that the DEQ consider eliminating some of the outfalls for future sampling events, based on the fact that several outfalls are associated with the closed landfill and do not receive stormwater from areas with pertinent industrial activities as outlined in our attached request for no -exposure certifications for these outfalls.
